Can You Pass a Moving School Bus in NC? Fines, Felonies, Points

Passing a stopped school bus in NC is a Class 1 misdemeanor that carries a minimum $500 fine, five points on your license, and possible county camera penalties on top. When a school bus has its stop arm out and red lights flashing, every driver on that road must stop, no matter which direction they’re going. The single exception is opposite-direction traffic on a divided highway.

When You Have to Stop

If a school bus activates its stop arm and flashing red lights, every driver on the road must come to a complete stop, regardless of direction. You stay stopped until the arm retracts, the red lights turn off, and the bus starts moving again. The rule applies on two-lane roads, on multi-lane roads without a physical divider, and in any public vehicular area including parking lots and school driveways. The Divided Highway Exception

You do not have to stop only when you’re going the opposite direction from the bus on a divided highway. A road qualifies as divided if the two directions of travel are separated by a physical barrier, such as a concrete median or grass strip, or by an intervening space. A center turn lane counts as an intervening space only if the road has at least four total lanes.1North Carolina General Assembly. That last piece catches people. On a five-lane road with two travel lanes each way and a shared center turn lane, opposite-direction traffic does not have to stop. On a three-lane road with one lane each way and a center turn lane, opposite-direction traffic must stop, because the road has fewer than four lanes.

Same-direction traffic always stops. The exception only protects drivers on the other side of the barrier or intervening space.

Criminal Penalties for Passing a Stopped School Bus

Jail exposure depends on your prior record. A first-time offender faces up to 45 days and would typically receive a community punishment like probation or community service. One detail that surprises defendants: the statute specifically bans “prayer for judgment continued” for this offense. PJC is a common North Carolina tool that lets you avoid formal conviction on many traffic offenses. It is not available here. Felony Charges If Someone Is Struck

Striking any person while willfully violating the stop law is a Class I felony carrying a minimum $1,250 fine and a mandatory two-year driver’s license revocation. If the person dies, the charge becomes a Class H felony with a minimum $2,500 fine and a three-year license revocation.1North Carolina General Assembly. The felony applies when you strike “any person,” not just a child. A crossing guard, another parent, or any pedestrian near the bus triggers the same charge. The license revocation is mandatory and runs the full period.

County Stop-Arm Camera Penalties

Many North Carolina counties run civil penalty programs using cameras mounted on school bus stop arms. The amounts escalate with repeat violations:

  • First violation: $400
  • Second violation: $750
  • Third and subsequent violations: $1,000 each

If you don’t pay within 30 days or request a hearing, a $100 late fee is added. Ignore it long enough and the DMV can refuse to renew your vehicle registration.
