Can You Carry a Gun in NYC With a Permit? Limits and Penalties

You can carry a gun in NYC with a permit only if that permit is a Carry License issued by the NYPD. A concealed carry permit from another New York county, or from any other state, does not authorize you to carry a firearm inside the five boroughs. The city runs its own licensing system, and the application takes roughly six months from a complete submission to a decision.

The Only Permits That Work Inside the Five Boroughs

The NYPD License Division issues the handgun licenses that matter here. A Carry License lets you carry a concealed handgun on your person in public. A Premises License is far more restricted: the gun stays at the home or business address printed on the license, and any transport to an authorized range requires the firearm unloaded and locked, with ammunition locked separately.1NYPD License Division. If you already hold a concealed carry permit from another county in New York, that permit is not valid in the city on its own. Out-of-state permits are worth even less. New York does not honor concealed carry permits from any other state. Who Qualifies for a Carry License

You must be at least 21, a U.S. citizen or lawful permanent resident, and of “good moral character” as the NYPD defines it. The department investigates your background, conduct, and history in depth to assess whether you present a public safety risk.1NYPD License Division. New Application Instructions

Before 2022, applicants also had to show a specific threat to their safety under a “proper cause” standard. The Supreme Court struck that requirement down in New York State Rifle & Pistol Association v. Bruen, holding that requiring applicants to demonstrate a special need for self-defense violated the Second Amendment.6Supreme Court of the United States. Several things disqualify an applicant automatically:

  • A felony conviction anywhere, a conviction for a “serious offense” under New York law, or a domestic violence misdemeanor
  • A dishonorable discharge from the Armed Forces
  • Involuntary commitment to a mental health facility, or being the subject of a report under Mental Hygiene Law 9.46
  • A domestic violence protective order against you, or a prior firearms license that was revoked or suspended

How to Get the License

Firearm Safety Training

Before you apply for a concealed carry license, New York requires a state-mandated safety course: 16 hours of in-person classroom instruction on safe handling, range safety, holster techniques, and legal use of force, plus 2 hours of live-fire training at a range. You must score at least 80% on a written exam to receive a certificate.7New York State Police. The Application Itself

Applications go through the NYPD License Division’s online portal. Paper applications are no longer accepted. You submit a detailed form and upload documents proving age, citizenship or residency, and address; applicants born outside the U.S. need naturalization papers, proof of derived citizenship, or an Alien Registration Card.8New York City Police Department. After documents are reviewed, you’ll be scheduled for a mandatory in-person interview with a License Division officer, followed by an investigation. The NYPD estimates roughly six months from a complete application to a decision.

Where a Carry License Still Doesn’t Let You Carry

A valid NYC Carry License is not blanket permission to carry everywhere. New York’s Concealed Carry Improvement Act, passed after Bruen, created two categories of off-limits places.

Sensitive Locations

Firearms are flatly prohibited in sensitive locations regardless of your license:

  • Government buildings and courthouses
  • Healthcare facilities and places of worship
  • Schools, colleges, libraries, public parks, playgrounds, and zoos
  • The entire public transit system, including subways, buses, ferries, airports, train stations, and bus terminals
  • Establishments licensed to serve alcohol for on-premises consumption
  • Entertainment venues, public gatherings, and protests

Private Property

Under the CCIA, you cannot bring a firearm onto someone else’s property unless the owner has posted clear signage permitting firearms or has given express verbal consent. How You Have to Store the Gun at Home

At home, a firearm must be secured with a gun locking device or kept in a safe storage depository. The rule tightens if a child under 18 lives in or visits your home, or if anyone in the household is prohibited from possessing firearms under state or federal law. In those situations, you cannot leave the firearm outside your immediate possession and control. Standard practice is to store the gun unloaded, locked, and separated from ammunition.11NYPD License Division. Penalties for Carrying Without a Valid NYC License

Possessing a loaded firearm without a license is criminal possession of a weapon in the second degree, a class C violent felony carrying up to 15 years in prison.12New York State Senate. New York Penal Law 265.03 – Criminal Possession of a Weapon in the Second Degree City prosecutors treat these cases aggressively, and judges have limited sentencing discretion because of mandatory minimums tied to the violent felony classification.

Even an unloaded, unregistered firearm carries class E felony exposure of up to four years. The charges stack: carrying in a sensitive location or on private property without consent adds separate felonies on top of any licensing offense. An out-of-state permit provides no defense.

Renewal

NYC handgun licenses expire after three years and must be renewed on that cycle.2New York State Senate.
