Can You Collect Unemployment and Social Security in Florida?

You can collect unemployment and Social Security in Florida at the same time, and neither payment reduces the other. Under Florida Statutes Section 443.101, Social Security benefits you paid into through payroll contributions cannot be used to lower your weekly Reemployment Assistance amount.1Florida Legislature. Florida Statutes 443.101 – Disqualification for Benefits That matters, because some other states still dock a retiree’s unemployment check dollar-for-dollar against Social Security income.

The No-Offset Rule

Florida law is direct: for any week you receive Social Security benefits from your own contributions, your Reemployment Assistance payment cannot be reduced because of those contributions. This applies to Social Security retirement and to Social Security Disability Insurance alike. You keep the full unemployment amount you qualify for, and you keep your full Social Security check.

An example makes it concrete. If your work history qualifies you for $250 per week in Reemployment Assistance and you also receive $1,800 per month from Social Security retirement, both amounts arrive in full. Nothing gets subtracted on either side.

How Florida Calculates Your Weekly Unemployment Amount

Your weekly benefit depends entirely on recent wages, not on Social Security income. Florida looks at the first four of the last five completed calendar quarters before you filed. For claims filed in 2026, that means wages earned between October 1, 2024 and September 30, 2025.2FloridaJobs.org. Claimant FAQ You need wages in at least two of those quarters and a minimum of $3,400 across the base period.

The weekly payment equals your highest-earning quarter divided by 26, rounded down to the nearest dollar, with a floor of $32 and a ceiling of $275.3Florida Legislature. Florida Statutes 443.111 – Payment of Benefits The $275 cap has stayed flat for years and is among the lowest state maximums in the country. Duration is tied to the statewide unemployment rate; when the rate sits at or below 5 percent — which has been the case in recent years — most claimants get up to 12 weeks. At $275 for 12 weeks, the maximum you can draw is $3,300.

If You Are on Social Security Disability

SSDI creates a real tension. To receive it, the Social Security Administration must have found you unable to perform substantial gainful activity, defined in 2026 as earning $1,690 or more per month.4Social Security Administration. Substantial Gainful Activity5Social Security Administration. What’s New in 2026? To collect Reemployment Assistance, you have to certify each week that you are able to work, available for work, and actively searching, with contacts to at least five prospective employers.6Florida Senate. Florida Statutes Title XXXI Chapter 443 Section 443.091 – Benefit Eligibility Conditions

Those two positions can coexist if your disability restricts you to certain kinds of work rather than shutting out all work. But it is a narrow path. You need to be able to show you can work within specific medical limits while staying below the SGA earnings line, and claiming both without careful documentation invites scrutiny from both agencies.

Social Security’s Earnings Test

If you are drawing Social Security retirement before full retirement age, the SSA applies an annual earnings test. In 2026, you can earn up to $24,480 before Social Security starts withholding $1 for every $2 above that limit.7Social Security Administration. 2026 Cost-of-Living Adjustment (COLA) Fact Sheet

Unemployment compensation does not count as earnings under this test. Social Security only counts wages from a job or net self-employment income.8Social Security Administration. Will Unemployment Benefits Affect My Social Security Benefits? Your Reemployment Assistance payments will not push you over the $24,480 threshold or trigger any reduction in your Social Security check. People get this backwards often enough that it is worth stating plainly: the two payments run on separate tracks.

Federal Taxes When You Stack Both

Florida has no state income tax, so neither benefit is taxed at the state level. Federal taxes are the concern. Unemployment compensation is fully taxable as ordinary income.9Internal Revenue Service. Unemployment Compensation Social Security becomes partially taxable once your combined income clears certain thresholds.

The IRS defines combined income as your adjusted gross income, plus nontaxable interest, plus half of your Social Security benefits. Once that total exceeds $25,000 for a single filer or $32,000 for joint filers, part of your Social Security is taxed. At higher income levels, up to 85 percent of Social Security benefits can be subject to federal tax.10Internal Revenue Service. Social Security Income Adding unemployment on top of Social Security can move you across those lines even when the unemployment amount is modest.

Neither program withholds federal tax automatically. You can file IRS Form W-4V to have 10 percent withheld from unemployment payments, which is the only rate available for that benefit.11Internal Revenue Service. Form W-4V (Rev. January 2026) Voluntary Withholding Request You can also request withholding from your Social Security check through the SSA. If you skip both, set money aside for estimated taxes so April is not a surprise.

Medicare Premium Ripple

Collecting both benefits can push your Medicare Part B premium up two years down the road. Part B includes an Income-Related Monthly Adjustment Amount (IRMAA) that raises premiums for higher-income beneficiaries. The standard Part B premium in 2026 is $202.90 per month, and once a single filer’s modified adjusted gross income exceeds $109,000 (or $218,000 for a couple filing jointly), surcharges kick in that can more than triple the base premium.12Centers for Medicare & Medicaid Services. 2026 Medicare Parts A & B Premiums and Deductibles

IRMAA uses your tax return from two years prior, so unemployment income received in 2026 could affect Medicare premiums in 2028. Most people stacking unemployment and Social Security will not clear the IRMAA thresholds, but pensions, investment income, or a working spouse can change that math. If a job loss caused a large income drop, the SSA lets you request reconsideration as a life-changing event.13Social Security Administration. Premiums: Rules for Higher-Income Beneficiaries

Report Social Security on Your Claim

Even though Social Security does not reduce your payment, you still have to disclose it. Florida’s claims system, Reconnect, is where you apply, request biweekly payments, and report income.14FloridaJobs.org. Reconnect Logins When the application or certification asks about Social Security income, put it in. Leaving it out will not raise your payment, since the state already ignores it for benefit calculations, but omitting it can be treated as misrepresentation. Under Florida Statutes Section 443.151, overpayments caused by false statements or failure to disclose material facts carry a 15 percent penalty on top of full repayment.15Florida Legislature. If Your Claim Is Denied

If the Department of Commerce denies your claim or rules you ineligible for a given week, you have 20 calendar days from the determination date to file an appeal. If day 20 lands on a weekend or holiday, the deadline moves to the next business day. There is no fee.16FloridaJobs.org. File an Appeal

You can file through Reconnect, by fax, or by mail. Once your appeal is in, you will receive a Notice of Hearing with a date and time for a telephone hearing. An appeals referee calls all parties, takes testimony, and issues a written decision. The 20-day window is strict, and missing it usually ends your ability to challenge that determination, so calendar the deadline the moment a denial notice arrives.
