Yes, you can collect rainwater in New York. Cities and towns set the actual construction rules through their building and plumbing codes. A basic rain barrel on a downspout almost never requires a permit. A system that ties into your home’s plumbing almost certainly does. Before installing anything more elaborate than a barrel, check with your local building department.

NYC has the most detailed regulations in the state. Outside NYC
Elsewhere in the state, rules are generally lighter. Many towns and counties have nothing in their codes specific to rainwater harvesting, so a standalone rain barrel typically needs no permit. Larger installations that involve below-grade cisterns, pumps, or connections to indoor plumbing will usually require a building or plumbing permit. How To Build a System That Meets Code
The NYC Plumbing Code spells out best practices that any New York homeowner should follow, whether local code requires them or not. These rules exist to prevent contamination, mosquito breeding, and property damage.
Collection surface. Water should come from an above-ground impervious roof made of approved materials. Storage tanks. Tanks must be watertight and built from durable, corrosion-resistant, non-toxic materials. Overflow. Every tank needs an overflow pipe sized for heavy storms. Under the NYC code, overflow pipes cannot have shutoff valves and must include a cleanout. Rooftop overflow has to be directed so it doesn’t freeze on walkways, and stormwater overflow cannot discharge into the sanitary sewer.8UpCodes. Cross-connection. If your rainwater system connects to a potable water line for backup supply, the NYC code requires an air gap between the two systems to prevent backflow. What You Can Use the Water For
Most residential rainwater collection is for non-potable purposes: watering the garden, lawn irrigation, washing vehicles, or flushing toilets. Untreated rainwater from a simple barrel is fine for outdoor uses, and the DEC suggests connecting a drip irrigation or soaker hose directly to the barrel.2New York State Department of Environmental Conservation. Drinking, cooking, and bathing are another matter. Rainwater is classified similarly to surface water for treatment purposes, so it must be filtered and disinfected to remove at least 99.9 percent of Giardia lamblia cysts and 99.99 percent of viruses before anyone drinks it.12Legal Information Institute. For anyone on a municipal water supply, the cost rarely makes sense.
Winterizing Your System
New York winters will destroy an unprotected rainwater system. Water expands when it freezes, and a full barrel or pipe left outside in January can crack in a single hard freeze.
Before overnight temperatures consistently drop below freezing, drain the barrel completely and use the water on late-season plantings or houseplants. Disconnect the barrel from the downspout and store it upside down in a garage, shed, or basement. If indoor storage isn’t possible, flip it upside down outside so ice can’t accumulate inside. Once it’s off, make sure your downspout directs water away from the foundation.
Larger underground cisterns are more forgiving. Maintenance is a year-round job. Inspect screens and filters every few months and clear accumulated debris. Pending Legislation To Watch
Senate Bill S1175, introduced in the 2025-2026 legislative session, would add a new title to the Environmental Conservation Law establishing statewide standards for rainwater harvesting.9New York State Senate. 2025-2026 Legislative Session S1175 The bill would require pretreatment filtering, one-millimeter mesh screening at all openings to block mosquitoes, and a water budget analysis showing how collected water will be reused between storms. It would also limit collection to rooftop runoff and require systems to capture at least 0.2 inches of rainfall from the contributing roof area.
The bill has not been enacted, so the current framework stands: no state permit, no state ban, and local codes fill in the rest.
