Charlie Kirk Shooter Tyler Robinson: Charges, Evidence, Hearing

Tyler Robinson is the 22-year-old Utah man charged with the Charlie Kirk shooting at Utah Valley University on September 10, 2025. Prosecutors in Utah County have filed seven counts against him, including aggravated murder as a capital felony, and are seeking the death penalty. He has not entered a plea, and a preliminary hearing is scheduled for July 6 through 10, 2026.¹²

What Happened at Utah Valley University

Charlie Kirk was speaking in the Sorensen Center courtyard at Utah Valley University in Orem as part of his “American Comeback Tour,” organized through Turning Point USA. He was on stage taking audience questions when a single shot struck him in the neck. He was killed in front of more than 3,000 attendees.³

The shot came from a campus rooftop more than 100 yards away. The weapon was a Mauser model 98 bolt-action rifle chambered in .30-06, a decades-old German military surplus firearm that prosecutors say belonged to Robinson’s grandfather. Because the rifle may have entered the United States before the 1968 Gun Control Act imposed modern serial number requirements, investigators had difficulty tracing its full history.⁴

The campus was evacuated and classes canceled. Two people were briefly detained during the initial response and released after police determined they had no connection to the shooting. The shooter fled on foot into a nearby neighborhood.³⁵

How Robinson Was Identified and Arrested

Investigators recovered the rifle in a wooded area near campus the day after the shooting. Authorities released photographs of a person of interest, and Robinson’s father recognized his son in the images. When confronted, Robinson admitted he was the person in the photos, though he initially threatened suicide rather than surrender.⁵

His father contacted a family friend, a youth pastor and court security officer, who called the U.S. Marshals Service. On the evening of September 11, 2025, Robinson traveled from Washington, Utah, to the Washington County Sheriff’s Office in Hurricane with his father and the family friend. Sheriff Nate Brooksby said deputies kept the environment “gentle” and “inviting” to ensure a peaceful surrender. Robinson was turned over to the FBI the following morning.⁶⁵

Before surrendering, Robinson posted a confession in a Discord chat: “Hey guys, I have bad news for you all. It was me at [Utah Valley University] yesterday. im sorry for all of this.” Officials described his demeanor at surrender as “quiet and somber.”⁷⁶

Who Tyler Robinson Is

Robinson grew up in a Utah suburb. He briefly attended Utah State University before dropping out and was in an electrical apprenticeship program at the time of the shooting. He lived with his romantic partner, Lance Twiggs, whom he called “Luna.” Officials described Twiggs as a biological male who was transitioning. Co-workers reportedly said Robinson would “detach” and walk away when politics came up.⁸⁹

According to his mother, Robinson had over the preceding year become “more political and left-wing” and “more pro-gay and trans-rights oriented.” In messages to Twiggs, he wrote: “I had enough of his hatred. Some hate can’t be negotiated out.” He told his parents “there is too much evil and the guy spreads too much hate.” FBI Co-Deputy Director Dan Bongino said Robinson’s digital footprint showed an “obsession” with Kirk. Robinson reportedly told Twiggs he had been planning the attack for “a little over a week.”¹⁰⁹

The Letter to “Luna”

On the morning of the shooting, Robinson texted Twiggs: “drop what you are doing, look under my keyboard.” Beneath the keyboard was a handwritten letter that read, in part: “I left the house this morning on a mission, and set an auto text. I am likely dead, or facing a lengthy prison sentence. I had the opportunity to take out Charlie Kirk, and I took it. I don’t know if I will/have succeeded, but I had hoped to make it home to you. I wish we could have lived in a world where this did not feel necessary.”¹¹

During the manhunt, Robinson also texted Twiggs: “I have no intention of being drug through the courts in front of the country.” He urged Twiggs to “delete this exchange” and told him not to speak with media or police. Those instructions became the basis for two witness tampering charges.¹²¹³

The Shell Casing Inscriptions

Investigators recovered at least four shell casings from the rooftop position, each bearing inscriptions. One read “Hey fascist! Catch!” followed by directional arrow symbols, a reference to a controller input from the video game Helldivers 2 used to call in an airstrike. Another read “Oh bella ciao, bella ciao, bella ciao ciao ciao,” lyrics from an Italian anti-fascist song. A third referenced furry fandom culture. A fourth read “If you read this, you are gay LMAO.” Robinson told Twiggs the engravings were “mostly a big meme.”¹⁴¹⁵

Governor Spencer Cox said the “Hey fascist, catch!” inscription “speaks for itself.” Media experts described the engravings as the work of someone “extremely online,” designed less to convey a coherent ideology than to troll investigators.¹⁴

The Seven Charges

On September 16, 2025, Utah County Attorney Jeff Gray filed seven charges in Utah’s Fourth Judicial District Court:

Aggravated murder, a capital felony carrying a potential death sentence, mandatory life without parole, or an indeterminate term of not less than 25 years to life.
Felony discharge of a firearm causing serious bodily injury, a first-degree felony.
Two counts of obstruction of justice, second-degree felonies related to alleged efforts to conceal evidence.
Two counts of witness tampering, third-degree felonies based on Robinson’s alleged instructions to Twiggs to delete messages and refuse to speak to police.
Violent offense committed in the presence of a child, a Class A misdemeanor.

