Can I Have a Gun in My Car in Alabama? Carry and Storage Rules

Yes, you can have a gun in your car in Alabama. Since January 1, 2023, any adult who is legally allowed to own a firearm can keep a loaded handgun in a vehicle without a permit, whether the car is theirs or someone else’s. The catches are age, prohibited-person status, and stricter storage rules that apply at certain locations like schools and workplace parking lots.

Who Can Carry a Gun in a Car Without a Permit

Alabama’s permitless carry law replaced the old requirement that you get a concealed carry permit from your county sheriff before keeping a handgun in your vehicle.1Alabama Legislature. Alabama Code 13A-11-61.2 – Possession of Firearms in Certain Places Two conditions still have to be met. You must be at least 19 years old, and you must not be otherwise prohibited from possessing a firearm.

The age floor drops to 18 for active-duty military members, honorably discharged veterans, and retired law enforcement officers. Permits still exist for anyone who wants one, and an Alabama concealed carry permit is worth having if you travel to states that grant reciprocity, but it is not required to carry inside the state.

Who Cannot Have a Firearm in a Vehicle

Permitless carry only helps you if you can legally possess a firearm to begin with. Alabama bars several categories of people from possessing any firearm anywhere, and the car is no exception.

State law prohibits firearm possession if you:

  • Have been convicted of a crime of violence. This includes murder, manslaughter (other than from a vehicle accident), rape, assault with intent to murder, robbery, burglary, kidnapping, any Class A felony, and Class B felonies involving serious physical injury, drug manufacturing or distribution, or sexual offenses involving a child under 12.
  • Have a misdemeanor domestic violence conviction.
  • Are subject to a domestic abuse protection order.
  • Have been declared of unsound mind by a court.

A violation is a Class C felony carrying one year and one day to ten years in prison.2Alabama Legislature. Alabama Code 13A-11-72 – Certain Persons Forbidden to Possess Firearm3Alabama Legislature. Alabama Code 13A-5-6 – Sentences of Imprisonment for Felonies A separate provision covers minors, habitual drunkards, and people addicted to controlled substances, and possession in those cases is a Class A misdemeanor.

Federal prohibitions apply on top of state law. Anyone barred from firearms under federal law, such as a person with a felony conviction from any state, a dishonorable discharge, or an active restraining order, remains barred inside their car in Alabama.

How to Store a Handgun in Your Car

Under normal driving conditions on public roads, Alabama is fairly relaxed about how a handgun rides in your vehicle. It can sit loaded in your glove compartment, center console, door pocket, or a holster on your person. Nothing in state law requires a locked container or an unloaded chamber while you are driving.

Long guns get even less state regulation. There is no statute dictating how a rifle or shotgun has to be transported, so a case, a rack, or the bed of a truck are all fair game.

Storage rules tighten when you drive onto certain restricted properties. In those places, any firearm in the vehicle must be hidden from ordinary view and locked inside a compartment, inside the locked vehicle itself, or in a container securely attached to the vehicle. A handgun on the passenger seat in plain view will not qualify. Violating the restricted-places statute is a Class C misdemeanor.1Alabama Legislature. Schools

Driving onto public K-12 school property is one of the most commonly enforced trigger points. Any firearm in the vehicle must be out of sight and locked in a compartment or the vehicle’s interior.1Alabama Legislature. Alabama Code 13A-11-61.2 – Possession of Firearms in Certain Places Bringing a firearm onto school premises with intent to do bodily harm is a separate and much more serious offense, charged as a Class C felony.2Alabama Legislature. Alabama Code 13A-11-72 – Certain Persons Forbidden to Possess Firearm

Police Stations, Jails, Prisons, and Mental Health Facilities

You cannot bring a firearm inside any of these facilities without express permission from someone with authority over the premises. If the firearm stays in your car in the parking lot, the locked-and-hidden rule applies.1Alabama Legislature. Alabama Code 13A-11-61.2 – Possession of Firearms in Certain Places

Guns in Your Car at Work

Alabama law specifically protects your right to keep a firearm in your private vehicle in an employer’s parking lot. Your employer cannot fire you or take other adverse action against you solely because a firearm is stored in your car, as long as you follow the storage rules.4Alabama Legislature. Alabama Code 13A-11-90 – Restrictions on Firearms by Employers

When you leave the vehicle, the firearm has to be out of sight and locked inside a compartment, the vehicle’s interior, or a container attached to the vehicle. Your employer is allowed to ask whether you are complying and to take action if you are not. In-compliance possession, on its own, cannot cost you your job.4Alabama Legislature. Alabama Code 13A-11-90 – Restrictions on Firearms by Employers

Traffic Stops

Alabama does not require you to volunteer that a firearm is in the car. There is no proactive duty to tell the officer. But if the officer asks whether you are armed or have a concealed firearm, you have to answer immediately and truthfully.5Alabama Legislature. Alabama Code 13A-11-95 – Duty to Inform Law Enforcement Officer Upon Request When in Possession of Concealed Pistol or Firearm

Many drivers choose to mention it early anyway, with hands visible on the wheel, before reaching for a wallet or registration. That is a practical choice, not a legal obligation.

Driving Out of State

Alabama’s rules stop at the state line. Once you cross into Georgia, Mississippi, Florida, Tennessee, or anywhere else, that state’s law controls what you can do with the firearm in your car. Some neighbors also have permitless carry; some do not. An Alabama concealed carry permit still matters here for reciprocity, which is one reason to keep one even though the state no longer requires it.

Federal law offers a narrow safety net through the Firearm Owners’ Protection Act. You can transport a firearm through a state where you could not otherwise carry it, provided you can legally possess it at both the origin and the destination. During the drive, the firearm must be unloaded and stored where it is not accessible from the passenger compartment. A trunk satisfies the rule. If your vehicle has no separate trunk, the firearm and ammunition must be in a locked container other than the glove compartment or center console.6Office of the Law Revision Counsel. 18 USC 926A – Interstate Transportation of Firearms

Safe passage covers continuous travel. Overnight stops or long detours in a restrictive state can push you outside the protection.

Rideshare Vehicles

State law gives you the right to carry; it does not override a private company’s contract. Uber prohibits riders, drivers, and delivery people from carrying firearms while using the app, with a narrow exception for transporting a firearm that is unloaded and locked in a hard-sided container in the trunk. Violations can result in account deactivation.7Uber Help. Firearms Policy Lyft asks that no one carry a weapon on Lyft property or while using the platform, even where carrying is legal, and its policy sweeps in handguns, stun guns, and knives.8Lyft Help. Safety Policies

These are contract terms, not criminal statutes, so the consequence is a lost account rather than a charge. If you rely on rideshares, plan firearm transport separately.
