Can You Gift a Car in New York? Forms, DMV Steps, and Taxes

Gifting a car in New York means signing the title over to the recipient, filing a Statement of Transaction (Form DTF-802) that claims the gift, and letting the recipient register and insure the vehicle in their own name. Gifts between a spouse, parent, child, stepparent, or stepchild are exempt from state sales tax. Everyone else pays sales tax on the car’s fair market value, even when no money changes hands. Plan on at least $75 in title and plate fees, plus a weight-based registration charge.

Who Can Receive the Car Tax-Free

New York exempts vehicle gifts from sales tax only when the transfer runs between five specific relationships: spouse, parent, child, stepparent, and stepchild.1NY DMV – NY.Gov. Grandparents, grandchildren, siblings, aunts, uncles, cousins, and friends are not on that list. A car gifted to any of them is still a taxable transfer, and the DMV will charge sales tax based on the vehicle’s fair market value. Combined state and local rates in New York run from about 7% to 8.875%, so a $15,000 vehicle can trigger more than $1,000 in tax. When the recipient falls outside the five exempt relationships, the donor also has to complete the Section 6 affidavit on page two of the DTF-802, sworn under penalty of perjury.1NY DMV – NY.Gov. Two more prerequisites: the donor must be the titled owner (both owners must sign if the title lists two names), and the title must be lien-free. The Three Documents You’ll Need

The Certificate of Title

On the back of the title, the donor completes the “Transfer by Owner” section: printed names and addresses for both parties, the date, and the donor’s signature. Don’t write anything on the front, and don’t fill in any transfer information until the actual day of the gift. The back of the title also carries two disclosures. The damage disclosure is required for every vehicle: the donor certifies whether the car has ever been wrecked or damaged badly enough that repairs would exceed 75% of its retail value at the time of loss.5NY DMV. Form DTF-802, Statement of Transaction

The recipient fills out page one with the vehicle’s VIN, year, make, model, and their personal information. For a qualifying family gift, the donor checks the correct relationship box and signs. Form MV-82, Vehicle Registration and Title Application

The recipient uses this form to apply for a new title and register the vehicle in their name.6NY DMV. Buy, Sell, or Transfer Vehicle Ownership Both parties should bring valid photo ID to the DMV.

At the DMV

Bring the signed original title, the completed DTF-802, and the MV-82 to any DMV office. The title certificate fee is $50.7NY DMV. Apply for a Title Certificate Only New plates cost $25.8NY DMV. What the Recipient Has to Line Up

Insurance

New York won’t issue plates or a registration until the recipient produces proof of a compliant New York auto policy. That means the statutory liability minimums plus $50,000 in Personal Injury Protection (no-fault) and uninsured motorist coverage.9NY DMV. Registration Fee

The two-year registration fee scales with the vehicle’s weight. Standard passenger vehicles run from $26 for the lightest cars to $140 for those over 6,950 pounds. A New Inspection Within 10 Days

The prior owner’s inspection sticker becomes invalid the moment ownership changes. The recipient has 10 days from the registration date to get the car inspected at a licensed New York inspection station.11NY DMV. What the Donor Does After Signing Over the Title

The registration expires the instant ownership transfers, so the donor’s job is to get their name off that car fast. Take the plates off before handing over the keys. Plates belong to the person, not the vehicle, and they can be moved to another car the donor owns or surrendered at the DMV.

Leaving plates on a gifted car is one of the most common mistakes in private transfers. Any tolls, parking tickets, or red-light or speed-camera violations racked up on those plates come back to the registered plate holder, meaning the donor. Clearing them later can require proving the transfer in court or before an administrative tribunal. Pull the plates, hand over the signed title, and let the recipient handle their own registration.

Federal Gift Tax on a Vehicle

New York has no separate state gift tax on vehicles, but federal rules still apply when the car is valuable. For 2026, the annual exclusion is $19,000 per recipient. A gift under that amount requires no reporting at all.12Internal Revenue Service. Filing Form 709 rarely means owing tax. The excess simply counts against the donor’s lifetime gift and estate tax exemption, which is over $13 million for 2025 (the 2026 figure has not yet been finalized by the IRS as of this writing). Fair market value should reflect a private-party sale price for a comparable car of the same make, model, year, condition, mileage, and options, not a dealer retail number. Mechanical problems, body damage, or unusually high mileage can pull that value down.14Internal Revenue Service.