The aggravated murder, felony firearm, and child-presence counts include a victim-targeting enhancement under Utah law, alleging Robinson intentionally selected Kirk because of Kirk’s political expression.¹

Gray said the decision to seek the death penalty was made “independently” based on the evidence and circumstances, and that he was not pressured by the Trump or Cox administrations. “The murder of Charlie Kirk is an American tragedy,” he said. “Charlie Kirk was murdered while engaging in one of our most sacred and cherished American rights.”¹⁶

The Evidence Against Him

Prosecutors have identified Robinson’s DNA on the rifle’s trigger, on other parts of the rifle, on the fired cartridge casing, on two of three unfired cartridges, and on a towel used to wrap the rifle. DNA was also recovered from a screwdriver found on the rooftop where the fatal shot was fired.¹⁷

The ballistic evidence is more contested. An ATF analysis comparing a bullet jacket fragment recovered during Kirk’s autopsy to the rifle returned an “inconclusive” result. Prosecutors have stressed that inconclusive does not mean the rifle did not fire the bullet, and that there may simply not have been enough marks on the fragment for a definitive match. The defense has noted that DNA from “multiple people” was found on some evidence items. The FBI has been conducting additional comparative bullet and bullet lead analyses.¹⁸¹⁹

Beyond forensics, prosecutors plan to rely on Robinson’s text messages and handwritten letter, surveillance footage placing him near the scene, and a travel timeline from southern Utah. They have been granted limited “use immunity” for Twiggs in exchange for a sworn recorded statement. According to prosecutors, Twiggs told investigators that Robinson confessed to the murder, hid the rifle, and disposed of his own clothing.²⁰

Where the Case Stands

Defense Team

Kathryn Nester was appointed lead defense counsel at a September 29, 2025, hearing, where Judge Tony Graf confirmed the team met the qualifications required for a capital case. Robinson’s full defense team also includes Michael Burt, Richard Novak, and Staci Visser.²¹

The defense moved to disqualify the entire Utah County Attorney’s Office, arguing a conflict of interest because Deputy County Attorney Chad Grunander’s close family member was at the shooting and had texted him from the event. After hearings in January and February 2026, Judge Graf rejected the motion, concluding there was “not a significant risk” that Grunander’s familial connection would influence the office’s work or its decision to seek the death penalty.²²

Cameras in the Courtroom

In March 2026, the defense moved to bar all media from the courtroom, arguing coverage was creating bias. The motion cited a December 2025 incident in which a videographer captured images of Robinson in shackles and audio of privileged attorney-client conversations, and a January 2026 incident involving unauthorized close-up images of the defendant.²³

At an April 17, 2026, evidentiary hearing, the defense presented survey evidence from trial consultant Dr. Bryan Edelman, who had worked on the Bryan Kohberger case. His survey of Utah County registered voters found 99% familiar with the case, 64% believing Robinson was guilty based on news coverage, and more than 50% saying the defendant would have a “hard time convincing them” of his innocence.²⁴

On May 8, 2026, Judge Graf denied the blanket media ban, ruling the public and media “have a right to criminal proceedings” and that livestreaming “maximizes the public’s access to court proceedings.” Media organizations must request camera access at least 14 days before a hearing, and either side may still seek closure of specific hearings. On June 1, 2026, Graf also rejected a defense motion to close the upcoming preliminary hearing.²⁵²⁶

Prosecutor Held in Contempt

After the inconclusive ATF bullet analysis was reported, Deputy Utah County Attorney Christopher Ballard spoke to TMZ, Fox News, and USA Today. Judge Graf found that while Ballard could correct specific factual errors, he crossed the line by commenting on the strength of the prosecution’s case, telling a TMZ reporter that prosecutors had “ample evidence” and would “overcome Robinson’s presumption of innocence.”²⁷

On June 26, 2026, Graf held Ballard in civil contempt, finding the statements had a “substantial likelihood of materially prejudicing the proceedings.” The defense asked the court to strike the death penalty as a sanction. Graf rejected that request, calling it “grossly disproportionate” and “an improper judicial intrusion into the executive branch’s prosecutorial discretion.” Instead, he ordered the prosecution to pay defense legal fees related to the contempt motion and directed an expansion of jury selection procedures, including additional juror questionnaires.²⁸

Preliminary Hearing

Robinson remains in custody and has not entered a plea. The preliminary hearing, described as a “mini-trial” to determine whether sufficient evidence exists to proceed to a full trial, is scheduled for July 6 through 10, 2026. Judge Graf has ruled that prosecutors may present hearsay evidence at this hearing and that it will be open to the public and media. The defense has sought to halt proceedings while it appeals the camera-access ruling. No trial date has been set.²⁹²

Federal Investigation

The state case is not the only track. A parallel federal investigation has been underway since shortly after the shooting, but as of mid-2026 no federal charges have been filed. The Department of Justice has been exploring a “novel legal theory” that would classify the killing as an anti-Christian hate crime. Career prosecutors have reportedly pushed back, arguing the crime does not clearly fit existing federal statutes: Robinson did not cross state lines, and Kirk was not a federal official. Sources described the effort as “trying to shove a square peg into a round hole.”³⁰

The FBI has separately investigated Robinson’s online associates. Director Kash Patel said the bureau is “investigating anyone and everyone involved in that Discord chat” where Robinson confessed before his arrest, and that the number of people being pursued was “a lot more” than the roughly 20 members initially reported. Discord conducted its own internal review and found “no evidence that the suspect planned this incident or promoted violence on Discord.”⁷³¹
