Social Security benefits can be garnished in Florida, but only for a narrow set of debts. Private creditors — credit card companies, hospitals, personal lenders — cannot take your benefits, even after winning a judgment against you. The federal government can, for unpaid taxes, defaulted federal student loans, and criminal restitution. Court-ordered child support and alimony can reach your check too. And the Social Security Administration itself can withhold money to recover overpayments. Everything else the state and its courts can do stops at the door.
Private Debts Cannot Reach Your Benefits
Section 207 of the Social Security Act puts benefits off-limits to “execution, levy, attachment, garnishment, or other legal process.”1Social Security Administration. 42 U.S.C. 407 That covers retirement benefits, Social Security Disability Insurance (SSDI), and survivor benefits. A parallel provision under Title XVI protects Supplemental Security Income (SSI).
If a credit card issuer, medical provider, or private lender sues you in Florida and wins, the judgment does not override that federal exemption. Florida’s own garnishment statute reinforces the point by listing Social Security as exempt and requiring the garnishment paperwork itself to notify you of that protection and how to claim it.2Florida Legislature. Florida Statutes 77.041 The creditor can chase other non-exempt assets, but not the monthly check.
Federal Tax Debt
The IRS is the creditor with the fewest limits. Through the Federal Payment Levy Program, it can take up to 15% of your monthly benefit for delinquent federal taxes with no court order required.3Internal Revenue Service. Federal Payment Levy Program The levy runs automatically once the IRS decides collection is warranted.
The benefit type matters. Since October 2015, SSDI has been excluded from the automated levy, though the IRS can still pursue SSDI through a separate manual process. Retirement and survivor benefits stay subject to the automatic 15%. SSI is excluded from the program entirely.4Social Security Administration. GN 02410.305 – Federal Payment Levy Program (FPLP)
There is no minimum benefit floor for tax levies. Even if 15% drops you below $750 a month, the levy still applies. The $750 protection you may have read about is only for non-tax federal debts.5Internal Revenue Service. Social Security Benefits Eligible for the Federal Payment Levy Program
Child Support and Alimony
Federal law explicitly waives Section 207’s shield for court-ordered domestic support, treating the federal government like a private employer for garnishment purposes.6Office of the Law Revision Counsel. 42 U.S. Code 659 The Consumer Credit Protection Act sets the ceilings:
- 50% of your benefit if you are currently supporting another spouse or dependent child
- 60% if you are not supporting another spouse or dependent child
- An additional 5% on top of either limit if you are more than 12 weeks behind
That puts the maximum at either 55% or 65% depending on your circumstances.7Office of the Law Revision Counsel. 15 U.S.C. 1673 These are the highest garnishment rates any creditor can impose on Social Security.
This exception reaches only Title II benefits — retirement, SSDI, and survivor payments. SSI cannot be garnished for child support because it is a need-based program not tied to employment.8Administration for Children and Families. Garnishment of Supplemental Security Income Benefits
Defaulted Federal Student Loans
Collection on defaulted federal student loans resumed in early 2026, and that includes offsetting Social Security. Under the Treasury Offset Program, the government can take up to 15% of your monthly benefit, but the first $750 per month is protected.9Office of the Law Revision Counsel. 31 U.S.C. 3716 That floor has not been adjusted for inflation since 1996.10Consumer Financial Protection Bureau. The Biden administration briefly raised the protected amount to $1,883 (150% of the poverty line), and the Trump administration reverted to the statutory $750 when collections resumed.11MarketWatch. Student-Loan Borrowers in Default Could See Social Security Benefits Cut to $750 as Debt Collection Resumes So if your monthly benefit is $1,000, the offset can take up to $150, leaving you with $850. If your benefit is already at or below $750, the offset cannot reduce it further.
Federal Criminal Restitution
A federal court that orders restitution as part of a criminal sentence can enforce it against your Social Security. The authorizing statute, 18 U.S.C. §3613, specifically overrides Section 207.12Office of the Law Revision Counsel. 18 U.S.C. 3613 The Consumer Credit Protection Act caps still apply. This reaches Title II benefits; SSI generally gets stronger protection because of its need-based status.
Overpayment Recovery by the Social Security Administration
The garnishment scenario most people don’t anticipate is not really a garnishment at all. If SSA determines it overpaid you — an agency error, an unreported change in income, a life event you did not report — it will hold money back from future checks until the overpayment is recovered.
As of March 2025, the default withholding rate for new Title II overpayments is 100% of the monthly benefit. SSA can hold the entire check. The default rate for SSI overpayments is 10%.13Social Security Administration. Social Security to Reinstate Overpayment Recovery Rate If full withholding would leave you unable to cover basic expenses, you can ask SSA for a lower rate.
You can also request a waiver if the overpayment was not your fault and repayment would prevent you from meeting basic living costs. File the waiver request within 30 days of the overpayment notice and SSA will pause collection while it reviews your case.14Social Security Administration. SSI Is Harder to Garnish Than Other Benefits
If your check is Supplemental Security Income rather than retirement or SSDI, most of the exceptions above shrink or disappear:

- SSI is technically subject to Treasury offset for non-tax federal debts, but the $750 floor usually leaves little or nothing to take.9Office of the Law Revision Counsel. 31 U.S.C. 3716
- SSA overpayment recovery defaults to 10% rather than 100%.13Social Security Administration. Social Security to Reinstate Overpayment Recovery Rate
SSA’s own overpayment recovery is the main real-world exposure for SSI recipients.
Protecting Benefits in a Bank Account
The legal exemption is one thing. What happens when benefits sit in a bank account with other money is another. Federal regulations give you automatic protection, but the protection has limits.
When a bank receives a garnishment order, it must review the account for federal benefit payments directly deposited during a lookback period. The bank calculates a “protected amount” from those deposits and cannot freeze or seize it. You keep access without filing anything. The trouble is commingling. When Social Security deposits sit in the same account as wages, side income, or transfers from elsewhere, the automatic protection covers only the amount directly deposited by the federal benefit agency. Anything above that is exposed. Florida law recognizes that commingling by itself does not destroy your ability to trace exempt funds, but tracing gets harder and more expensive as more income sources flow through the account.16Florida Legislature. The cleanest fix is a dedicated account that receives only the Social Security direct deposit. No wages, no transfers in, no other deposits. If nothing else moves through the account, there is nothing to argue about when a garnishment order arrives.
What to Do If Your Benefits Are Wrongly Garnished
If a creditor freezes or takes money you believe is exempt Social Security income, Florida gives you a specific process. You have 20 days from receipt of the garnishment notice to file a sworn Claim of Exemption and Request for Hearing with the clerk of the court that issued the writ.2Florida Legislature. Once you file, the creditor has 8 business days (if served by hand) or 14 business days (if served by mail) to file a written challenge. No response within that window, and the clerk must dissolve the writ automatically without a hearing.2Florida Legislature. Florida Statutes 77.041 When the funds are clearly Social Security, creditors’ attorneys typically know the claim is valid and let it go uncontested. Miss the 20-day deadline, though, and you can lose the protection by default.
Pull your bank statements showing the SSA direct deposit before you file. The cleaner the records — especially if you kept a separate account — the faster it moves.
