What Prosecutors Say the Evidence Shows
The prosecution’s case pulls from several categories of evidence. DNA consistent with Robinson was found on the rifle’s trigger, a fired cartridge casing, two unfired cartridges, and a towel used to wrap the weapon.7ABC News. One piece of evidence has been muddier. An ATF ballistics report compared a bullet fragment recovered during Kirk’s autopsy to the rifle tied to Robinson and classified the result as “inconclusive.” Prosecutors say that means the fragment was too damaged or too small for a definitive match, not that the rifle was excluded. Forensic experts told reporters that inconclusive results are common in rifle cases because high-velocity rounds deform on impact, and that treating an inconclusive result as exoneration would be “extremely misleading.” The FBI is running a second analysis. The Key Witness: Lance Twiggs
Lance Twiggs, Robinson’s roommate and romantic partner, is expected to be a central prosecution witness. On June 26, 2026, Judge Graf held Deputy Utah County Attorney Christopher Ballard in civil contempt for violating a pretrial publicity order. The dispute grew out of media coverage of the inconclusive ATF ballistics finding, which some outlets framed as exonerating Robinson. Security Failures at UVU
The shooting exposed serious gaps in event security. Only six UVU police officers were on duty for a crowd of 3,000 in an open-air venue. Five to seven private security guards were positioned near Kirk on stage, but the rooftops surrounding the courtyard were not covered.
