Home Cultivation Is Off Limits for Everyone
Section 4764A of Title 16 lists what adults 21 and older can legally do with cannabis — possess small amounts, share small amounts, buy from licensed retailers — and then spells out what remains criminal. The prohibition applies equally to registered medical patients. The Delaware Medical Marijuana Act, at Title 16, Chapter 49A, gives no cultivation right to patients or their designated caregivers. There is no small-scale carve-out. One plant, three plants, indoors, outdoors, locked closet, backyard — none of it matters. Without a commercial license from the state, the act of growing is a crime.
What Growing Without a License Costs You
Cultivation is prosecuted as manufacturing a controlled substance under the Uniform Controlled Substances Act. The charge is a felony from the first gram, and the felony class escalates by weight.

1,500 grams works out to about 3.3 pounds. A modest indoor setup with a handful of plants can produce that in a single cycle, which means a personal grow can land you in Class C territory without much effort. The manufacturing statute doesn’t distinguish between growing for yourself and growing to sell. The weight is the weight.

The Legal Way to Get Cannabis in Delaware
Since you can’t grow it, you have to buy it. Delaware’s recreational retail market opened on August 1, 2025, when 12 existing medical dispensaries began serving adult-use customers. Adults 21 and older can legally possess a “personal use quantity,” defined in House Bill 1 as any of the following:
- One ounce (28 grams) or less of dried leaf marijuana
- 12 grams or less of concentrated cannabis

Possessing, using, purchasing, or transporting amounts at or below those limits carries no civil or criminal penalty.1Justia Law. Where You Can and Cannot Use It
Consumption in any area accessible to the public is a criminal offense, and so is consumption inside a moving vehicle.1Justia Law. Adult-Use When you transport cannabis in a car, it needs to be in a closed container or otherwise not readily accessible to anyone inside.
The short version: buy it from a licensed dispensary, keep quantities within the personal use limit, use it in private, and leave the growing to license holders. Anything else puts you on the wrong side of a felony statute.
