The Cerissa Riley case ended in July 2023 when an Orange County judge dismissed every remaining sexual assault charge against Riley and her boyfriend, Newport Beach orthopedic surgeon Grant Robicheaux, ruling the evidence “lacked competence” and was insufficient to send either defendant to trial. Riley was a 31-year-old teacher living in Orange County when she was arrested in September 2018. She was the girlfriend of Robicheaux, a Newport Beach orthopedic surgeon who had appeared on a single 2014 episode of the Bravo reality series Online Dating Rituals of the American Male.1Deadline. The 2018 Arrest and Original Charges
Newport Beach police arrested Riley and Robicheaux on September 12, 2018, with bail set at $100,000 each.26abc. A search of the couple’s home in January 2018 had produced illegal drugs and firearms, and investigators reported finding thousands of photos and videos on Robicheaux’s phone. At a September 2018 news conference, Rackauckas suggested the case could involve hundreds or even more than a thousand additional unidentified victims and played clips from Robicheaux’s Bravo appearance to describe how the couple gained trust.4LA Mag. Why the Case Became Politically Explosive
The charges landed in the middle of a bitter reelection race between Rackauckas and challenger Todd Spitzer, described as longtime antagonists. Spitzer accused Rackauckas of timing the arrests for political gain and, during Riley and Robicheaux’s arraignment, handed reporters copies of a sealed search warrant affidavit that included sensitive material and the unredacted name of one alleged victim.5LA Mag. Spitzer won the November 2018 election. After taking office, he ordered a fresh review of the case after a prosecutor flagged what his office called “serious proof problems.”6Los Angeles Times. A Judge Blocked the Dismissal
Riley’s case did not end there. Orange County Superior Court Judge Gregory Jones denied Spitzer’s motion to dismiss in June 2020, criticizing the DA’s office for what he called a “back room” effort to drop the case without a clear justification and without giving the alleged victims a chance to be heard, which he suggested may have violated California’s Marsy’s Law.9Voice of OC. On August 20, 2020, Jones took the unusual step of removing the Orange County District Attorney’s Office from the case entirely, ruling it would be “impossible for the District Attorney’s Office to prosecute this case in an ethical fashion” after the office itself had described the prosecution as “manufactured.”10ABC7. How the Attorney General Narrowed the Case
State prosecutors conducted their own review. In May 2021, Deputy Attorney General Yvette Martinez moved to dismiss 10 charges involving six of the seven alleged victims while seeking to add four new charges related to the drugging of one alleged victim in 2017.11KTLA. In July 2021, Orange County Superior Court Judge Steve Bromberg approved dismissal of charges tied to those two alleged victims but held off on the rest, citing “too many unanswered questions.” By the time the case reached its evidentiary hearing, only counts involving two alleged victims remained.
The 2023 Dismissal
Over six days in mid-2023, both sides presented evidence before Orange County Superior Court Judge Michael Leversen. On July 7, 2023, Leversen dismissed all remaining sexual assault charges against Riley and Robicheaux, finding the evidence “lacked competence” and was “insufficient to bring Robicheaux or Riley to trial.”13Los Angeles Times. On October 20, 2023, Leversen also dismissed the remaining felony poisoning and phencyclidine-sale charges against both defendants. That ruling left Riley free of every criminal count she had faced since 2018.15ABC7. Where Things Stand for Riley
The criminal case is over, but the consequences continued. As of November 2023, Riley and Robicheaux were living together in an RV in Orange County, reportedly unable to rent an apartment.17ABC7.
