Tax Treatment of Your Payment

Payments that reimburse actual financial losses, such as stolen funds or bank fees you paid, are generally not taxable, because they replace money you already lost rather than providing a net gain. Compensation for lost time functions more like income and may be taxable.

If your total payment exceeds the applicable reporting threshold, the settlement administrator may issue a Form 1099-MISC. Even without a 1099, the IRS expects you to report any taxable portion on your return. Keep a copy of your claim form and any payment confirmation in case questions come up at tax time, and consider asking a tax professional how your specific payment should be reported.
