The 30-Day Deadline

Texas Transportation Code Section 521.054 requires you to notify DPS and apply for a duplicate license within 30 days of your name change taking effect. The clock starts on your wedding date, the date your divorce decree becomes final, or the date a judge signs a court order changing your name. Missing the deadline is a violation, though a court can dismiss the charge if you correct the record within 20 working days and pay a reimbursement fee of up to $20.1State of Texas. Update Your Social Security Record First

DPS verifies your information against the Social Security Administration’s database. If SSA still has your old name, DPS cannot make the change. Get the Social Security update started immediately after the name change becomes official.

To update SSA, submit Form SS-5 with an original or certified copy of the document proving your name change. SSA accepts marriage documents, divorce decrees, certificates of naturalization showing your new name, and court orders. Photocopies and notarized copies are not accepted. What to Bring to the DPS Office

The core document is the one that proves your name change. For a marriage-related change, that means one of the following:

  • Marriage license issued by the county clerk
  • Certified copy of a divorce decree
  • Certified annulment order

For a name change unrelated to marriage, bring one of these:

  • Certified court order granting the name change
  • Amended birth certificate showing your new name

If your Texas license carries a gold star, it is REAL ID compliant, and keeping that status through a name change requires what the federal government calls name traceability.
