A wet reckless in California is a plea bargain, not a charge police can arrest you for. Under Vehicle Code Section 23103.5, a driver originally charged with DUI pleads guilty to reckless driving, and the court adds a notation that alcohol or drugs were involved.1California Legislative Information. California Vehicle Code 23103.5 The immediate penalties are lighter than a DUI across the board, but the conviction still goes on your criminal record, still counts as a prior DUI for ten years, and can still create license, insurance, and travel problems long after the case closes.
How the Plea Works
The underlying offense is reckless driving under Vehicle Code Section 23103. What makes it “wet” is the alcohol notation the court attaches at sentencing. That notation is the reason a wet reckless counts as a priorable DUI later; without it, the offense would be a standard “dry” reckless with no alcohol flag and no DUI-prior consequences.
Prosecutors have wide discretion about when to offer the reduction. No statute requires it. In practice, the offer tends to come up when:
- Your BAC was borderline, close to 0.08%, especially if the test happened well after the stop.
- There are reliability problems with the chemical test, such as calibration issues or a long gap between the stop and the blood draw.
- You have a clean record and no prior DUIs or serious traffic history.
- You enrolled voluntarily in an alcohol education program before the case resolved.
A high BAC, an accident, injuries, or a prior DUI on your record makes the offer unlikely. What one county routinely offers, another refuses, so local practice matters.
Penalties for a Wet Reckless Conviction
Because you are technically pleading to reckless driving, the penalty framework comes from Vehicle Code Section 23103.2California Legislative Information. California Vehicle Code 23103
Jail
The statute allows a minimum of five days and a maximum of 90 days in county jail. Most first-time wet reckless defendants receive no actual jail time, or a short sentence that can be served through community service or work release.
Fines
The base fine ranges from $145 to $1,000. That is only the starting figure. California adds penalty assessments, court construction fees, state surcharges, and restitution fund contributions that typically multiply the base by four or five times. A $500 base fine can turn into $2,000 or more once everything is added.
Probation
Wet reckless probation typically runs one to two years, usually informal (also called summary or unsupervised). You must stay out of trouble and complete any court-ordered programs. Shorter probation is one of the quieter advantages of the plea, because a probation violation on a longer DUI probation can reopen consequences years later.
Alcohol Education
State law requires anyone convicted of a wet reckless to complete a 12-hour alcohol education program.3California Department of Health Care Services. DUI Programs Program fees generally run a few hundred dollars.
Wet Reckless vs. First-Offense DUI
Laid out side by side, the differences show why defense attorneys push for the reduction whenever the facts allow:
- Maximum jail: 90 days versus six months for a first DUI under Vehicle Code Section 23536.4California Legislative Information. California Vehicle Code 23536
- Minimum jail: 5 days versus 96 hours (at least 48 continuous) for a first DUI.
- Base fine floor: $145 versus $390.
- Probation: One to two years versus three to five years.
- Alcohol program: 12 hours versus 30 hours for the standard first-offense DUI program.
- Court-ordered license suspension: None for a wet reckless; mandatory for a DUI.
The one area where the wet reckless offers no advantage is priorability. Both convictions count equally as priors for ten years.
What Happens to Your License
The license side is where people most often get tripped up, because the criminal court and the DMV operate on separate tracks.
A wet reckless conviction on its own does not trigger a court-ordered license suspension. That is a genuine benefit over a DUI conviction. But the DMV runs its own administrative process based on your arrest, not your conviction. If you were arrested for DUI and either failed or refused a chemical test, the DMV will pursue a four-month administrative suspension regardless of how the criminal case resolves.5California DMV. A reckless driving conviction also adds two points to your driving record. Enough points within a set window (four in 12 months, six in 24, or eight in 36 for standard licenses) makes the DMV eligible to declare you a negligent operator and suspend your license on that basis alone. If you already have points, a wet reckless can push you over.
Insurance and SR-22
Insurance carriers treat a wet reckless almost the same as a DUI. The alcohol notation tells them this was not ordinary reckless driving, and most raise premiums substantially. Expect elevated rates for three to five years, depending on the carrier and your overall record.
If your license was suspended through the DMV’s administrative process, you will need an SR-22 certificate of financial responsibility to reinstate driving privileges. The SR-22 is not insurance itself; it is a form your insurer files with the DMV certifying that you carry at least state-minimum liability coverage. You typically maintain the filing for three years, and any lapse in the policy during that period triggers an automatic suspension. Not every insurer offers SR-22 filing, and those that do often charge higher premiums.
The 10-Year Priorability Trap
This is the single most important thing to understand before accepting a wet reckless. Under Section 23103.5, if you are convicted of DUI within ten years of the wet reckless, the new DUI is treated as a second offense. Second-offense penalties are dramatically harsher: mandatory minimum jail of 96 hours going up to one year, higher fines, a two-year license suspension, and a longer alcohol program.
The ten-year clock runs from the date of the original arrest, not the conviction. Priorability is the tradeoff that makes a wet reckless a compromise rather than a clean win. You get lighter immediate penalties, but any DUI arrest within the decade carries amplified consequences. The relief of avoiding a DUI conviction can make people feel the problem is behind them. It is not, for ten years.
Travel and Immigration
Canadian border officials assess admissibility based on Canadian equivalents of your conviction, not California’s label.6Government of Canada. You may be turned away at the border or need to apply for a Temporary Resident Permit or criminal rehabilitation to get in.
For non-citizens in the United States, the stakes can be higher. An alcohol-related conviction may surface during visa renewal or re-entry. At a minimum you may face a mandatory medical exam before a new visa is issued. In worse scenarios the visa can be denied or revoked. Anyone on a non-immigrant visa should involve an immigration attorney before accepting a wet reckless plea, not just a criminal defense lawyer.
Professional and Commercial Licenses
Some occupations carry consequences beyond the standard penalties.
Commercial Drivers
Reckless driving is a “serious traffic violation” under federal regulations. A single conviction does not automatically disqualify a CDL holder, but a second serious violation within three years triggers a 60-day disqualification, and a third triggers 120 days.7eCFR. 49 CFR 383.51 – Disqualification of Drivers For a commercial driver, a wet reckless starts a three-year window in which any additional serious violation puts the CDL at risk.
Pilots
FAA certificate holders must report any alcohol-related motor vehicle conviction in writing within 60 calendar days. A wet reckless with an alcohol notation qualifies. The report goes to the FAA’s Security and Hazardous Materials Safety Office; a phone call does not satisfy the requirement. Failing to file within the 60-day window is itself grounds for suspension or revocation of pilot certificates.8Federal Aviation Administration. Other Licensed Professionals
Healthcare workers, attorneys, teachers, and others holding state-issued licenses may face disciplinary review after an alcohol-related conviction. Reporting requirements and tolerance vary by board. A wet reckless is generally viewed more favorably than a DUI in these proceedings, but it still triggers the disclosure obligation and can lead to probation, monitoring, or license conditions.
Ignition Interlock Devices
A wet reckless does not carry a mandatory ignition interlock device unless a judge specifically orders one. First-time DUI offenders also avoid a mandatory IID in most cases, but repeat DUI offenders and those with injury DUIs face one to four years of IID requirements.9California DMV.
