Yes, a parent can be an IHSS provider for their child in California. Since February 19, 2024, any parent who meets the program’s standard provider requirements can be paid to deliver authorized In-Home Supportive Services to their own child with a disability. The pay covers care tasks that go beyond what a child of the same age without a disability would ordinarily need, not routine parenting.
What the 2024 Law Actually Changed
For years, parents ran into two barriers that other IHSS providers did not. They had to prove they could not hold full-time work because of their child’s care needs, and they had to show no other suitable provider was available. Assembly Bill 1085 amended Section 12302 of the Welfare and Institutions Code and struck both requirements. You no longer justify your employment status. You no longer document a search for someone else. You enroll the same way any other IHSS provider enrolls.
What You Can Actually Be Paid For
This is where families are most often caught off guard. IHSS does not pay parents for ordinary childcare. It pays for the care your child needs that a non-disabled child of the same age would not.
A two-year-old without a disability needs help bathing and eating, so those tasks are considered normal parenting at that age and are not authorized. An eight-year-old who needs full assistance with bathing, dressing, or feeding because of a disability is a different case, because those tasks go well beyond what an eight-year-old would typically require. The county social worker measures the gap between what your child needs and what any child that age would need, and only the gap turns into authorized hours.
The service categories a parent provider can be authorized to perform include:
- Personal care such as bathing, dressing, grooming, and feeding.
- Domestic services like housecleaning, meal preparation, and laundry tied to the child’s condition.
- Accompaniment to medical appointments and other necessary health-related destinations.
- Protective supervision for children with a mental impairment who cannot safely be left alone. The child must need substantially more monitoring than a same-age child without a mental impairment. This category can push total authorized hours up to the IHSS maximum of 283 per month.1California Department of Social Services. Assessment and Authorization Part IV
- Paramedical services such as injections, wound care, or catheter maintenance that a licensed health care professional has ordered and trained you to perform.
Two Things Have to Line Up
Your child has to qualify for IHSS, and you have to qualify as a provider. Both tracks run at the same time.
Your Child’s Eligibility
Your child must live in California and have a Medi-Cal eligibility determination.2CDSS Public Site Department of Social Services. IHSS for Children A child on Supplemental Security Income is automatically Medi-Cal eligible. Children whose family income is too high for SSI may still qualify with a share of cost. Children enrolled through a Regional Center Home and Community-Based Services waiver may have only the child’s own income counted for Medi-Cal purposes.
The child must also have a physical or mental impairment expected to last at least one year that limits daily activities.3California Department of Social Services. A county social worker then schedules an in-home assessment to authorize specific services and set monthly hours.4Department of Social Services. Your Eligibility as the Provider
You must live in the same household where the child primarily resides. In a joint custody situation, the parent whose home the child spends the majority of time in is the one who can serve as provider. You must be legally authorized to work in the United States and will complete Form I-9 during enrollment.6California Department of Social Services. Every prospective provider is fingerprinted and background-checked. Any conviction beyond minor traffic violations requires a criminal record exemption from CDSS before you can enroll. Certain serious offenses, including robbery, sexual battery, child abuse, elder abuse, arson, and kidnapping, cannot be exempted at all. You cannot begin working as a provider until CDSS grants an exemption, if one is needed. A denied exemption can be appealed in writing within 15 days of the denial letter.7CDSS – CA.gov. Enrolling as Your Child’s Provider
Attend a provider orientation, which some counties offer online. At the enrollment appointment, bring your original government-issued ID and your original Social Security card. You sign the Provider Enrollment Form (SOC 426) and the Provider Enrollment Agreement (SOC 846).8CDSS – CA.gov. Plan for roughly six weeks for the fingerprinting and background check to clear after your enrollment appointment. You cannot be paid for services until the county officially enrolls you.10California Department of Social Services. Pay, Hours, and the Multi-Child Trap
IHSS wages are set at the county level. As of 2026, California’s state minimum wage of $16.90 per hour is the floor.12California Department of Industrial Relations. Minimum Wage Some counties negotiate higher rates through their Public Authority. San Francisco pays around $23.00 per hour. Counties without supplemental agreements pay at or near the state minimum. Your county’s IHSS Public Authority can confirm the current local rate.
Providers are paid biweekly after submitting approved timesheets. Overtime is paid at one and a half times your regular hourly rate after 40 hours in a workweek. If you serve one child, your authorized hours usually will not approach overtime.
If you serve two or more IHSS recipients, watch the caps. Providers with multiple recipients are capped at 66 hours per workweek combined without an approved exemption.13CDSS – CA.gov. IHSS Overtime Exemption 2 Two exemptions exist that can raise the limit to 90 hours per week and 360 hours per month, one for certain live-in family care providers who met the criteria on or before January 31, 2016, and one for extraordinary circumstances such as complex medical or behavioral needs, rural areas with limited provider availability, or language match. Both are requested through the county on their own forms.
Exceeding workweek or overtime limits without approval counts as a violation. First violation brings a written notice. Second brings a chance to complete a one-time training within 14 calendar days to avoid the violation being recorded. Third is a 90-day suspension. Fourth is a 365-day termination, after which you re-enroll from scratch. Violations reduce by one for each year you go without a new one.
Taxes and Your Child’s SSI
Because parent providers live with the child, most qualify for a significant tax break. Under IRS Notice 2014-7, wages earned by IHSS providers who live in the same home as the recipient are excluded from gross income for federal income tax purposes. California applies the same exclusion to state income tax. Your IHSS pay would not appear as taxable income on your W-2; the exempt wages show up in Box 12-II instead.14CDSS – CA.gov. The exclusion covers federal and state income taxes only. It does not exempt you from FICA (Social Security and Medicare) taxes.14CDSS – CA.gov. Live-In Provider Self-Certification Information Confirming your withholding setup with a tax professional is worthwhile, especially in the first year.
On SSI, the Social Security Administration has addressed the deeming question directly: IHSS payments to an ineligible parent living in the same household as an eligible child are excluded from income for deeming purposes.15Social Security Administration – Program Operations Manual System (POMS). If Your Application or Enrollment Is Denied
If your child’s IHSS application is denied, or the authorized hours seem too low, you can request a state fair hearing from the California Department of Social Services. If the county reduces hours on a case already in service, requesting a hearing before the effective date of the reduction can keep existing services in place while the appeal is pending.
If your enrollment as a provider is denied, you have 60 days from the date the county notifies you to file an appeal.16CDSS – CA.gov.
