Can You Ship Alcohol to Maine? Wine, Beer, and Spirits Rules

Shipping alcohol to Maine is legal only for wine, and only when it comes from a winery that holds a Maine direct shipper license. Spirits and beer cannot be shipped to Maine consumers from out-of-state sellers at all, and out-of-state retailers, including online wine shops, are also shut out. That leaves a narrow but real path: licensed wineries can send wine straight to your door, up to twelve cases per year, through a private carrier that verifies your age at delivery.¹

What You Can and Cannot Have Shipped

Maine’s default rule under Title 28-A, Section 2077-B is that no one may sell, deliver, or purchase liquor from an out-of-state company by mail order. The single carve-out is licensed direct wine shipment under Section 1403-A.²

That means:

Wine from a licensed winery: allowed.
Wine from an out-of-state retailer or wine shop: not allowed.
Spirits from any out-of-state source: not allowed.
Beer from any out-of-state source: not allowed.

One thing worth knowing regardless of the source: the U.S. Postal Service cannot carry alcohol at all. Under 18 U.S.C. § 1716, alcoholic beverages are classified as nonmailable nationwide.³ Any wine you legally receive will arrive by UPS or FedEx.

How Direct Wine Shipping Works

To ship wine to a Maine address, a winery must hold a federal basic wine manufacturing permit and obtain a wine direct shipper license from the Maine Bureau of Alcoholic Beverages and Lottery Operations. The application requires the federal permit, a list of labels the winery intends to ship, and a fee of up to $200. Both in-state and out-of-state wineries can qualify.¹

Once licensed, a winery can ship to you within these limits:

No more than 12 cases per calendar year to any one recipient address.
No more than 9 liters per case.
No bottle smaller than 750 milliliters.
For personal use only, not for resale.
Wine coolers are excluded.⁴

Delivery itself has its own requirements. FedEx applies its Adult Signature Required service to every package containing alcohol: the recipient must be at least 21, show government-issued photo ID, and sign in person. If no one is available, or the recipient appears intoxicated, the driver will not leave the package.⁵ UPS handles wine under a shipping addendum that puts compliance on the shipper and also blocks redirection of wine packages to UPS Access Point pickup locations, so plan to be home.⁶

Why Spirits and Beer Cannot Ship In

Maine is a “control state” for spirits. The state government itself acts as the sole spirits wholesaler, buying every bottle sold in Maine and setting both wholesale and retail prices at licensed agency liquor stores.⁷ There is no legal channel for an out-of-state distillery or spirits retailer to bypass that role and ship to you directly. Beer sits inside the private three-tier system but has no direct-shipping exception equivalent to wine, so it too is off-limits for out-of-state shipment.

Why Out-of-State Wine Retailers Cannot Ship Either

The wine exception is written for producers, not sellers. Section 1403-A requires a federal wine manufacturing permit, which retailers do not hold. That is why an out-of-state online wine shop cannot ship to a Maine address even when a Maine-licensed winery could send the same bottle.¹

Retailers physically located in Maine, on the other hand, can deliver alcohol to Maine consumers, with age verification at the door.

Bringing Alcohol Back Yourself

If you cross into Maine with alcohol you bought out of state, the statute sets category limits for personal use:

For spirits, the Bureau can issue a special permit to bring in more than 4 liters, useful mainly for collectors or people relocating to the state.⁸ There is no equivalent permit path in the statute for wine or beer. Whatever you bring must be for personal consumption.

Penalties Apply to Buyers, Not Just Sellers

Section 2077-B is written to reach both sides of an illegal mail-order transaction. It prohibits selling, furnishing, delivering, and purchasing liquor from an out-of-state company by mail order outside the licensed wine exception. Penalties track those in Sections 2073-A and 2073-C for unauthorized importation.² If you order spirits or beer from an out-of-state website, you are exposed too, not only the seller.

Legal Ways to Widen Your Selection

Several routes give you access to more than what sits on the nearest shelf:

Join a wine club at any winery that holds a Maine direct shipper license. Many wineries do, and the 12-case annual cap leaves plenty of room for monthly or quarterly clubs.
Order through a licensed Maine retailer. Local shops and agency liquor stores can often special-order products already carried by Maine’s wholesale distributors.
Buy from Maine producers directly at their tasting rooms. This works for wineries, breweries, and distilleries and sidesteps shipping rules entirely.
Bring alcohol back yourself within the 4-liter, 4-liter, and 400-fluid-ounce limits above.

For spirits in particular, agency liquor stores are the only retail channel, and prices are set by the state, so shopping around by price will not help. If a specific bottle is not on the shelf, ask the store to request it through the Bureau.
