You cannot use an out-of-state medical card in Florida. Florida’s medical marijuana program has no reciprocity provision, no visitor pass, and no workaround: dispensaries sell only to patients registered with the state’s Office of Medical Marijuana Use (OMMU) who present a Florida-issued identification card.1Florida Senate. Why Florida Rejects Other States’ Cards
The statute defines a “qualified patient” as a Florida resident who has been added to the Medical Marijuana Use Registry by a Florida-registered physician and holds a state-issued identification card.1Florida Senate. Florida Statutes 381.986 – Medical Use of Marijuana Everything about that definition is state-specific. There is no category for a visiting patient, no temporary credential, and no honor system between states.
If you drive or fly into Florida with cannabis you obtained legally elsewhere, Florida treats you the same as anyone else caught with marijuana outside its program. Possession of 20 grams or less is a first-degree misdemeanor punishable by up to a year in jail and a $1,000 fine. More than 20 grams is a third-degree felony, up to five years in prison and a $5,000 fine.2Justia Law. Florida Statutes 893.13 – Prohibited Acts; Penalties Your home-state card is not a defense.
The Seasonal Resident Path
If you spend part of the year in Florida, you may qualify as a seasonal resident and get a Florida card of your own. The statute defines a seasonal resident as someone who lives in Florida for at least 31 consecutive days each calendar year, keeps a temporary residence in the state, and returns to their home state at least once per year.1Florida Senate. Seasonal residents without a Florida driver’s license prove residency by submitting two documents showing a Florida address. The OMMU accepts a deed, mortgage statement, or lease; a utility bill no more than two months old; a utility hookup or work order dated within 60 days; or mail from a financial institution or government agency issued within the last two months.3Office of Medical Marijuana Use. Registry Identification Cards Permanent residents with a Florida license or state ID have residency verified automatically through the motor vehicle database.
A short vacation does not qualify. If you are visiting for a week to see family or attend a conference, the seasonal path is not open to you.
What It Takes to Get a Florida Card
Find a Florida-Registered Physician
Only doctors registered with the OMMU and holding an active, unrestricted Florida medical license can certify you.4Florida Department of Health. Know the Facts – Physicians The exam must be in person. Insurance typically does not cover the visit, and out-of-pocket costs run roughly $100 to $300. The OMMU keeps a searchable directory of qualified physicians on its website.
You will need a qualifying condition. The statute lists cancer, epilepsy, glaucoma, HIV/AIDS, PTSD, ALS, Crohn’s disease, Parkinson’s disease, multiple sclerosis, chronic nonmalignant pain originating from a qualifying condition, and terminal illness diagnosed by a second physician. It also permits certification for conditions “comparable” to those listed, at the physician’s discretion, which is how patients with anxiety, chronic migraines, or fibromyalgia are often approved.1Florida Senate. Florida Statutes 381.986 – Medical Use of Marijuana If your out-of-state diagnosis fits one of these, bring your records; if the Florida physician agrees, they enter you into the registry and issue a certification specifying what you can purchase.
Apply to the OMMU
Once your physician enters you into the registry, you apply for the card yourself. The application requires proof of residency, a passport-style 2×2 color photo taken within the last 90 days against a white background, and a $75 non-refundable fee (plus a $2.75 convenience fee if you pay online).3Office of Medical Marijuana Use. Online applications average 10 business days for approval; paper takes a few days longer. When approved, you get an email that acts as temporary authorization to shop while the physical card is mailed.3Office of Medical Marijuana Use. Registry Identification Cards
Stay Current
The card is good for one year and renews for another $75. Separately, your physician certification expires every 210 days, so you need a follow-up visit roughly every seven months. If the certification lapses, dispensaries cannot fill new orders even if your card is still within its annual window.
What You Can Buy Once You Have a Card
Florida caps purchases and possession on rolling windows tracked through the registry. Smokable flower is limited to 2.5 ounces within any 35-day period, with no more than 4 ounces in your possession at one time. Non-smokable products (edibles, oils, tinctures, capsules, topicals) are capped at a 70-day supply within any 70-day period, up to 24,500 milligrams of THC.5Office of Medical Marijuana Use. Consequences Out-of-State Patients Often Miss
You Cannot Bring Cannabis From Another State
Transporting marijuana across state lines is a federal offense, even between two states with legal medical programs. Flying out of a Florida airport with cannabis in your bag is a federal crime the moment you leave Florida airspace. TSA is not specifically hunting for it, but if screeners find it, they are required to refer the matter to local law enforcement. Getting a Florida card does not solve this either: you cannot legally carry your Florida purchases home.
Firearms
Federal law prohibits any “unlawful user of or addicted to any controlled substance” from possessing firearms or ammunition.7Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts Cannabis remains a Schedule I substance federally, so holding any state’s medical card, including Florida’s, makes you an unlawful user in federal terms. ATF Form 4473 warns of this directly, and answering it untruthfully is a separate federal felony. A pending executive order has directed rescheduling to Schedule III, but that process is not final.
Where You Can Use It
Smoking or vaping medical marijuana is prohibited in any public place or indoor workplace in Florida.8Office of Medical Marijuana Use. Know the Facts – Smoking Hotels, short-term rentals, and landlords can ban it on their property. In practice, use is confined to a home or private property where the owner allows it. Employment
Florida has no law protecting cardholders from adverse employment action. A 2025 bill that would have shielded public employees died in the Senate Health Policy committee. Employers can maintain zero-tolerance policies, require drug testing, and fire or refuse to hire based on a positive cannabis test, valid card or not. Check your employer’s policy before you apply.
