Casey Anthony’s brother is Lee Anthony, her older sibling who became one of the most watched witnesses in the 2011 Florida murder trial over the death of his two-year-old niece, Caylee. He testified for both sides, was accused by the defense of sexually abusing Casey as a teenager, and was ruled out by DNA as Caylee’s biological father. He has since married, had a son, and cut off contact with Casey.
What Lee Testified to for the Prosecution
Lee took the stand for the state in June 2011. He told jurors that on July 3, 2008, he contacted Casey about Caylee and was told the child was “being watched while she was out with a friend.” On July 15, he went to the family home and encountered the white Pontiac Sunfire Casey had been driving, a car he had previously owned himself. He described the odor from the vehicle as “very potent, very strong” and “offensive.”1Newsweek. Casey Anthony Brother Lee Testimony Murder Trial
He also recounted asking Casey why she would not let their mother see Caylee. Casey answered, “Because maybe I’m a spiteful bitch,” and insisted the child was with a nanny whose sleep schedule she did not want to disrupt. Eventually Casey told him she had not seen her daughter in 31 days and that Caylee had been kidnapped.1Newsweek. His Emotional Return for the Defense
Lee was recalled by the defense on June 24, 2011, and his demeanor was strikingly different. Visibly emotional, he testified that no one in the Anthony family had acknowledged Casey’s pregnancy until days before she gave birth in August 2005, even though she had been visibly pregnant by her seventh month. He said he once pressed his mother, Cindy, about it and was told to “let it go.” He did not visit Casey or the newborn at the hospital. “I was very angry at my mom and I was also angry at my sister,” he said. “They didn’t want to include me and didn’t find it important enough to tell me.”3Christian Science Monitor. Casey Anthony Trial: Why Emotional Day Could Bolster Defense
Prosecutors pointed out that in a 2009 deposition Lee had described his parents as being “over the top” about the pregnancy, with a nursery prepared and a baby shower held, which conflicted with his trial account of a family in denial.4ABC News. On cross-examination, it emerged that Lee had met privately with defense attorney Jose Baez between his two courtroom appearances, after declining to meet with prosecutors. Lee said the meeting concerned a “separate issue” and denied being coached.4ABC News. Casey Anthony Trial: Lee Anthony, Cindy Anthony Baffle
The Sexual Abuse Allegations
In his May 2011 opening statement, Baez alleged that Lee had attempted to sexually abuse Casey when he was a teenager, and that abuse by both Lee and their father, George, had created a “culture of lying and deceit in the Anthony family home.”5CBS News. Two of Casey’s former boyfriends offered secondhand accounts. At a June 28, 2011 hearing outside the jury’s presence, former fiancé Jesse Grund testified that Casey had told him she once woke to find Lee standing over her, and on another occasion woke to Lee groping her. Another ex-boyfriend, Tony Lazzaro, testified that Casey had told him Lee tried to “feel her up” but did not succeed. Lee was never directly asked on the stand by either side whether he had abused his sister.7ABC News. Casey Anthony Trial: Fiance Says Lee Anthony Groped Sister
The Paternity Test
The defense also raised the question of whether Lee could be Caylee’s biological father. FBI DNA examiner Heather Seubert testified that a paternity test confirmed Lee was not Caylee’s father. A separate test excluded George Anthony as well.8CBS News. Casey Anthony Trial Update: FBI Witness Asked About Caylee Paternity, Duct Tape
Casey’s 2022 Documentary Claims
More than a decade after the trial, Casey revisited the abuse allegations in the Peacock docuseries Casey Anthony: Where the Truth Lies. She alleged Lee molested her between the ages of 12 and 15, saying, “My brother never raped me, absolutely not, but it was close enough where there was a pattern.”9People.
