Capri Sun False Advertising Lawsuits: 100% Juice, PFAS, All Natural

Capri Sun lawsuits have mostly been consumer class actions accusing Kraft Heinz of falsely marketing the pouches as “All Natural” or “100% Juice” when they contain manufactured citric acid, along with a separate case alleging PFAS “forever chemicals” in the Strawberry Kiwi flavor. Several of these suits have been dismissed or voluntarily dropped. As of mid-2026, one “100% Juice” case filed in August 2025 and the PFAS case are still pending, and no settlement fund or claims process exists.

Why Citric Acid Keeps Showing Up in These Cases

Nearly every false advertising suit against Capri Sun turns on one ingredient. Citric acid occurs naturally in citrus, but roughly 99% of the world’s supply is produced industrially by fermenting carbohydrates (often molasses) with the fungus Aspergillus niger, then recovering the acid using lime and sulfuric acid. Plaintiffs argue this manufactured version is synthetic, citing a USDA technical evaluation that classifies it that way, and two 2001 FDA warning letters (to Hirzel Canning and Oak Tree Dairy Farm) stating that products with manufactured citric acid cannot be labeled “All Natural” or “100% Natural.”1LawInc. The Active “100% Juice” Case: Danzy v. Kraft Heinz

The current live consumer case was filed August 11, 2025. In Danzy v. The Kraft Heinz Company, plaintiff Tyisha Danzy alleges that Capri Sun 100% Juice Fruit Punch is falsely advertised because it contains synthetic citric acid functioning as a preservative. The case was filed in the U.S. District Court for the Northern District of California, case number 4:25-cv-06792, by the firm Bursor & Fisher. It alleges violations of California’s Consumers Legal Remedies Act, Unfair Competition Law, and False Advertising Law, plus breach of express warranty, and argues the product is misbranded under FDA regulations and California’s Sherman Law because the label does not disclose citric acid’s preservative function. Danzy is seeking certification of a nationwide class and a California subclass, along with compensatory, statutory, and punitive damages. The case remains pending as of mid-2026.3Top Class Actions. The PFAS Case: Toribio v. Kraft Heinz

Kraft Heinz is also defending a separate class action over alleged chemical contamination. Filed in November 2022 in the U.S. District Court for the Northern District of Illinois, Toribio et al. v. The Kraft Heinz Co. alleges that Capri Sun Strawberry Kiwi drinks, marketed as “all natural,” contain per- and polyfluoroalkyl substances known as “forever chemicals.”4Truth in Advertising. The “All Natural” Cases That Have Been Dismissed

Four earlier suits attacked the “All Natural” label, and all four are now closed:

Osborne v. Kraft Foods Group was filed in June 2015 in the Northern District of California. It challenged several Capri Sun 100% Juice flavors marketed as “All Natural.”6Truth in Advertising. Forbes v. Kraft Heinz Foods Company, filed in New York in January 2023, focused on Capri Sun apple juice. It brought claims under the Magnuson-Moss Warranty Act and New York General Business Law, arguing the manufactured citric acid was an artificial preservative and that labeling it “for tartness” obscured its actual function.8ClassAction.org. Flexer v. Kraft Heinz, case number 1:25-cv-00414 in the Eastern District of New York, was filed in January 2025 and voluntarily dismissed on May 23, 2025.10Bloomberg Law. A Related Ruling That Could Help Future Plaintiffs

In late 2024, a federal judge in the Northern District of Illinois denied Kraft Heinz’s motion to dismiss Hayes v. Kraft Heinz Co., a suit challenging the “No Artificial Flavors, Preservatives, or Dyes” label on Kraft Mac & Cheese, which contains the same manufactured citric acid. The court found the plaintiffs had sufficiently alleged the citric acid was artificial, crediting scholarly articles and FDA guidance classifying citric acid as a preservative. The judge distinguished the case from Valencia v. Snapple Beverage Corp., noting these plaintiffs had explained how artificial citric acid is chemically different from the natural version in fruit. The 2022 Cleaning-Solution Recall (Not a Lawsuit)

You may remember Capri Sun being in the news for a contamination episode. In August 2022, Kraft Heinz voluntarily recalled about 5,760 cases of Capri Sun Wild Cherry Flavored Juice Drink Blend after a diluted cleaning solution used on food processing equipment was accidentally introduced into a production line.13Kraft Heinz Company. Can You Join or File a Claim Right Now?

No. None of the Capri Sun false advertising lawsuits has produced a settlement fund or a claims process to submit a receipt or purchase record against. The Danzy “100% Juice” case in the Northern District of California is still seeking class certification.3Top Class Actions.
