Section 10 borrows its penalty structure from Section 23, which covers driving on a suspended or revoked license. A first offense carries a fine of $500 to $1,000, and a judge can impose up to 10 days in jail. A second or subsequent offense carries a mandatory minimum of 60 days in jail, with a maximum of one year. District court judges handle these charges routinely.
What Happens at the Traffic Stop
If an officer runs your license and finds it expired, you are not driving away. The vehicle gets towed and impounded at your expense. Insurance and Liability Consequences
Your auto policy does not automatically terminate the day your license expires, but that does not mean you are protected. Many policies exclude losses tied to illegal activity, and driving unlicensed qualifies. If you crash while your license is expired, your insurer may deny the claim or dispute the payout. Once your license has been expired for more than two years, the simple renewal path closes. You will need to retake both the learner’s permit written exam and the road test, effectively starting the licensing process from the beginning. If you are close to the two-year mark, renewing before you cross it saves considerable time. And you still cannot legally drive in the meantime.
Active-Duty Military Exception
Active-duty military members are the one group with genuine flexibility. If you or an eligible family member is stationed outside Massachusetts with a license about to expire, the RMV can issue a temporary license valid for up to 60 days past the expiration date.
