Unfiltered Cigars Are Still Allowed Anywhere
Even where a local government has banned beach smoking, the state statute forbids that ban from reaching unfiltered cigars.1The Florida Legislature. Cigars with plastic tips or filters are not exempt and can be restricted the same way cigarettes are.
What About Vaping?
Vaping sits under a separate legal framework. Florida never preempted local regulation of vapor-generating electronic devices, so cities and counties have independent authority to restrict vaping on beaches.1The Florida Legislature. State Parks and Federal Beaches Follow Different Rules
The local-control system only applies to beaches owned by counties and cities. Popular Beaches That Have Banned Smoking
Miami Beach was one of the first cities to act. Its ordinance took effect January 1, 2023 and covers all lighted tobacco products except unfiltered cigars on public beaches and parks.5City of Miami Beach. St. Johns County, home to St. Augustine Beach, followed in late 2025.
The trend runs clearly toward more bans. But smaller and less tourist-oriented beach towns haven’t all acted, and where no local ordinance exists, smoking remains legal by default.
Fines If You Get Caught
Violating a local beach smoking ban is a civil infraction, not a crime. Each local government sets its own fine schedule, and most follow a tiered structure that climbs with repeat violations. Look for the city or county ordinance on its government website, watch for posted signs at the beach entrance, or call the local parks and recreation department. Tourist-heavy beach towns tend to post the rules clearly at public access points. For state park beaches, assume smoking and vaping are prohibited. For federal shorelines, check the park’s own page.
