CAPI Program: Eligibility, Payment Amounts, and How to Apply

The CAPI program in California — the Cash Assistance Program for Immigrants — provides monthly cash payments to aged, blind, or disabled non-citizens who would qualify for federal Supplemental Security Income but are denied solely because of their immigration status. It is entirely state-funded, mirrors SSI and State Supplementary Payment benefit levels, and pays up to roughly $1,234 per month for an individual in 2026. Who Qualifies

Three requirements have to be met at the same time: a categorical requirement, an immigration requirement, and a financial requirement.

Age, Blindness, or Disability

You must be at least 65, legally blind, or have a medically determinable physical or mental impairment that prevents substantial gainful activity and is expected to last at least 12 continuous months or result in death. These standards match the Social Security Administration’s SSI definitions.1California Department of Social Services. Immigration Status

Under Welfare and Institutions Code Section 18938, you qualify if your status would have made you eligible for SSI/SSP as those rules existed on August 21, 1996, but you are now denied SSI/SSP only because of the federal immigration restrictions.2California Legislative Information. The battered-immigrant category is worth knowing about because many eligible applicants overlook it. If you or your child have been subjected to battery or extreme cruelty by a spouse, parent, or household member, and you have a pending or approved petition establishing your immigration case, you may qualify even without a green card in hand.3Office of the Law Revision Counsel. 8 USC 1641 – Definitions

Income and Resources

CAPI uses SSI’s financial limits. Countable resources cannot exceed $2,000 for an individual or $3,000 for a couple.4California Department of Social Services. Cash Assistance for Immigrants Your primary home and one vehicle are excluded, along with burial funds and life insurance policies with a face value of $1,500 or less. Both earned and unearned income count, including in-kind support and maintenance like free rent or meals from someone in your household. If your countable income after allowable disregards is below the maximum CAPI payment, you receive the difference; if it equals or exceeds the maximum, you’re ineligible.

Basic CAPI vs. Extended CAPI

When you entered the United States decides which track you fall into and whether your sponsor’s finances count against you.

Basic CAPI

If you entered the U.S. before August 22, 1996, you fall under Basic CAPI, and sponsor restrictions are generally lighter. You can also qualify for Basic CAPI if you entered on or after that date and one of three sponsor conditions applies: your sponsor has died, your sponsor is disabled, or you are a victim of abuse by your sponsor or the sponsor’s spouse. Abuse claims require a sworn statement plus at least one piece of supporting evidence, such as a police report, documentation from a domestic violence program, or a medical professional’s records. If no additional evidence is available, the county can accept the sworn statement alone after making a credibility determination.2California Legislative Information. Extended CAPI

If you entered on or after August 22, 1996, and your sponsor is alive, not disabled, and has not abused you, you fall under Extended CAPI, available since October 1, 1999. Here a portion of your sponsor’s income and resources may be “deemed” to you for up to 10 years, running from the date the sponsor signed the Affidavit of Support or your U.S. arrival, whichever is later.5California Department of Social Services. How Much CAPI Pays in 2026

CAPI payments track the combined federal SSI and California State Supplementary Payment rates, which adjust annually with the Social Security cost-of-living increase. For 2026, the COLA is 2.8 percent.6Social Security Administration. That puts the maximum CAPI payment at approximately $1,234 per month for an individual living independently and about $2,099 for a couple. Your actual check is lower if you have countable income or receive in-kind support. Benefits arrive on the first of each month by Electronic Benefit Transfer card or direct deposit.

How Free Rent or Meals Reduce Your Check

If someone else pays your rent, mortgage, or food costs, Social Security rules treat that help as income under the “presumed maximum value” rule. The reduction equals one-third of the federal SSI benefit rate plus $20. For 2026, with the federal rate at $994, the maximum reduction is about $351 for an individual receiving full room and board.7Social Security Administration. It catches people off guard when a family member covers housing costs, thinking it won’t affect benefits.

How to Apply

Applications go through your local county social services office. The core form is the SOC 814, “Statement of Facts — Cash Assistance Program for Immigrants.”9California Department of Social Services. Expect to provide these along with the SOC 814:

  • Identity and immigration status documents such as a Permanent Resident Card, I-94 Arrival/Departure Record, or asylum approval letter
  • Recent bank statements for all accounts, proof of any income like pay stubs, pension statements, or support letters, and documentation of other resources
  • Housing cost proof such as a rental agreement or mortgage statement and utility bills, because these figures affect your benefit calculation directly
  • Sponsor information if you have one, plus any evidence that the sponsor is deceased, disabled, or abusive if you’re claiming a Basic CAPI exemption
  • Medical evidence from treating physicians if you’re applying based on disability or blindness

Get the shelter-cost sections right. Those numbers drive whether in-kind support reductions apply and at what level, and a wrong figure can mean a lower monthly payment until the next redetermination catches it.

After the county receives your paperwork, an eligibility worker is assigned and schedules a mandatory interview, usually by phone or in person. Once the review is complete, you receive a Notice of Action stating whether you’re approved or denied, the start date and monthly amount if approved, or the specific reason for denial and how to appeal.1California Department of Social Services. Keeping Your Benefits: Reporting and Redetermination

You must report any change in your circumstances to the county within 10 days.1California Department of Social Services. Cash Assistance Program for Immigrants Reportable changes include:

  • Starting or losing a job, a lump sum like an inheritance or legal settlement, or changes in pension or support payments
  • Opening or closing bank accounts, buying or selling property, or receiving a gift of significant value
  • Moving, someone joining or leaving your household, or changes in who pays your rent or food costs
  • Becoming eligible for SSI, obtaining citizenship, or any other change in your documented immigration status

The county also runs a full redetermination every 12 months, when you’ll provide updated bank statements and other documentation confirming you still meet all requirements. Missing the 10-day window or the annual redetermination can produce overpayments that the state recovers by reducing future benefits until the debt is repaid. Intentional failure to report changes that raise your income or resources can trigger fraud penalties on top of repayment.

Appealing a Denial or Reduction

If your application is denied or your benefits are reduced, the Notice of Action must explain the reason and tell you how to challenge it. You have 90 days from the date on the notice to request a state hearing.10California Department of Social Services. State Hearing Requests After 90 days, you can still request one, but you’ll need to show good cause for the delay.

A state hearing is an administrative proceeding before a hearing officer from the California Department of Social Services. You can represent yourself or bring someone to help, submit documents, call witnesses, and question the county’s evidence. If you request a hearing before the effective date of a benefit reduction, your benefits may continue at the existing level until the hearing is decided, which is a strong reason not to wait. Submit the request online through the CDSS website, by phone to the state hearing line, by fax, or by mail. Hearings are typically conducted by phone, though in-person hearings are available. If you disagree with the written decision, you can seek judicial review in state court.

What CAPI Doesn’t Do

CAPI is a bridge, not a permanent parallel program. If your immigration status changes and you become eligible for federal SSI, the switch is mandatory — you cannot stay on CAPI instead. Section 18938 requires periodic redetermination, and part of that process is checking whether you now qualify for SSI/SSP. If you do, CAPI requires a repayment agreement for any interim assistance that overlaps with retroactive SSI payments.2California Legislative Information. CAPI payments are not taxable income. Like SSI, they are need-based assistance rather than earned income, and receiving CAPI does not generate a Form 1099 from the state.
