How Long Visitors Can Drive on a Foreign License

A visitor with a valid, unexpired foreign license can drive in Texas for up to one year from the date of entry into the United States, or until becoming a Texas resident, whichever comes first.1Department of Public Safety. There’s an age limit that surprises people. Reciprocal driving privileges apply only to drivers between 18 and 75.1Department of Public Safety. Driving Privilege Reciprocity Anyone younger or older can’t rely on the reciprocity rule and would need to apply for a Texas license.

Which Countries Texas Recognizes

Texas doesn’t recognize every foreign license. The state follows international agreements the federal government has signed, so your country needs to be a party to one of them:

  • The 1949 Geneva Convention on Road Traffic, which covers most of Western Europe and parts of Asia, Africa, and the Americas.
  • The 1943 Inter-American Convention on Automotive Traffic, covering several countries in the Western Hemisphere.
  • The NATO agreement, covering NATO member nations.

The U.S. State Department also extends recognition to several countries that were formerly part of the Soviet Union or Yugoslavia, including Ukraine, Estonia, Latvia, Lithuania, Croatia, and Serbia.1Department of Public Safety. What You Have to Carry

Under the international agreements, your foreign license must be translated into English. You can meet this in one of two ways: an International Driving Permit or a certified English translation of your license.1Department of Public Safety. Whenever you’re behind the wheel, keep your foreign license, your IDP or certified translation, and your passport or other identification on you. An officer who can’t read your credentials during a stop will make the encounter longer and harder than it needs to be.

Insurance Is Still Required

A foreign license doesn’t exempt you from Texas insurance requirements. Every driver must carry minimum liability coverage of $30,000 for bodily injury per person, $60,000 per accident, and $25,000 for property damage.4Texas Department of Insurance. For a rental car, buying coverage through the rental company is the simplest path. For longer stays with a borrowed or purchased vehicle, some insurers write temporary policies for periods under six months. Premiums tend to be higher because most insurers won’t credit your foreign driving history, and some will require an IDP before they issue a policy at all.

When You Become a Texas Resident

Once you establish residency, the visitor rules stop applying. You have 90 days from the date you move here to apply for a Texas driver’s license, and you can drive on your valid foreign license during that window.2State of Texas. Residency isn’t purely about time. It’s about intent. The DPS looks at whether you’ve shown you mean to make Texas your permanent home, weighing things like living here more than 30 days, enrolling children in a Texas school, or registering to vote. Getting a Texas License as a Foreign License Holder

Apply in person at a DPS office, by appointment. You’ll need documents proving your identity and lawful presence, your Social Security Number, and Texas residency.

A valid foreign passport paired with a current I-94 form is the usual combination for identity and lawful presence. Your visa can be expired as long as the I-94 is not. DPS verifies your immigration status with the Department of Homeland Security, and the license won’t issue until that clears.6Department of Public Safety. Bring two documents showing your Texas address, with at least one showing 30 days of residency.

You’ll take a vision exam, a written knowledge test, and a behind-the-wheel skills test. Applicants between 18 and 24 must complete a six-hour adult driver education course before testing.7Department of Public Safety. Penalties for Driving Without a Valid License

Driving in Texas without a valid license, whether because your foreign license expired, you overstayed the 90 days, or your home country isn’t covered by a reciprocity agreement, is a Class C misdemeanor on the first offense. If you’re also uninsured, the charge rises to a Class B misdemeanor, which carries potential jail time and a fine up to $2,000. A conviction can also complicate your immigration status and cause trouble when you later apply for a Texas license. If your paperwork isn’t ready, stay off the road until it is.
