Smoking in public in California is prohibited in almost every place you’re likely to stand. Enclosed workplaces, government buildings and their entrances, playgrounds, youth sports events, state parks, beaches, public transit vehicles, and transit stops are all off-limits, and cities routinely add more restrictions on top. Cigarettes, cigars, and vaping devices are treated the same under most of these laws, and cannabis is banned anywhere tobacco is.
Indoor Workplaces, Restaurants, and Bars
California’s Labor Code bans smoking in every enclosed place of employment. That covers offices, factories, restaurants, bars, retail stores, theaters, and building lobbies. “Enclosed” is defined broadly and includes parking structures, waiting areas, elevators, stairwells, and restrooms attached to the building.1California Legislative Information. A few narrow exceptions exist. Tobacco shops and private smokers’ lounges are exempt. So are patient smoking areas in long-term care facilities and truck cabs when everyone inside is a smoker. Government Buildings and the 20-Foot Rule
You can’t smoke inside any public building in California, and you can’t smoke within 20 feet of a main exit, entrance, or operable window of one. State-owned passenger vehicles are also off-limits. “Public building” reaches state, county, and city offices, courthouses, libraries, and facilities on University of California and California State University campuses.3Justia Law. Cities and campuses can push that buffer out further, and many have.
Playgrounds and Youth Sports
Smoking is banned within 25 feet of any playground or tot lot sandbox area on public park grounds or school property. A public sidewalk that happens to run within that 25-foot zone is exempt, so walking past on the sidewalk isn’t a violation.4California Legislative Information. A larger buffer applies during youth sports. If a practice, game, or related event involving athletes under 18 is happening at a park or facility, smoking is banned within 250 feet. Violating either rule costs $250. Both laws define “smoking” to include vaping.
State Parks and Beaches
Since 2020, smoking has been prohibited on all California state beaches and throughout the state park system. The ban covers cigarettes, cigars, pipes, vaping devices, and any other lighted or heated inhalation product. The only place you can smoke within a state park or beach is on paved roadways and in parking facilities.5California Legislative Information. California Public Resources Code 5008.10
Two other exceptions exist: smoking as part of a religious ceremony, and smoking props on permitted, closed film sets. Elsewhere in the park, the fine is up to $25, plus any local add-ons.
Buses, Trains, and Transit Stops
Smoking is prohibited on every public transit vehicle in California and at every transit stop, including bus stops, train stations, and covered shelters. The rule applies across all transit agencies in the state.
Amtrak bans smoking and vaping on trains, connecting buses, and inside stations. Crews sometimes announce that passengers can step off and smoke during extended platform stops, but only when time allows and local law permits.6Amtrak. Smoking Policy
Vaping and E-Cigarettes
California treats vaping the same as smoking almost everywhere. Since 2016, electronic smoking devices have been folded into the definitions of “smoking” and “tobacco product” in the state’s major anti-smoking laws. Vaping is banned in enclosed workplaces, near government buildings, at playgrounds and youth sports events, in state parks, on beaches, and at transit stops.1California Legislative Information. Cannabis in Public
Legal recreational cannabis doesn’t create a right to smoke it in public. State law prohibits smoking or vaping cannabis in any public place, and it also bars cannabis use anywhere tobacco smoking is already banned. Every restriction above applies to cannabis too.7California Legislative Information. California Health and Safety Code 11362.3
Cannabis carries extra limits on top. You can’t smoke or vape it within 1,000 feet of a school, daycare, or youth center while children are present, unless you’re inside a private home and the smoke isn’t detectable at the school or center. Smoking or ingesting cannabis while driving or riding in a vehicle is also illegal.
Local Rules Often Go Further
State law is the floor. California cities and counties are free to adopt stricter smoking restrictions, and many have.8California Department of Public Health. California’s Statewide Smoke-Free Air Laws and Restrictions Common local expansions include:
- All public parks, not just the area near playgrounds
- Outdoor dining areas of restaurants and bars
- Public sidewalks and pedestrian zones
- Balconies, patios, and units in multi-unit housing
- Farmers’ markets, sports arenas, and other outdoor venues
The apartment rule surprises people. There is no statewide ban on smoking inside your own unit, but a growing number of cities prohibit it. Landlords can also ban smoking as a lease term. Check the local municipal code and your lease before assuming your unit or balcony is fair game.
What the Fines Look Like
Violating California’s smoking laws is an infraction. No jail, but the fines vary by which law you break. There is no single statewide fine that applies across all situations.

- Smoking in a vehicle with a minor: up to $100 per violation
Local fines are often steeper, and many cities use a progressive schedule where repeat violations climb. Fines of $100 to $500 per incident are common at the city level.
