Can You Gift a Car in Virginia Without Paying Tax?

You can gift a car in Virginia without paying the state’s 4.15 percent motor vehicle sales and use tax, but only if the recipient is your spouse, son, daughter, or parent. Anyone else, no matter how close, will owe the tax when they title the vehicle. The transfer itself is straightforward: a signed title, a tax exemption form, a $15 titling fee, and a short DMV visit.

Who Can Receive a Tax-Free Car Gift

Virginia’s sales and use tax exemption for a gifted vehicle applies only when the recipient is the transferor’s spouse, son, daughter, or parent.1Virginia Code Commission. Virginia Code 58.1-2403 – Exemptions That list is exhaustive. Siblings, grandparents, grandchildren, in-laws, aunts, uncles, cousins, and friends are not on it. If you gift a car to any of them, the recipient pays tax at titling.

A gift also has to be an actual gift. The recipient can’t give anything of value in exchange, whether that’s cash, services, or forgiveness of a personal debt. If they do, Virginia treats the transfer as a sale.

The Assumed-Loan Trap

Here’s the piece that catches families off guard. If the recipient takes over any unpaid debt on the vehicle, the exemption disappears. The only relationship where an assumed loan doesn’t kill the exemption is spouse to spouse.1Virginia Code Commission. Virginia Code 58.1-2403 – Exemptions

So if you want to gift a car to your daughter and there’s still $8,000 owed on it, letting her assume that loan turns the whole transfer into a taxable transaction. The clean route is to pay the loan off before transferring the title. The lender will then release the lien and either send you a clear title or provide a lien release document to submit with the existing title. The DMV will not transfer ownership while a lien still sits on the title.

What Non-Qualifying Recipients Pay

When the exemption doesn’t apply, the recipient pays 4.15 percent of the vehicle’s gross sales price as motor vehicle sales and use tax at titling.2Virginia Department of Motor Vehicles. Writing “$0” on the title won’t get around this. For vehicles five model years old or newer, the stated price must be within $1,500 of the NADA trade-in value, or the DMV will require additional documentation and can assess tax based on the vehicle’s market value.2Virginia Department of Motor Vehicles. Documents to Bring to the DMV

Both parties should have the following ready before going in:

  • The Certificate of Title, with the donor signed in the seller section and the recipient signed in the buyer section. Write “gift” in place of the sale price.4Virginia Department of Motor Vehicles. Buying/Selling a Vehicle
  • Purchaser’s Statement of Tax Exemption (Form SUT-3), completed by the recipient to certify the family relationship and claim the exemption.   • Odometer disclosure. Federal law requires it for the first 20 years for model year 2011 and later vehicles, and applies under the previous 10-year window for model year 2010 and older vehicles.   • Government-issued ID for both parties. Names must match the title and forms exactly.

Fees, Plates, and the DMV Visit

Registration is separate. A standard passenger car runs $30.75 per year for vehicles at 4,000 pounds or less, or $35.75 for vehicles between 4,001 and 6,500 pounds.8Virginia DMV. DMV Fees If the recipient already has Virginia plates on another vehicle they own, those plates can be moved to the gifted vehicle using a License Plate Application (Form VSA 10) at a customer service center.9Virginia Department of Motor Vehicles. What the Donor Needs to Do Afterward

Don’t skip this. Virginia requires the donor to notify the DMV that the vehicle has been sold, traded, or donated. You can do it online, at a customer service center, or by phone.4Virginia Department of Motor Vehicles. Buying/Selling a Vehicle Until that notification is on file, the vehicle is still tied to your name, and parking tickets, toll violations, and similar issues can come back to you.

Take your plates off the car unless you’re transferring them. Either surrender the plates to the DMV or keep them. If the liability insurance on the vehicle lapses after the transfer without the registration being handled properly, Virginia can suspend your driving privileges.10Virginia Department of Motor Vehicles. Insurance and Safety Inspection for the New Owner

Virginia requires proof of minimum liability coverage before it will issue plates or decals.10Virginia Department of Motor Vehicles. Insurance Requirements The recipient should call their insurer before the DMV visit so coverage is confirmed on arrival. Most insurers offer a grace period of 7 to 30 days to add a newly acquired vehicle to an existing policy.

The state also requires a safety inspection at an authorized station at least once every 12 months.11Virginia Code Commission. A vehicle that fails inspection receives a rejection sticker valid for 15 days while repairs are made.

Federal Gift Tax

Virginia’s sales tax exemption is state-only. The IRS has its own rules, which matter mostly for high-value vehicles. For 2026, you can give up to $19,000 per recipient per year with no federal gift tax reporting.12Internal Revenue Service. What’s New – Estate and Gift Tax Most car gifts sit well under that.

If the vehicle’s fair market value is over $19,000, the donor has to file IRS Form 709 for the year of the transfer. Filing doesn’t necessarily mean tax is owed. The amount over $19,000 comes out of your lifetime gift and estate tax exemption, which is $15,000,000 for 2026.12Internal Revenue Service. Married couples can split a gift and effectively double the exclusion to $38,000, provided both spouses file Form 709 to elect gift splitting.
