The California gambling tax treats winnings as ordinary income, stacked on top of your wages and other earnings and taxed at the state’s progressive rates of 1% to 12.3%, with a 1% mental health services surcharge pushing the top rate to 13.3% on taxable income above $1 million.1Franchise Tax Board. The one meaningful state-level exception is the California State Lottery, whose prizes are exempt from California income tax but still fully taxable federally.
What California Taxes as Gambling Income
Everything counts. Casino table games, slots, card rooms, racetracks, raffles, fantasy sports, poker tournaments, and lotteries from other states all produce taxable winnings.2Internal Revenue Service. Non-cash prizes are taxed at their fair market value. Win a $35,000 car at a casino event and you owe income tax on $35,000, even though no money changed hands. Many winners either sell the prize or pay the tax bill out of savings.
The California State Lottery Exception
Winnings from the California State Lottery, including SuperLotto Plus and Powerball or Mega Millions tickets bought in California, are exempt from California state income tax.1Franchise Tax Board. This exemption is narrow. Buy a winning Powerball ticket across the state line in Nevada and the prize is fully taxable on your California return.
Sports Betting
Sports betting is not legal in California as of 2026. Voters rejected Propositions 26 and 27 in November 2022, and no new measure has qualified since. If you place sports wagers through offshore or out-of-state platforms, the winnings are still taxable, even though the activity itself is not state-sanctioned.
How the State Rate Actually Hits a Winning
There is no flat California gambling tax rate. Your winnings pile onto the rest of your income for the year, and the combined total decides which brackets they fall into.6Franchise Tax Board. 2025 California Tax Rate Schedules That means a single win can be taxed at several rates at once as it crosses bracket lines.
Consider a single filer earning $70,000 in wages who wins a $50,000 poker tournament. Combined income is now $120,000. The wages are taxed as they were, but the $50,000 prize lands mostly in the 9.3% bracket, which starts around $72,700 for single filers. A $500,000 jackpot in the same scenario would push much of the prize into the 11.3% bracket. Bigger wins reach higher marginal rates fast.
Federal Reporting and W-2G Thresholds
All gambling winnings go on your federal return through Schedule 1 (Form 1040), line 8b, whether or not you receive a form from the payer.2Internal Revenue Service. Starting in 2026, the IRS reporting threshold for slot machines and bingo is $2,000, up from the longstanding $1,200, and it will keep adjusting for inflation annually.7Internal Revenue Service. Instructions for Forms W-2G and 5754 (Rev. January 2026) For keno, the $2,000 threshold applies after subtracting the wager.
Getting a form and owing tax are different questions. A $500 blackjack payout, a $1,900 slot hit, or a $200 sports bet are all fully taxable even though no W-2G is issued. The Franchise Tax Board receives copies of every W-2G, so mismatches get flagged, but the legal obligation to report is the same whether or not a form exists.
Federal and State Withholding
Payers must withhold 24% for federal income tax when a payout minus the wager exceeds $5,000 on sweepstakes, wagering pools, lotteries, and certain parimutuel or sports wagers.8Internal Revenue Service. Instructions for Forms W-2G and 5754 (01/2026) If you fail to provide a valid Taxpayer Identification Number, federal backup withholding also applies at 24%.9Internal Revenue Service. On the state side, California requires payers to withhold 7% of California-sourced gambling winnings paid to nonresidents once total payments exceed $1,500 in a calendar year.3Franchise Tax Board. Without a valid TIN, California backup withholding kicks in at 7% with no minimum threshold and no waiver.10Franchise Tax Board. Deducting Gambling Losses
Losses are deductible on both federal and California returns, but only up to the amount of gambling income you report that year.2Internal Revenue Service. Topic No. 419, Gambling Income and Losses Gambling never generates a net tax deduction. Won $10,000 and lost $15,000? You can deduct $10,000. The extra $5,000 is gone and cannot be carried forward.
Losses are claimed as “Other Itemized Deductions” on Schedule A, so you have to itemize instead of taking the standard deduction. For 2026, the federal standard deduction is $16,100 for single filers and $32,200 for joint filers.12Internal Revenue Service. Records That Actually Hold Up
Loss deductions usually fall apart in audits because taxpayers know they lost money but cannot prove the specifics. The IRS expects a contemporaneous diary or log covering:
- The date and type of wager or game
- The name and address of the establishment
- The names of people with you
- Amounts won or lost in each session
Keep the supporting paper too: W-2G forms, wagering tickets, canceled checks, credit card records, and payout slips.14Internal Revenue Service. A spreadsheet reconstructed years later does not.
Estimated Tax After a Big Win
A large jackpot can trigger a requirement to make quarterly estimated tax payments. Even after 24% federal and any 7% state withholding, you may still owe substantial tax if the winnings push your total income into higher brackets. For 2026, the IRS requires estimated payments if you expect to owe at least $1,000 after withholding and credits, and your withholding will cover less than the smaller of 90% of your 2026 tax or 100% of your 2025 tax (110% if your 2025 adjusted gross income was over $150,000).15Internal Revenue Service. 2026 Form 1040-ES Estimated Tax for Individuals
The 2026 quarterly deadlines are April 15, June 15, September 15, and January 15, 2027. If you win midyear, you calculate the payment for the quarter in which the income was received rather than going back to earlier quarters. Splitting a Prize With a Group
When several people share a winning ticket or wager, whoever collects the prize should file IRS Form 5754 (Statement by Person(s) Receiving Gambling Winnings) before leaving the establishment. The form lists each winner’s name, address, TIN, and share.7Internal Revenue Service. Instructions for Forms W-2G and 5754 (Rev. January 2026) The payer then issues a separate W-2G to each winner.
Skip Form 5754 and the entire prize gets reported under one Social Security number, leaving that person on the hook for tax on money they largely handed to other people. The reporting and withholding thresholds apply to the total winnings before splitting, not each share, so a group ticket paying $8,000 to five people is measured against the thresholds as $8,000 even though each person walks away with $1,600.
Winning in Another State
California residents who gamble across state lines can face tax in both places. Many states withhold on gambling winnings paid to nonresidents. California provides a credit for taxes paid to other states on the same income through Schedule S (Other State Tax Credit), attached to Form 540 along with a copy of the other state’s return.17Franchise Tax Board. 2025 Instructions for Schedule S Other State Tax Credit
The credit is capped at the California tax that would otherwise be due on the same income. If the other state’s rate is lower, you still owe California the difference. If it is higher, the excess is not refundable by California; that is between you and the other state.
