California First Offender Program: Diversion Paths and Dismissal

California does not have a single program called the “first offender program.” What people usually mean by that phrase is diversion: a set of statutes that let an eligible defendant complete treatment, classes, community service, or other court-ordered conditions instead of being convicted, and then have the charge dismissed. Which track you qualify for depends on what you were charged with and your background. The main options are drug diversion under Penal Code 1000, general misdemeanor diversion under Penal Code 1001.95, mental health diversion under Penal Code 1001.36, and military veteran diversion under Penal Code 1001.80.

Drug Diversion for Personal-Use Offenses

Penal Code 1000 is the diversion program for minor, nonviolent drug offenses. It covers simple possession of a controlled substance, possession of drug paraphernalia, being under the influence, and cultivating marijuana for personal use.1California Legislative Information. Since a 2018 amendment, Penal Code 1000 operates as true pretrial diversion, which means no guilty plea is entered before treatment begins. That matters for your record and, if you are not a U.S. citizen, for immigration exposure.

You are disqualified if you had a conviction for a non-qualifying drug offense within the past five years, or any felony conviction within the past five years. A drug conviction older than five years does not automatically bar you. The diversion period runs 12 to 18 months and requires completion of a court-approved drug education or treatment program. If you need more time, you can ask the court for an extension.

Misdemeanor Diversion Under Penal Code 1001.95

Penal Code 1001.95 gives judges broad authority to divert almost any misdemeanor charge, and the judge can grant it even over the prosecutor’s objection.2California Legislative Information. The statute excludes three categories: offenses requiring sex offender registration under Penal Code 290, domestic violence offenses, and stalking.3California Legislative Information. California Penal Code 1001.95 DUI is not on that list, but separate Vehicle Code provisions restrict diversion for driving-under-the-influence charges, and the law in that area has been shifting. Get case-specific advice before assuming DUI diversion is available.

When granted, the case can be continued for up to 24 months. The court sets conditions tailored to the offense, such as community service, restitution, or classes.2California Legislative Information. California Penal Code 1001.95 – Court Initiated Misdemeanor Diversion Inability to pay restitution, by itself, cannot be used to deny diversion or to declare a violation.

Mental Health Diversion

Penal Code 1001.36 reaches both misdemeanor and felony charges when a mental health condition played a meaningful role in the offense.4California Legislative Information. California Penal Code 1001.36 It requires more documentation than the other programs.

To qualify, you must have a diagnosed mental disorder recognized in the current edition of the Diagnostic and Statistical Manual of Mental Disorders. Common qualifying diagnoses include bipolar disorder, schizophrenia, schizoaffective disorder, and post-traumatic stress disorder. Antisocial personality disorder and pedophilia are specifically excluded. A qualified mental health professional must confirm that the disorder was a significant factor in the charged offense, and the court must find that treating you in the community would not pose an unreasonable risk to public safety.

The maximum diversion period is two years for felony charges and one year for misdemeanors.5California Legislative Information. California Penal Code 1001.36

Certain serious charges are excluded entirely: murder and voluntary manslaughter, rape, lewd acts on a child under 14, assault with intent to commit rape or similar sex crimes, continuous sexual abuse of a child, most offenses requiring sex offender registration, and use of weapons of mass destruction.4California Legislative Information. California Penal Code 1001.36 Vehicle Code 23640 also blocks mental health diversion for DUI.

Military Veteran Diversion

Current and former U.S. military members have their own track under Penal Code 1001.80, which covers both misdemeanors and felonies.6California Legislative Information. California Penal Code 1001.80 It recognizes that service-connected conditions like PTSD, traumatic brain injury, military sexual trauma, substance abuse, and other mental health problems can contribute to criminal conduct.

For a misdemeanor, you need to show military service and that you may be suffering from a qualifying service-connected condition. For a felony, the condition must have been a significant factor in the offense. The statute tilts toward the defendant: the court must find the connection exists unless clear and convincing evidence shows otherwise.6California Legislative Information. The maximum diversion period is two years, with progress reports to the court at least every six months. Excluded offenses mirror the mental health list: murder, voluntary manslaughter, rape, certain sex crimes against children, most offenses requiring sex offender registration, and weapons of mass destruction charges.6California Legislative Information. How You Apply

Your defense attorney files a formal request asking the judge to consider diversion. The request identifies the statute, shows you meet the eligibility rules, and attaches supporting documentation such as treatment records, a mental health evaluation, or military service records.

The court reviews your criminal history, the facts of the case, and the prosecution’s position. Under Penal Code 1000, the prosecutor’s office typically makes the initial eligibility call. Under Penal Code 1001.95, the judge decides regardless of the prosecutor’s view.2California Legislative Information. If diversion is granted, you agree to the conditions, waive your right to a speedy trial, and criminal proceedings pause. The clock starts on your diversion period, and you begin whatever the court ordered.

If You Don’t Complete the Program

Diversion is not automatic protection. If you miss appointments, pick up a new charge, or fail to meet the conditions, the court holds a hearing to decide whether to reinstate the original criminal case. For veteran diversion, the same kind of hearing follows if you appear to be performing unsatisfactorily or not benefiting from treatment.6California Legislative Information. If proceedings are reinstated, your case picks up where it left off. You face the original charges as if diversion never happened. People sometimes treat diversion casually because no conviction is on the books yet, and that is where most failures start.

What Dismissal Actually Gets You

Complete all conditions within the diversion period, and the court dismisses the charge. Under California law, the arrest is generally deemed to have never occurred, and you can respond to most employment and housing questions by saying you were not arrested for or convicted of the offense.7California Legislative Information. Records do not always disappear on their own. After drug diversion under Penal Code 1000, you may need to file a petition to seal your arrest and court records using the specific court forms and serve the petition on the prosecuting agency. Expect to take that step rather than assume it happens automatically.

One boundary to know: even after successful completion and sealing, the arrest can still be disclosed on applications for law enforcement positions, and you must disclose it if a peace officer application asks directly.7California Legislative Information. California Penal Code 1001.9

Noncitizens: Diversion Is Not a Guarantee

If you are not a U.S. citizen, California diversion does not necessarily protect you from immigration consequences. Federal immigration law uses its own definition of “conviction,” and the Board of Immigration Appeals has held that certain diversion arrangements, particularly older ones that required a guilty plea or admission of facts before entering the program, can still count as convictions for deportation and inadmissibility. California’s shift from deferred entry of judgment to true pretrial diversion under Penal Code 1000 was partly a response to this problem, but the risk has not vanished.
