Yes. An undocumented immigrant can get a driver’s license in Illinois. Since July 1, 2024, the state has issued undocumented residents the same standard driver’s license that any Illinois resident receives when they opt out of REAL ID. The card is marked “Federal Limits Apply,” and it is valid for driving throughout Illinois and the rest of the country.1Illinois Legal Aid Online. Driver’s License for Immigrants
What the License Is and What It Cannot Do
This is not a special category. It is the ordinary Illinois driver’s license, identical in appearance to the non-REAL ID license carried by any resident who chose not to upgrade. Nothing on the card signals the holder’s immigration status.1Illinois Legal Aid Online. Driver’s License for Immigrants
Since May 7, 2025, federal REAL ID enforcement has been in effect. A “Federal Limits Apply” license cannot be used to board a domestic commercial flight, enter a federal courthouse or other federal building, access a military base, or enter a nuclear power plant. For those purposes you need a valid passport or another federally accepted ID.2Transportation Security Administration. Most adults receive a license valid for four years. Drivers under 21 get one that expires three months after their 21st birthday. Applicants 81 through 86 receive a two-year license, and those 87 or older get a one-year license.3Illinois General Assembly. 625 ILCS 5/6-115 – Expiration of Licenses
Who Qualifies
You must meet three conditions:
- You have lived in Illinois for more than 12 consecutive months.
- You are ineligible to obtain a Social Security number.
- You cannot present documents from U.S. Citizenship and Immigration Services authorizing your presence in the country.4Illinois General Assembly. 625 ILCS 5/6-105.1 – Temporary Visitor’s Driver’s License
The residency requirement is strict. Time spent in other states does not count toward the 12 months. Applicants who do hold USCIS authorization documents follow a different track and may need to present their immigration paperwork; the process described here is for residents without any federal immigration authorization.
Documents to Bring
Most trips to a Secretary of State facility fail because the applicant brought the wrong papers. Gather these before your appointment.
For identity, bring a valid, unexpired passport from your country of citizenship or a valid, unexpired consular identification card. The document cannot expire within two years of your application date.1Illinois Legal Aid Online. For residency, bring documents showing you have lived in Illinois for at least a year. Accepted proof includes utility bills dated within 90 days, bank statements, a lease or rental agreement, pay stubs, insurance policies, and official mail from government agencies. Instead of a Social Security number, you will sign a declaration at the facility stating you are ineligible to obtain one.5Illinois Secretary of State. Document Requirements to Obtain a Driver’s License/State ID Card You also need written proof of your signature on at least one document you bring.
The Application and Tests
Book an appointment through the Secretary of State’s website or by phone.6Illinois Secretary of State. Appointments Not every facility processes standard licenses for applicants without a Social Security number, so confirm this when you book.
At the appointment you take the same three tests as any first-time applicant:
- A vision screening at the facility.
- A written exam on Illinois traffic laws, road signs, and safe driving, based on the Illinois Rules of the Road handbook.
- A behind-the-wheel driving test. You must bring an insured vehicle to use.
The written exam is given in English and may be available in other languages depending on the location. After you pass all three tests, you pay the application fee. Check the current fee schedule at ilsos.gov before your appointment. The license is mailed to your Illinois address.
Insurance
You cannot take the road test or hold a license without auto insurance. Illinois requires every driver to carry liability coverage, and the vehicle you use for the driving test must be insured.8Illinois Secretary of State. Auto Insurance Shopping Guide Coverage has to remain continuous the whole time your license is active. A lapse can lead to license suspension.
The Voter Registration Trap
This is the most serious pitfall in the application. The Secretary of State’s office runs Illinois’s automatic voter registration system, and at some point in the process you may see a question asking whether you are a U.S. citizen. Answering “yes” by mistake, or a system error, can register a non-citizen to vote.
That has happened before. A programming error in the Secretary of State’s system between 2018 and 2019 sent registration data for more than 500 people to election officials even though they had answered “no” to the citizenship question. Illinois law provides that a person wrongly registered through such an error cannot be treated as having made a false citizenship claim.
But actually voting is a different matter, and the federal consequences are severe. Read every screen and every form. If asked whether you are a U.S. citizen, answer “no.” If any voter registration materials arrive after you receive your license, do not fill them out or return them. If you find out you were registered by mistake, contact your county election office right away to cancel the registration.
This License Does Not Cover Commercial Driving
A standard license issued through this process cannot be used to get a Commercial Driver’s License. Federal rules require every CDL applicant to prove U.S. citizenship or lawful permanent residency.12eCFR. 49 CFR 383.71 – Driver Application and Certification Procedures Certain employment-based visa holders, such as H-2A and H-2B workers, can apply for a non-domiciled CDL, but applicants without lawful immigration status cannot get a CDL. No state can override that.
Privacy Protections and Their Limits
Illinois has designed the program to reduce exposure to federal immigration enforcement. The Illinois TRUST Act restricts state and local law enforcement from enforcing federal civil immigration law or detaining people solely on the basis of immigration status. And because the license itself looks identical to any other non-REAL ID license, the card does not identify the holder as undocumented.
These protections are not absolute. A federal warrant or judicial subpoena can compel disclosure of records. Federal policy shifts over time as well. Assume that information you give a government office could, in theory, be reached through legal process, even where state policy currently limits voluntary sharing.
Why Getting the License Matters
Driving in Illinois without any valid license is a Class B misdemeanor if you have never been licensed or your license has been expired for more than a year. That carries up to six months in jail and a fine of up to $1,500.13Illinois General Assembly. 625 ILCS 5/6-601 – Driving While License Revoked or Without a License A traffic stop without a valid license also creates a record that can complicate any future immigration case. Holding a valid Illinois license removes that risk for routine driving.
