California Air Gun Laws: Classification, Restrictions, and Transport

Under California air gun laws, BB guns, pellet guns, airsoft guns, and paintball markers are not classified as firearms, so buying one requires no background check, registration, or waiting period. That doesn’t make them unregulated. State law controls who can sell them to minors, how they must be colored, where you can carry them, and how you can handle them in public, with penalties ranging from a $100 infraction to felony prison time.

How California Classifies Air Guns

California uses two overlapping categories, and knowing which one applies to your device tells you which rules you face.

A “BB device” is any instrument that fires a projectile like a BB or pellet using air pressure, gas pressure, or spring action. The definition also covers paintball markers.1California Legislative Information. California Code, Penal Code – PEN 16250 If it launches a projectile with compressed air or a spring, it’s a BB device.

An “imitation firearm” is any BB device, toy gun, or replica so similar in color and overall appearance to a real firearm that a reasonable person would mistake it for one.2California Legislative Information. California Code, Penal Code – PEN 16700 Many air guns fit both categories. The imitation firearm label triggers extra rules around public display, coloring, and brandishing that don’t apply to devices that clearly look like toys or sporting equipment.

The underlying reason for the lighter treatment is a definitional one: California defines a firearm as a device that launches a projectile through a barrel by explosion or combustion.3California Legislative Information. Buying, Selling, and Giving Air Guns to Minors

Selling any BB device to a minor is a misdemeanor.5California Legislative Information. California Penal Code PEN 19910 Giving or lending one to a minor without the express or implied permission of a parent or legal guardian is also a misdemeanor.6California Legislative Information. California Penal Code PEN 19915 Between the two statutes, every way an adult could hand off a BB gun to a minor is covered.

There is no blanket prohibition on minors possessing or using air guns. A minor with parental permission can lawfully use a BB gun. The law targets the adults who supply them.

Coloring and Marking Rules

Federal law requires toy, look-alike, and imitation firearms to carry a blaze orange plug permanently inserted in the barrel, recessed no more than six millimeters from the muzzle.7Office of the Law Revision Counsel. 15 U.S. Code 5001 – Penalties for Entering Into Commerce of Imitation Firearms The federal rule exempts traditional BB guns, pellet guns, and paintball guns powered by air, gas, or spring action.8eCFR. California adds its own layer. Since January 1, 2016, BB devices firing 6mm or 8mm projectiles, which covers most airsoft guns, must meet state coloration requirements. Paintball markers firing projectiles larger than 10mm are excluded.

The practical rule: whatever colored tip, panels, or markings the manufacturer put on your air gun to comply with these rules, leave them there. Altering, removing, or covering required coloring is itself a criminal offense.

Where You Cannot Bring an Air Gun

Carrying an air gun on school property is one of the most serious mistakes an owner can make, and the penalties are heavier than most people expect for a device sold as a toy.

State law prohibits bringing or possessing any device that fires a metallic projectile through air, CO2, or spring action on the grounds of any public or private school offering instruction from kindergarten through 12th grade. BB guns, pellet guns, and paintball markers all qualify. The only exception is written permission from the school principal or their designee.9California Legislative Information. The same statute extends to public and private college and university campuses. Written permission from the president or equivalent administrator can create an exception; without it, unauthorized possession on campus is a misdemeanor.

A violation on K-12 grounds is a wobbler, meaning prosecutors can charge it as either a misdemeanor or a felony. The misdemeanor path carries up to one year in county jail. The felony path can mean state prison. The choice usually depends on whether the device was loaded, whether there was any threatening conduct, and the person’s record.

Public Display, Brandishing, and Negligent Discharge

How you handle an air gun outside your home can create three separate criminal charges, each more serious than the last.

Openly displaying or exposing an imitation firearm in a public place is prohibited.10California Legislative Information. California Code, Penal Code – PEN 20170 A first violation is an infraction with a $100 fine. Repeat offenses escalate. Walking down the street with a realistic-looking airsoft gun visible on your hip is illegal even if you never point it at anyone.

Brandishing

Pointing or waving an imitation firearm at someone in a way that would make a reasonable person fear injury is a misdemeanor carrying a minimum of 30 days in county jail.11California Legislative Information. California Code, Penal Code – PEN 417.4 A judge cannot go below that 30-day floor. Self-defense is the only statutory exception.

Negligent Discharge

Willfully firing a BB device in a grossly negligent manner that could injure or kill someone is a separate offense.12California Legislative Information. California Code, Penal Code – PEN 246.3 Gross negligence means conduct far beyond ordinary carelessness, so different from what a reasonable person would do that it shows disregard for human life. Firing a pellet gun into the air in a residential neighborhood is the kind of act that can meet the standard. Conviction is typically a misdemeanor carrying up to a year in county jail.

Hunting With Air Guns

California allows air rifles for hunting small game mammals and resident game birds. Air rifles cannot be used to take big game or migratory game birds regardless of caliber or power, because the methods-of-take regulations for those species don’t list air guns as an allowable option.4California Department of Fish and Wildlife. Because air rifles aren’t firearms, the standard firearms-related hunting requirements like the Firearm Safety Certificate don’t directly apply. You still need a valid California hunting license and must follow bag limits, seasons, and other game-specific rules. First-time license buyers must complete a hunter education course regardless of the weapon used.

Transporting Air Guns

Moving an air gun around is generally less restricted than transporting a firearm, but there are still rules.

For air travel, TSA allows compressed-air guns and paintball markers in checked baggage only, never in carry-on. The compressed-air cylinder must be detached before packing.13Transportation Security Administration. What Can I Bring? – Firearms TSA screens them alongside firearms, so expect the checked bag to be inspected.

USPS does not regulate air guns as firearms for mailing. You can ship one, but if the package contains a compressed-air cartridge or cylinder, hazardous materials rules for compressed gases apply.14Postal Explorer. Publication 52 – Hazardous, Restricted, and Perishable Mail – 43 Firearms

For vehicle transport, California does not impose the same locked-container or trunk-storage rules on air guns that apply to firearms. Local ordinances may still restrict how you carry one in a vehicle inside city limits. Keeping the air gun unloaded and cased in transit avoids most problems.

Federal Land

The National Park Service allows firearm possession in parks when it complies with the laws of the state where the park sits, but prohibits discharging firearms unless hunting is specifically authorized by federal statute. Firearms are also banned inside NPS facilities like visitor centers and ranger stations.15National Park Service. Firearms in National Parks Because air guns aren’t firearms, those specific possession rules don’t automatically extend to them, but NPS “dangerous weapons” prohibitions in facilities may. Check the regulations for the specific park or federal site before bringing an air gun.

Local City and County Ordinances

Local rules are the ones that catch owners off guard most often. Many California cities and counties layer their own restrictions on top of state law, and the most common is a flat ban on discharging any air gun within city limits. Sacramento, for example, makes it unlawful to carry or discharge an air gun anywhere in the city except in licensed shooting galleries.16Sacramento City Code. 9.32.070 Discharging Air Guns in City Similar ordinances exist in cities across the state.

Local rules can be stricter than anything the state imposes. A city can prohibit backyard target shooting that would be legal under state law, or require permits for activities the state doesn’t touch. Before setting up a target range at home or carrying an air gun in public, check your city and county municipal code. A call to the local police department’s non-emergency line usually clears up what’s allowed.
