Flying a drone in Key West is legal, but every launch on the island requires FAA airspace authorization before takeoff. The whole island sits inside controlled airspace tied to Key West International Airport, Naval Air Station Key West adds military no-fly zones across the Lower Keys, and city rules restrict where you can physically take off and land. Skip any one of those pieces and you risk fines, equipment seizure, or criminal charges.
You Need FAA Airspace Authorization for Every Flight
The entire island of Key West lies within five miles of Key West International Airport, which puts all of it in controlled airspace. No drone flight is legal there without FAA authorization first.1Key West International Airport. Unmanned Aircraft Systems
Authorization comes through the FAA’s Low Altitude Authorization and Notification Capability, known as LAANC. You request it through an approved app such as AirControl or Aloft, and approvals in eligible grids can come back within seconds. The app shows you the maximum altitude allowed in each grid square, which varies across the island because of the airport’s approach paths.
Naval Air Station Key West tightens the picture further. NAS Key West operates facilities across the Lower Keys, and civilian drones are not permitted in the military airspace around them. LAANC will not approve those zones. Check the FAA’s B4UFLY app during planning to see which areas are open and at what ceiling.
Pilot Certification and Drone Registration
Key West International Airport’s own guidance instructs anyone flying a drone on the island or within five miles of the airport to register as a Part 107 operator, obtain LAANC or Certificate of Authorization approval, follow Part 107 rules, and comply with local ordinances.1Key West International Airport. A pilot flying strictly for fun can operate under the recreational rules elsewhere by passing the free Recreational UAS Safety Test (TRUST) and carrying proof of completion, and by registering any drone weighing 250 grams or more.3Federal Aviation Administration. Where You Can Take Off and Land
Florida law lets local governments regulate drone takeoffs and landings on property they own, even though they cannot regulate the airspace itself.4Florida Senate. You need prior approval from city authorities to use municipal property as a launch or landing site.
That catches visitors off guard, because most of Key West’s photogenic spots are public. LAANC clearance covers the air; it does not give you a legal patch of ground to stand on. Private property with the owner’s permission is the cleanest option, but on a small island where the waterfront is largely public, options thin quickly.
Wildlife Refuges and the Marine Sanctuary
Federal regulations prohibit launching, landing, or disturbing wildlife with drones anywhere on National Wildlife Refuge land. The Fish and Wildlife Service warns that popular drone apps do not always show refuge boundaries accurately. Do not rely on an app alone. The Florida Keys National Marine Sanctuary reaches across most of the surrounding waters. Flying low to photograph manatees, sea turtles, or coral reefs can cross into a wildlife disturbance violation. Keep altitude, and keep distance from animals.
Florida Privacy and Critical Infrastructure Rules
Florida prohibits using a camera-equipped drone to record images of privately owned property or the people on it when the intent is surveillance and the person has a reasonable expectation of privacy. The statute presumes privacy exists when a person is not visible from ground level in a place they have a legal right to be, even if a drone can see them from above. Florida also criminalizes unauthorized drone operations near a defined list of critical infrastructure, which includes airports, military installations, seaports, correctional institutions, power plants, water treatment facilities, and gas pipelines, when those sites are fenced or posted. Penalties can reach the third-degree felony level, up to five years in prison and fines up to $5,000, with higher exposure for repeat or aggravated conduct.8Florida Senate. The Order to Handle Things Before You Fly

- Check airspace in B4UFLY, then request LAANC authorization through an approved app. Without it, no flight on the island is legal.
