FanDuel works in Georgia, but only in part. You can enter daily fantasy sports contests, play FanDuel Faceoff, and use FanDuel Predicts while physically inside the state. That block is not a setting you can adjust; it applies to every device and browser.
Why Daily Fantasy Sports Are Allowed
Georgia’s gambling code defines a “bet” as an agreement where someone stands to win or lose something of value based on an outcome that depends on chance, even if some skill is involved. The same statute excludes prizes or compensation offered to contestants in a “bona fide contest for the determination of skill, speed, strength, or endurance.”3Justia. Georgia Code 16-12-20 – Definitions DFS operators rely on that exception. Drafting a lineup under a salary cap is treated as a skill contest rather than a wager.
Georgia has never passed a law that explicitly legalizes or regulates DFS, and it has never passed one that bans them either. FanDuel and its competitors operate without a state licensing framework or oversight. You’re not playing in a state that has affirmatively blessed daily fantasy sports; you’re playing in one that hasn’t gotten around to addressing them. A future legislature could close that gap in either direction.
Why the Sportsbook and Racing Are Blocked
The Georgia Constitution draws a hard line. Article I, Section II, Paragraph VIII states that “all lotteries, and the sale of lottery tickets, and all forms of pari-mutuel betting and casino gambling are hereby prohibited,” with only narrow exceptions for the state-run lottery and nonprofit bingo.2Georgia Secretary of State. Legalization requires a constitutional amendment: a two-thirds supermajority in both chambers followed by a public vote.
The criminal code reinforces the ban. Simple gambling, which covers placing a bet on the result of a game or contest, is a misdemeanor.4Justia. Horse racing falls under the same constitutional bar on pari-mutuel wagering, the system where bets go into a shared pool and payouts come from that pool after the track’s cut. Georgia has no horse racing commission, no licensed tracks, and no framework for advance deposit wagering. FanDuel Racing stays dark here even for the Kentucky Derby and Breeders’ Cup.
Is Legalization Coming
Lawmakers have tried repeatedly to open the door, and every effort has run into the amendment requirement. In the 2026 session, Rep. Matt Hatchett introduced HB 910, which was assigned to the Higher Education Committee. A prior House study committee on gaming issued a nine-page report with no recommendations. A Senate study committee on tourism suggested legal sports betting could help attract major events. None of these efforts have come close to the two-thirds vote needed to put an amendment on the ballot.
Signing Up in Georgia
You must be at least 18 to deposit money or enter a fantasy contest on FanDuel in Georgia.6FanDuel. Trust and Safety Registration requires your full legal name, a verified residential address, date of birth, and the last four digits of your Social Security number. FanDuel verifies your identity during signup, so a false date of birth won’t get through.

Withdrawals
Most withdrawal methods require that you’ve already used them for a deposit. Deposited with a debit card? Withdraw to that same card. Deposited through PayPal? Your withdrawal goes to the bank account linked to that PayPal. Don’t Try to Spoof Your Location
FanDuel’s geolocation system pings cell towers and Wi-Fi signals to confirm you’re physically inside a state where your chosen product is legal. The check runs every time you open the app or enter a contest. If the system can’t confirm your location, you’re locked out until it can.
Using a VPN or GPS spoofing tool to reach the sportsbook or casino from Georgia is a fast way to lose your account. FanDuel’s terms of use state that anyone who fails to meet eligibility requirements, including the physical location requirement, faces account termination, forfeiture of prizes, and restrictions on withdrawals. Taxes on Your Winnings
Winning money on FanDuel’s fantasy contests triggers tax obligations even though the activity is legal here. The IRS treats gambling and fantasy sports winnings as taxable income that must be reported on your federal return using Schedule 1 of Form 1040.9Internal Revenue Service. Gambling Income and Losses This applies whether or not you receive a tax form. If your net fantasy sports profit for the year reaches $600, FanDuel is required to send you and the IRS a 1099. Amounts below that threshold are still taxable; you report them yourself.
You can deduct fantasy sports losses, but only if you itemize on Schedule A, and the deduction cannot exceed your reported winnings for the year. A $2,000 loss against $800 in winnings doesn’t get you a $2,000 write-off. The IRS also expects records: a log of entries, results, amounts won or lost, and any statements from the platform.9Internal Revenue Service.
