California Window Tint Ticket: Fix-It Cost, Legal Limits, Exemptions

A California window tint ticket usually costs $25 if you treat it as a fix-it ticket and correct the problem before your court date. Ignore it, and penalty assessments push the total to roughly $196 or more. The gap between those two numbers is entirely about how fast you act.

The $25 Fix-It Path

Most tint citations are issued as correctable violations under Vehicle Code 40610, which means the officer hands you a notice to correct rather than a standard infraction.1California Legislative Information. The officer’s estimate of reasonable correction time on the citation cannot exceed 30 days.1California Legislative Information. California Vehicle Code 40610 Before your appearance date:

  • Remove or adjust the tint so the vehicle complies.
  • Take the car and the citation to a law enforcement officer, who will inspect the windows and sign the back of the ticket confirming the correction.3Superior Court of California. Types of Violations

What the Fine Grows to If You Don’t Fix It

California stacks penalty assessments and surcharges on every base fine. On a $25 base, the state adds $27 in penalty assessments for every $10 of the fine (or portion of $10), a 20-percent state surcharge, a $40 court security fee, a $35 infraction conviction assessment, and a $10 administrative fee.5Superior Court of California, Amador County. Paying the full bail amount without correcting the tint gets you an infraction conviction on your record instead of a dismissal. The violation itself does not add points to your driving record because it is an equipment violation rather than a moving violation. But the conviction stays on file, and nothing prevents another officer from citing you again the next time your windows fail the meter test. A missed court date can also trigger a failure-to-appear notice, which may lead to a license suspension or a bench warrant.

What Counts as Legal Tint

Two statutes govern window film in California. Section 26708 lists what you can put on your windows, and Section 26708.5 prohibits aftermarket material that reduces light transmittance except where 26708 allows it.6California Legislative Information. California Vehicle Code 26708.5

Windshield

You can apply transparent material to the topmost portion of the windshield, but the bottom edge must sit at least 29 inches above the driver’s seat in its lowest and rearmost position. On most vehicles that works out to a strip four to five inches from the top of the glass. The material cannot be red or amber.7California Legislative Information. California Vehicle Code 26708

Front Side Windows

Aftermarket tint film that reduces light transmittance is not allowed on the windows immediately left and right of the driver.6California Legislative Information. California Vehicle Code 26708.5 Factory-tinted safety glass is permitted if it meets the federal standard (FMVSS No. 205), which requires at least 70-percent visible light transmittance for glass areas needed for driving visibility.8National Highway Traffic Safety Administration. 11-000697 Trooper Kile 205 Your front side windows need to let through at least 70 percent of visible light, film or no film.

Rear Side Windows and Rear Window

Side windows behind the driver are exempt, so you can tint them as dark as you want. The rear window is also exempt if the vehicle has side mirrors on both sides giving a clear view of at least 200 feet behind the car.7California Legislative Information. Medical Exemptions

Two exemptions exist, and they work differently depending on where the film goes.

For the front side windows, you can install sun screening devices if you carry a letter from a licensed physician certifying a medical condition requiring sun protection, or a letter from a licensed optometrist certifying a visual condition. For the windshield and other windows, you can apply clear, colorless, transparent UV-blocking film with a certificate from a licensed dermatologist. The film must allow at least 88 percent of visible light through on its own, and once applied the glass-and-film assembly must still meet the federal 70-percent standard. Keep the documentation in the vehicle. If you’re pulled over, the officer will want to see it on the spot.

When the Officer Won’t Offer a Fix-It Ticket

An officer can skip the correctable violation option if there is evidence of fraud, persistent neglect, an immediate safety hazard, or if you refuse to promptly correct the problem.1California Legislative Information. California Vehicle Code 40610 You then get a standard notice to appear, and the full fine with penalty assessments applies from the start. Second and third tint citations are more likely to be written this way, since a repeat stop reads as persistent neglect.

Challenging the Meter Reading

Officers measure visible light transmittance with a handheld tint meter that clamps on either side of the glass, with one side emitting light and the other reading how much passes through. Most California departments use digital meters, and those meters require regular calibration. Departments are expected to keep calibration records. If you plan to fight the ticket rather than fix the tint, the calibration history of the specific meter used on your car is the first thing to request.
