Chevy Lemon Lawsuit: Defects, Class Actions, and Recovery

If your Chevrolet has a defect the dealer cannot fix, a Chevy lemon lawsuit can force General Motors to buy the vehicle back, replace it, or pay you cash while you keep it. Every state has its own lemon law, the federal Magnuson-Moss Warranty Act adds a second track, and several active class actions may already cover your specific model and defect. Between 2018 and 2021, GM was named in roughly 9,800 lemon law suits in California alone, nearly one in three filings in the state.1Local News Matters. When a Chevy Qualifies as a Lemon

The core test is the same in every state. Your vehicle has a substantial defect that significantly impairs its safety, use, or value; the defect arose while the manufacturer’s warranty was in effect; and the dealer has had a reasonable number of chances to fix it and failed.2Florida Attorney General. What counts as “reasonable” varies. Common thresholds are three or four attempts for the same defect, one or two attempts for a safety-critical issue, or 30 cumulative days out of service.3EasyLemon. Chevrolet’s warranty sets your eligibility window: 3 years or 36,000 miles bumper-to-bumper, and 5 years or 60,000 miles for the powertrain.5Kelley Blue Book. Vehicle Lemon Laws by State Defects you reported and had documented inside those windows are the foundation of a claim.

State coverage of used vehicles differs sharply. New Jersey protects used vehicles purchased from licensed dealers that are no more than seven years old, have under 100,000 miles, and cost at least $3,000. Texas may cover used vehicles still under the original warranty.5Kelley Blue Book. The Defects That Drive Chevy Claims

Transmission problems are the single most common category. Owners of vehicles with GM’s 6-speed, 8-speed, and 9-speed automatic transmissions report shuddering, hard shifting, delayed engagement, jerking, and complete transmission failure. Engine defects come next: excessive oil consumption, stalling, misfires, and sudden power loss. Certain models show up over and over. The Silverado, particularly 2015–2019 models with 8-speed transmissions and newer models with the 6.2L V8. The Equinox, especially with the 2.4L Ecotec and 1.5L turbocharged engines, where excessive oil consumption can require adding a quart every 1,000 miles alongside timing chain failures and stalling.7The Lemon Firm. How to File Against GM

The steps are predictable, and skipping any of them can sink an otherwise strong claim.

  • Document every repair. Take the vehicle to an authorized Chevrolet dealer and keep every work order, invoice, and piece of written correspondence. Dates, symptoms, and outcomes matter.
  • Give the dealer the required number of attempts under your state’s law before declaring the vehicle a lemon.
  • Send written notice, often by certified mail, telling GM the defect remains unresolved and that you want a repurchase or replacement. Georgia uses a standardized “Final Repair Opportunity Notice” form.4Georgia Consumer Protection Division. Lemon Law Process
  • Complete arbitration if your state requires it. GM uses BBB AUTO LINE for warranty and lemon law disputes; the program is free and nationwide. What You Can Recover

Chevy lemon claims typically resolve one of three ways.

A buyback means GM repurchases the vehicle. The refund covers your down payment, monthly loan or lease payments, sales tax, registration and title fees, finance charges, and incidental costs like towing or rental cars, reduced by a mileage offset for use before the first repair attempt. Buyback values typically run from $20,000 to more than $60,000 depending on purchase price.3EasyLemon. GM Lemon Law Settlements

A replacement means GM gives you a new or comparable vehicle. A cash-and-keep settlement, used when you want to keep the car despite the problems, typically ranges from $5,000 to $25,000 for diminished value and inconvenience. You generally won’t pay your attorney out of pocket. State and federal lemon laws require the manufacturer to pay the prevailing consumer’s reasonable legal costs, and most lemon law attorneys work on contingency, with the fee coming from GM rather than from your settlement.10FTC. If your defect is one of the following, joining or waiting on the class action may make more sense than filing an individual lemon claim. Check each case’s model years and covered defect against your own vehicle.

6.2L V8 Engine Failures

In April 2025, GM recalled roughly 598,000 SUVs and pickups equipped with the L87 6.2L V8, including 2021–2024 Silverado 1500, Suburban, and Tahoe models.11Wards Auto. NHTSA Opens Investigation Into GM Engine Failures Prior to Recall Manufacturing defects in the connecting rods and crankshafts can cause sudden total engine failure. GM identified over 28,000 field complaints potentially related to these parts, with more than 14,000 alleging loss of propulsion.12NHTSA. General Motors, LLC, was filed in February 2026 in the Eastern District of Michigan.13Hagens Berman. 8-Speed Transmission Defect

About 800,000 Chevrolet, GMC, and Cadillac vehicles with 8L45 or 8L90 eight-speed automatics were the subject of a long-running class action. In June 2025, the Sixth Circuit decertified the broad class in Speerly et al. v. General Motors LLC, finding too many differences between owners for a single proceeding. Chevrolet Bolt Battery Fires

GM recalled all 2017–2022 Chevrolet Bolt EV and 2022 Bolt EUV vehicles after two manufacturing defects in LG-supplied battery cells created fire risks at high charge levels.17GM. Owners who installed the advanced diagnostic software are eligible for $1,400; those who leased or sold their vehicle before the software was offered can receive $700.19CBS News. Shift to Park Defect

A February 2025 preliminary settlement in Jefferson v. General Motors LLC and related cases covers original purchasers and lessees of 2016–2019 Chevrolet Malibu and Volt, 2018–2019 Chevrolet Traverse, 2019 Chevrolet Blazer, and 2017–2019 GMC Acadia vehicles (GMC coverage is limited to Ohio and Tennessee residents). Eligible members can receive a $500 cash payment and up to $375 in reimbursement for out-of-pocket repair costs.21ClassAction.org. Brake Defect Suits

Two brake actions are pending. Barron et al. v. General Motors LLC, filed October 2025 in the Eastern District of Pennsylvania, alleges defective master brake cylinder assemblies in 2025 Chevrolet Traverse and Colorado, GMC Acadia and Canyon, and Buick Enclave models, causing stiff pedals, pedals sinking to the floor, or total brake failure. Thieme et al. v. General Motors LLC, filed February 2026, targets a vacuum pump defect in 2018–2022 Chevrolet Equinox and GMC Terrain models that allegedly causes loss of power brake function.23ClassAction.org. California Owners: What Changed

California generates more lemon filings than any other state, and its rules moved twice in quick succession. Assembly Bill 1755, signed in 2024, shortened the timeframe for consumers to exercise their rights and shifted more responsibility onto owners to initiate claims.1Local News Matters. Senate Bill 26, signed April 2, 2025, made AB 1755’s procedural framework optional. Manufacturers can opt in for five years or stay under the previous rules. SB 26 also pushed the pre-dispute notice requirement from April 1 to July 1, 2025, and set a legislative review of AB 1755 for 2029.24RVIA. Used-vehicle buyers face the biggest change. After Rodriguez v. FCA, most used-car purchasers can no longer bring Song-Beverly claims and instead need to look to the federal Magnuson-Moss Warranty Act or implied warranty claims under the California Uniform Commercial Code.6The Lemon Firm. The Federal Backup: Magnuson-Moss

When state lemon protections don’t apply, or don’t apply well, the federal Magnuson-Moss Warranty Act is the second track. It covers any consumer product sold with a written warranty and provides remedies including replacement or refund when the manufacturer cannot repair a defect after a reasonable number of attempts.10FTC. Lemon Laws State-Specific Information Winning consumers can recover attorney fees and court costs, and claims can be filed in state or federal court. For federal court jurisdiction, individual claims must involve at least $50,000 in controversy, and class actions require at least 100 named plaintiffs.
