Can You Conceal Carry in NYC? License, Training, and Penalties

You can carry a concealed handgun in New York City, but only if the NYPD has issued you a Carry Business License. No other permit works inside the five boroughs. New York City does not honor concealed carry licenses from other states, and it doesn’t even honor permits issued by other counties in New York. If you want to carry in NYC, you go through the NYPD License Division or you don’t carry at all.

The License That Lets You Carry

The NYPD issues several kinds of handgun licenses. Only one authorizes everyday concealed carry in public: the Carry Business License. Despite the name, it’s available to qualified city residents, not just business owners.1Government Portal. New Application Instructions

A separate “premises” license lets you keep a handgun at home or at a business address, but it doesn’t let you carry the gun anywhere else. If you leave the address with the handgun on you, you’re carrying illegally. Don’t confuse the two.

Who Qualifies

New York Penal Law Section 400.00 sets the baseline. You must be at least 21, though honorably discharged military veterans are exempt from the age floor. You also need to show “good moral character,” meaning the temperament and judgment to be trusted with a weapon. The NYPD tests this with a detailed background investigation and by requiring four notarized character reference letters. The background check reviews arrests, summonses, domestic violence history, orders of protection, and mental health history.1Government Portal. New Application Instructions You are disqualified automatically if you have been convicted of a felony or a “serious offense,” if you are a fugitive, if you are addicted to a controlled substance, or if you have been involuntarily committed to a mental health facility.2New York State Senate. The 18-Hour Training Requirement

Before you apply, you have to finish an 18-hour firearm safety course taught by a state-authorized instructor. Sixteen hours are in-person classroom, two hours are live-fire on a range. At the end, there’s a written exam covering the full curriculum, and you need at least 80 percent to pass.5New York State Police. Courses run roughly $100 to $350 depending on the provider. Confirm the instructor is authorized by New York State before you enroll. A certificate from an unauthorized instructor won’t be accepted, and there’s no appeal on that.

How to Apply

Everything starts on the NYPD’s online licensing portal. You upload proof of city residency or business address, a birth certificate, your training completion certificate, and the four notarized reference letters.1Government Portal. New Application Instructions

Two fees are due upfront: a $340 non-refundable application fee and an $88.25 fingerprinting fee, paid by credit card or money order.1Government Portal. New Application Instructions Add the notary fees for four letters and the cost of the training course, and you’re realistically looking at $550 to $800 total before you ever hold the license.

Once your application and fees are in, the License Division schedules an in-person fingerprinting appointment and, later, an interview. The NYPD estimates about six months from a complete application to a decision, and many applicants wait longer.1Government Portal. New Application Instructions

Where You Still Can’t Carry

Having the license doesn’t mean you can carry anywhere in the city. New York’s Concealed Carry Improvement Act designates a long list of “sensitive locations” where firearms are banned regardless of your license.   • Government buildings, courthouses, and polling places
  • Subways, buses, trains, ferries, airports, and their stations and platforms
  • Nursery schools, preschools, K-12 schools, colleges, summer camps, and state-licensed or state-funded childcare facilities
  • Public parks, playgrounds, zoos, and the designated Times Square area
  • Hospitals, clinics, mental health facilities, and addiction services locations
  • Churches, mosques, synagogues, and other houses of worship, unless you’re specifically responsible for security there
  • Any establishment licensed to serve alcohol or cannabis for on-site consumption
  • Theaters, stadiums, museums, conference centers, and banquet halls
  • Homeless shelters, domestic violence shelters, and youth shelters
  • Libraries

In Manhattan especially, the density of prohibited spots is high enough that a normal day of errands can cross several. Tracking where you are matters.

Private Property Is Off Unless the Owner Says On

Outside the sensitive-location list, the default rule for private property still cuts against the carrier. New York presumes firearms are not welcome on any private property unless the owner has given express permission, either through conspicuous signage or direct consent.7Governor.ny.gov. Walking into a grocery store or restaurant that hasn’t posted a sign saying carry is allowed is a violation.

Magazine and Ammunition Limits

State law caps ammunition feeding devices at ten rounds. Possessing any magazine that holds more is illegal.8New York State Senate. Passing Through NYC With a Firearm

If you’re not a resident but you’re driving or flying through, the rules are strict and enforced strictly.

Federal law offers a “safe passage” protection under 18 U.S.C. ยง 926A. If you can legally possess a firearm at both your origin and destination, you may transport it through restrictive jurisdictions as long as the gun is unloaded, locked in a container, and stored separately from ammunition outside the passenger compartment.10Office of the Law Revision Counsel. 18 US Code 926A – Interstate Transportation of Firearms If your vehicle has no trunk, the firearm and ammunition must be in a locked container other than the glove compartment or console.

NYC law enforcement has historically read that protection narrowly. Travelers who stop for more than fuel or a breakdown risk prosecution. An overnight hotel stop or a sightseeing detour can void the safe-passage defense because you’re no longer just transporting through.

For flying, TSA rules require firearms to travel as checked baggage only, unloaded and inside a locked hard-sided container. You have to declare the firearm at the airline ticket counter.11Transportation Security Administration. The trap: if your flight is canceled or you have to reclaim your bag inside NYC, you’re now in possession of a firearm in the city without an NYPD license, and federal safe-passage protection may not apply because the airport was your destination, not a waypoint.

Keeping the License Current

A Carry Business License is valid for three years. Renewal costs another $340 and has to be completed before the license expires.1Government Portal. Letting the license lapse doesn’t just end your carry authority; possessing the handgun without a valid license can bring criminal charges.

You also have to report changes that could affect eligibility during the license term. An arrest, an order of protection, a change of address, or a mental health commitment can trigger review or revocation. The NYPD doesn’t need to wait for the renewal date to pull the license.

Penalties for Carrying Without the License

Carrying a loaded handgun in NYC without the proper NYPD license is Criminal Possession of a Weapon in the Second Degree under Penal Law Section 265.03, a Class C violent felony.12New York State Senate. The minimum is mandatory. Judges cannot sentence below it. A second violent felony conviction pushes the minimum to seven years. Visitors from permissive-carry states are not exempt, and not knowing New York’s licensing requirements is not a defense.

Carrying in a designated sensitive location with a valid license is a separate offense under Penal Law Section 265.01-e.
