Can You Gamble Online in Florida? Sports, Casinos, and Taxes

Online gambling in Florida is legal in only two forms: mobile sports betting through Hard Rock Bet and pari-mutuel wagering on horse races through licensed platforms. Online casino games, real-money internet poker, and most other forms of internet wagering remain criminal under Florida law. Daily fantasy sports and sweepstakes-style casinos operate in a gray zone the state has not moved to shut down. Because Florida has no state income tax, any winnings you report are taxed only at the federal level.

Mobile Sports Betting Through Hard Rock Bet

Hard Rock Bet is the only legal sportsbook in Florida. It launched statewide on December 7, 2023, and operates under the 2021 Gaming Compact between the state and the Seminole Tribe, ratified by the Legislature under § 285.710.1Official Internet Site of the Florida Legislature. You have to be at least 21 and physically inside Florida’s borders to place a bet.2Florida Legislature. Trying to spoof your position or otherwise work around the check can get your account terminated and your balance forfeited.

No other sportsbook can legally operate in the state. Hard Rock Bet holds exclusive rights under the compact, which runs for 30 years. That exclusivity has already survived a federal court challenge, so residents shouldn’t expect a second legal operator to appear in the near term.

Online Horse Race Wagering

Betting on horse races through an online platform is legal under Florida Statutes § 550.3551, which authorizes pari-mutuel wagering on races broadcast into and out of Florida and requires compliance with the federal Interstate Horseracing Act.3Official Internet Site of the Florida Legislature. You open an account, deposit funds, and place bets. The Florida Gaming Control Commission oversees the operators. Unlike sports betting, horse racing is not restricted to a single provider.

Online Casino Games and Poker Are Illegal

Real-money online casino play and internet poker rooms are prohibited. Florida’s general gambling statute makes it a second-degree misdemeanor to play any game of chance for money, whether in person or on a screen.5Florida Senate. No Florida law authorizes any company to offer a state-licensed online casino. The Seminole Tribe runs table games and slots on its reservation properties, but those rights do not extend to online play. Any site offering real-money blackjack, roulette, or online poker to Florida residents is operating offshore and outside the Florida Gaming Control Commission’s jurisdiction.7Florida Senate. Using an offshore site creates two practical problems on top of the criminal statute. Federal law requires banks and payment processors to block transactions tied to unlawful internet gambling, so deposits and withdrawals through U.S. financial institutions often get declined or frozen.8eCFR. Most people who lose out on offshore platforms lose to the operator, not to a prosecutor.

Daily Fantasy Sports

DraftKings, FanDuel, and similar daily fantasy operators accept Florida players, but their legal footing is genuinely uncertain. Florida has never passed a law that authorizes or regulates paid fantasy contests. The operators rely on the argument that building a fantasy lineup is a game of skill and therefore falls outside the state’s gambling ban.

The complication is that Florida Statutes § 849.14 makes it a misdemeanor to bet on any contest of skill, speed, or endurance, not only games of chance.9Florida Senate. The Florida Attorney General has issued an advisory opinion raising the possibility that paid daily fantasy contests fall within that statute.10My Florida Legal. Gambling / Fantasy Sports League Even so, the state has not prosecuted an individual player or moved against a major operator, and the platforms continue to run contests with large prize pools for Florida residents. Because no licensing framework exists, daily fantasy operators do not pay Florida gaming taxes.

Social and Sweepstakes Casinos

Sweepstakes casinos offer casino-style games in Florida by structuring themselves around the legal definition of gambling. Under longstanding principles, illegal gambling requires three things at once: a prize, chance, and consideration (payment). Take one away and it is not gambling in the legal sense.

Sweepstakes platforms remove the consideration element. You get virtual coins for signing up or logging in. You can buy additional social coins for entertainment, and those purchases come bundled with bonus sweepstakes entries at no extra charge. The sweepstakes entries are what can lead to redeemable prizes. Federal rules reinforce this model: a lawful sweepstakes must allow free entry, and buying something cannot improve the odds of winning.11USPIS.gov. If a site forces you to pay before you can play, it is probably not operating a lawful sweepstakes.

Taxes on Florida Gambling Winnings

Every dollar you win gambling is taxable at the federal level, whether it comes from Hard Rock Bet, a horse racing app, a sweepstakes cashout, or a daily fantasy contest. The IRS treats gambling winnings as ordinary income. Florida imposes no state income tax, so nothing is owed to Tallahassee. The federal obligation stands regardless of whether you receive a tax form from the operator.

Reporting and Withholding Thresholds for 2026

Starting in 2026, the IRS set a uniform $2,000 threshold for issuing a Form W-2G, the document that reports gambling winnings. The threshold will be adjusted for inflation each year going forward.12Internal Revenue Service. Instructions for Forms W-2G and 5754 (01/2026) For sports wagers, horse racing bets, and most other wagers, a W-2G is issued only when the winnings meet the $2,000 threshold and are at least 300 times the amount wagered.

Withholding is a separate trigger. Operators must withhold 24% of your winnings when the payout minus your wager exceeds $5,000 from sports bets, sweepstakes, lotteries, or pari-mutuel wagers that hit the 300-to-1 ratio.12Internal Revenue Service. Deducting Gambling Losses in 2026

The One Big Beautiful Bill Act, signed into law on July 4, 2025, changed how gamblers deduct losses. Beginning with the 2026 tax year, you can deduct only 90% of your gambling losses against your winnings, down from the full 100% previously allowed. The deduction is still capped at the amount of your winnings, and gambling losses cannot offset any other type of income.

In practice, if you won $201,000 and lost $200,000, you would expect tax on $1,000. Under the new rule, you can deduct only $180,000 (90% of $200,000), leaving $21,000 in taxable gambling income. For casual bettors with modest swings, the effect is small. For anyone wagering serious money, it is a real cost.

The deduction is also available only if you itemize. Roughly 86% of taxpayers take the standard deduction instead, and those filers pay federal income tax on every dollar of gambling winnings with no offset for losses.

Federal Laws Sitting Behind Florida’s Rules

Two federal statutes shape what is possible in Florida beyond the state’s own laws. The Federal Wire Act prohibits anyone in the gambling business from using interstate wire communications to transmit bets on sporting events, with penalties up to two years in federal prison.13Office of the Law Revision Counsel. 18 USC 1084 – Transmission of Wagering Information; Penalties It is part of the reason the Seminole compact keeps all server processing on tribal land within Florida; routing wagers through out-of-state servers would raise serious federal concerns. The statute carves out an exception for wagers transmitted between two jurisdictions where that type of betting is legal in both.

The Unlawful Internet Gambling Enforcement Act of 2006 takes aim at the money rather than the bet. Banks, credit card companies, and payment processors must maintain written policies designed to identify and block transactions connected to unlawful internet gambling.8eCFR. Your bank is following a federal regulation, and financial institutions that block these transactions are explicitly shielded from liability, so disputing the block will not get you anywhere.
