Yes, felons can get food stamps in California. The state opted out of the federal lifetime ban that once blocked anyone with a drug-related felony from receiving SNAP, so a past felony conviction by itself does not disqualify you from CalFresh. What can disqualify you is an active legal status: an outstanding felony warrant with law enforcement actively looking for you, a verified probation or parole violation, or current incarceration. If you have a drug felony and are still on supervised release, you also need to be in compliance with your conditions.
The Drug Felony Opt-Out
The federal Personal Responsibility and Work Opportunity Reconciliation Act of 1996 imposed a lifetime food stamp ban on anyone convicted of a drug-related felony. The opt-out is not unconditional. Non-drug felonies are not addressed by the federal ban at all, so they do not affect CalFresh eligibility in California either.
Statuses That Do Block Eligibility

Fleeing felons. If you have an outstanding felony warrant and law enforcement is actively seeking you, you cannot receive CalFresh until the warrant is resolved through surrender, arrest, or recall. Probation or parole violators. A verified violation of your probation or parole conditions blocks benefits until the violation is addressed with the court or your supervising agency.

While You Are Incarcerated
You cannot receive CalFresh while you are in custody. Benefits stop when you enter, and you apply again after release. California does not have a statewide pre-release application program, so in most counties you file once you are out. Most CalFresh households in California face no cap on savings, bank balances, or vehicle value. You do not have to spend down assets to qualify, which matters if you are rebuilding after time in custody.

Work Requirements Starting February 2026
Beginning February 1, 2026, adults aged 18 to 64 without dependents under 14 must work, take part in a SNAP Employment and Training program, or volunteer at least 80 hours a month to keep benefits. The previous cutoff was age 54, so the pool covered by the rule is expanding.
Exemptions include veterans, people experiencing homelessness, former foster youth who were in care on their 18th birthday and are 24 or younger, pregnant people, anyone with a physical or mental health condition that limits their ability to work, and people in a substance abuse treatment program.8Food and Nutrition Service. The treatment exemption is worth knowing if you have a drug conviction, because the same program participation can satisfy both the CalFresh work rule and the compliance condition attached to the drug felony opt-out.

Answer the Criminal History Questions Honestly
The application does ask about criminal history. Answer accurately.
