California Penal Code 261: Rape Penalties and Consequences

California Penal Code 261 defines rape as an act of nonconsensual sexual intercourse and treats it as a felony punishable by three, six, or eight years in state prison. A conviction also requires sex offender registration, counts as a strike under California’s Three Strikes Law, and carries longer prison terms when the victim is a minor. After SB 258 took effect on January 1, 2026, the statute covers all rape offenses, including acts formerly prosecuted under the repealed spousal rape statute at Penal Code 262.

What Penal Code 261 Covers

Rape under Penal Code 261 is sexual intercourse accomplished without the other person’s consent.1California Legislative Information. California Penal Code 261 – Rape Only slight penetration is required, and ejaculation is not an element. The prosecution must prove beyond a reasonable doubt that the intercourse happened and that the victim did not consent.

The most commonly charged form involves accomplishing the act against the victim’s will through force, violence, duress, menace, or fear of immediate bodily injury to the victim or someone else.2California Legislative Information. When Consent Is Legally Impossible

The statute also criminalizes intercourse in situations where the victim cannot legally consent, regardless of whether the victim physically resisted.1California Legislative Information. California Penal Code 261 – Rape

  • The victim was asleep, unconscious, or otherwise unaware the act was occurring, and the accused knew it.
  • Alcohol, drugs, or an anesthetic substance left the victim unable to resist, and the accused knew or should have known.
  • A mental disorder, developmental disability, or physical disability prevented the victim from legally consenting, and the accused knew or should have known.
  • The accused tricked the victim into believing the penetration served a professional purpose, such as a medical procedure, when it did not.
  • The accused used deception to impersonate someone the victim knew, inducing the victim to submit.

How the Law Defines Consent

Penal Code 261.6 defines consent as positive cooperation in an act, given freely and voluntarily by a person who knows what is happening.3California Legislative Information. California Penal Code 261.6 – Consent Silence is not consent. Lack of resistance is not consent. Agreement under threat or deception is not consent. The prosecution does not have to prove the victim fought back, only that the victim did not freely and knowingly cooperate.

Prison Sentence and Fine

Penal Code 264 sets punishment at three, six, or eight years in state prison.4California Legislative Information. California Penal Code 264 – Punishment for Rape The judge picks among the three terms after weighing aggravating and mitigating circumstances.

Strike Offense and Violent Felony Status

Every rape conviction under Penal Code 261 is a “serious felony” under Penal Code 1192.7 and therefore counts as a strike.5California Legislative Information. California Penal Code 1192.7 – Serious Felony A defendant with one prior strike faces a doubled sentence on any later felony. Two prior strikes trigger 25 years to life.

Rape accomplished by force or violence, and rape in which the defendant administered an intoxicating substance without consent, also qualify as “violent felonies” under Penal Code 667.5.6California Legislative Information. California Penal Code 667.5 – Violent Felony That label requires the defendant to serve at least 85 percent of the sentence before becoming eligible for release.

Sex Offender Registration

A rape conviction under Penal Code 261 triggers mandatory sex offender registration under Penal Code 290.7California Legislative Information. California Penal Code 290 – Sex Offender Registration Act California uses a tiered system, and the tier depends on the type of rape.

  • Tier 3, lifetime registration, applies to rape involving force or violence, intoxication, or unconsciousness, and to any rape sentenced under the enhanced minor-victim penalties in Penal Code 264(c).
  • Tier 2, minimum 20 years, applies to other qualifying rape convictions that do not fall into the Tier 3 subdivisions, such as rape by fraud or impersonation.7California Legislative Information. California Penal Code 290 – Sex Offender Registration Act

Failing to register is a separate crime.

How Long Prosecutors Have to File Charges

For rape committed on or after January 1, 2017, there is no statute of limitations. Prosecutors can bring charges at any time.

For earlier conduct involving a victim who was under 18 at the time, Penal Code 801.1 allows prosecution until the victim turns 40, provided the offense occurred on or after January 1, 2015, or the previous limitations period had not yet run by that date.8California Legislative Information. Immigration Consequences for Non-Citizens

Federal law treats rape as an “aggravated felony” under the Immigration and Nationality Act.9Legal Information Institute (Cornell Law School). 8 USC 1101(a)(43) – Aggravated Felony Definition A non-citizen convicted of rape becomes deportable and is generally cut off from most forms of relief from removal, including asylum and cancellation of removal.

An aggravated felony conviction on or after November 29, 1990, is also a permanent bar to the good moral character required for naturalization.10USCIS. Permanent Bars to Good Moral Character For immigration purposes, the term of imprisonment is the full sentence ordered by the court, even if part or all of it was suspended. Related Sexual Offenses

Penal Code 261 does not cover every sex offense. Statutory rape lives at Penal Code 261.5 and applies to intercourse with a person under 18 even when the act appears consensual; it can be charged as a misdemeanor or a felony depending on the age gap, and it is a misdemeanor only when the parties are within three years of each other. Spousal rape is no longer separate. The former Penal Code 262 has been repealed and folded into Penal Code 261, so rape of a spouse carries the same penalties as any other rape under the statute.4California Legislative Information.
