Capital Health Settlement: Eligibility, Payouts, and Timing

The Capital Health settlement is a $4.5 million class action resolution of claims arising from the November 2023 ransomware attack on Capital Health Systems, Inc. Eligible class members can receive up to $5,000 in reimbursement for documented losses, an estimated $100 flat cash payment, or three years of credit monitoring. The claim filing window has closed, and payments depend on final court approval scheduled for July 14, 2026.¹

Who the Settlement Covers

The settlement covers roughly 503,071 people whose information was exposed when an unauthorized party accessed Capital Health’s network between November 11 and November 26, 2023.² Compromised data potentially included names, addresses, dates of birth, Social Security numbers, email addresses, telephone numbers, and clinical information belonging to patients, former patients, guarantors, and employees.³

The consolidated case, Bruce Graycar, et al. v. Capital Health Systems, Inc., is pending in the U.S. District Court for the District of New Jersey. Capital Health denies any liability, fault, or wrongdoing and agreed to the settlement to resolve the litigation.²

What Class Members Can Receive

The settlement fund offers three benefit options. A class member can pick only the option that applies to their situation.

Reimbursement of up to $5,000 for out-of-pocket losses fairly traceable to the breach. Covered expenses include costs from identity theft or fraud, credit monitoring services purchased after November 11, 2023, expenses from falsified tax returns, credit report fees, and miscellaneous costs such as notary and postage fees. Documentation is required.¹
An estimated $100 flat cash payment for class members who do not submit documented losses. If someone files under the documented-loss category but cannot provide adequate documentation, the claim is processed as a flat payment instead.¹
Three years of credit monitoring services, valued at $90 per year.²

All payment amounts are subject to pro rata adjustment. The final per-person figure depends on how many valid claims were filed and how much of the fund remains after administrative costs and attorney fees.¹

Deadlines Have Passed

The claim filing deadline was April 6, 2026. The deadline to opt out or exclude yourself was March 9, 2026, and the objection deadline was April 3, 2026.¹ No new claims can be submitted. If you did not file, you cannot receive a payment, but you also remain bound by the settlement’s release of claims unless you opted out within the exclusion window.

When Payments Will Be Sent

The final approval hearing is set for July 14, 2026, at 11:00 a.m. Eastern before Magistrate Judge Justin T. Quinn at the U.S. District Court for the District of New Jersey.¹ Benefits will not be distributed until the court grants final approval and the settlement becomes legally final. Appeals, if any, can push distribution further out.
