California Consumer Assistance Program (CAP) Eligibility

Eligibility for the California Consumer Assistance Program depends on three things: your gross household income, whether your vehicle passed or failed its most recent Smog Check, and which track you want (repair help or vehicle retirement). If your income is at or below 225% of the federal poverty level and your car failed a Smog Check, you can qualify for up to $1,450 in emissions repair assistance or a $2,000 retirement payment. Retirement payments of $1,500 (for a vehicle with any recent Smog Check) and $1,350 (no income limit, but the vehicle must have failed) are also available depending on your situation.¹

2026 Income Limits

Both the repair track and the two higher-value retirement tiers require gross household income at or below 225% of the federal poverty level. The 2026 thresholds are:²

Add $12,780 for each additional household member beyond six. The only path that skips this income test is the $1,350 retirement tier.³

Repair Assistance: What Qualifies

To qualify for repair assistance, your vehicle must have failed its most recent Smog Check, and your household income must fall within the limits above. The work has to be done at a shop authorized by the Bureau of Automotive Repair; repairs at any other shop are not reimbursable. California Health and Safety Code Section 44062.1 sets the framework for the state’s contribution and your co-payment.⁴

How much the state pays depends on the vehicle’s model year. For 1996 or newer vehicles, the state covers up to $1,450 of diagnosis and emissions-related repair costs, and you pay 20% of the bill when the total is $1,812.50 or less. For 1976 through 1995 vehicles, the state’s ceiling is $1,100 and the 20% co-pay applies on totals up to $1,375. Anything above the applicable cap is your responsibility.⁵

Retirement Payments: Three Tiers

If the car isn’t worth repairing, you can scrap it through the program. The retirement track has three payment levels, and only one tier applies to your situation:³

$2,000 if you meet the income limit and your vehicle failed its most recent Smog Check.
$1,500 if you meet the income limit and your vehicle has had a completed Smog Check (pass or fail) within 180 days before you apply. Zero-emissions vehicles such as battery-electric or hydrogen fuel cell cars don’t qualify for this tier.
$1,350 with no income requirement, but the vehicle must have failed its most recent Smog Check.

For the $2,000 and $1,350 tiers, the Smog Check failure cannot be caused solely by an ignition timing adjustment, a failed gas cap test, or a tampered emissions control system.⁶ A minor gas cap issue that trips a failure won’t get your vehicle into the higher payout.

You cannot retire more than one vehicle in a 12-month period as a sole owner, or more than two as a joint owner.³

Vehicle and Registration Rules for Retirement

The retirement track has vehicle rules that trip up applicants more often than the income test. Your car must be a passenger vehicle, truck, SUV, or van with a gross vehicle weight rating of 10,000 pounds or less, and it must be subject to the Smog Check program.³

Registration must be current with a valid unexpired sticker, or all fees paid with the registration not expired more than 120 days. The vehicle must have been continuously registered in California for the two consecutive years before the current registration expiration date, with no lapses totaling more than 120 days during that period. Vehicles registered to a business, government agency, or nonprofit are excluded, as are cars in the middle of an ownership transfer or classified as junked or total-loss salvage.⁶

The dismantler also runs an inspection when you drop the car off. You have to drive the vehicle to the site under its own power. The engine has to start normally, without jump-starts or starting fluid, and the car must drive forward at least 10 yards. It also has to be reasonably intact: all doors, the hood, dashboard, windshield, exhaust system, all side panels, at least one bumper, at least one side window, the driver’s seat, and a working headlight, taillight, and brake light must be present.⁶ Cars already stripped for parts will fail this check.

Documents You Need to Prove Eligibility

Income verification is the piece most applicants underestimate. The Bureau accepts your most recent federal Form 1040 or California Form 540. A W-2 by itself is not accepted. If you don’t file taxes, alternatives include proof of current unemployment benefits, veterans’ benefits, disability payments issued within the last 60 days, or your latest Social Security annual award letter. A bank statement from the past 60 days showing Social Security direct deposit also works. If you’re using wages, submit a recent pay stub alongside your tax return.¹

You’ll also need your current vehicle registration and the most recent Smog Check report. The VIN and license plate on your application must match your registration card exactly, because the Bureau cross-references the entry against the DMV database and a small typo can hold up processing.

How to Apply

Applications go through the Bureau’s online portal or by paper form mailed to Sacramento. The Bureau’s stated review window is two weeks from receipt.⁷ Online submissions move faster because the data logs immediately.

If you’re approved, the Bureau sends an official eligibility letter with a unique authorization number. This letter controls the whole process. No contracted shop will begin repairs and no dismantler will accept your vehicle without it. Taking your car to a non-contracted shop, or scrapping it before the letter arrives, forfeits the payment. For retirement, the letter carries an expiration date; missing it voids your approval.³

If Repairs Don’t Bring the Car Into Compliance

Sometimes the repair assistance runs out and the car still fails. Two options remain. You can pivot to the retirement track if the vehicle meets those requirements. Or you can apply for a Repair Cost Waiver through the BAR Referee program: if you’ve spent at least $650 on emissions-related repairs at a licensed station and the vehicle still fails a retest, a one-time waiver may let you renew your registration and buy time. CAP repair costs count toward the $650. The waiver is limited to one per vehicle per registered owner, and it won’t apply if the emissions equipment has been tampered with or removed.
