Chris Brown’s Assault on Rihanna: Charges, Sentence, Probation

On February 8, 2009, R&B singer Chris Brown beat his then-girlfriend Rihanna inside a rented Lamborghini on a Los Angeles street, hours before both were scheduled to perform at the Grammy Awards. Brown pleaded guilty to felony assault that June and was sentenced to five years of probation, roughly 1,400 hours of community labor, and a year of domestic violence counseling. He served no prison time for the attack itself, though probation violations later landed him in county jail. The Rihanna Chris Brown assault became one of the most widely discussed domestic violence cases in modern American pop culture, and Brown’s legal record has continued to grow in the years since.

What Happened the Night of the Attack

Brown and Rihanna attended a pre-Grammy gala in Beverly Hills hosted by Clive Davis and the Recording Academy on the evening of February 7, 2009.1Los Angeles Times. Chris Brown Arrested After Alleged Assault At about 12:30 a.m. the next morning, with Brown driving through an upscale neighborhood, the two began arguing. An LAPD affidavit filed by Detective De Shon Andrews said the fight started after Rihanna read a text message on Brown’s phone from a woman he had previously been involved with.2NBC Washington. Brown pulled over on North June Street. According to the affidavit, he tried to force Rihanna out of the car, and when her seatbelt kept her in place, he shoved her head against the passenger window, raising a circular contusion on her forehead. He then punched her repeatedly in the face. Her mouth filled with blood that splattered across her clothing and the car’s interior.2NBC Washington. It got worse. Brown bit her left ear and put her in a headlock, choking her until she started losing consciousness. He threw her phone out of the window so she couldn’t call for help, and at one point told her, “I’m really going to kill you.” Rihanna managed to yank the ignition key away and screamed. A neighbor heard her and called 911. Brown had already left on foot.2NBC Washington. LAPD Detective’s Affidavit Details Alleged Beating by Chris Brown of Rihanna

The Charges and the Guilty Plea

On March 5, 2009, Brown was charged with two felonies: assault and making criminal threats.3People. Under California Penal Code Section 273.5, which covers domestic violence resulting in a traumatic condition, a felony conviction carries a potential sentence of two to four years in state prison.7California Legislative Information. California Penal Code Section 273.5 Brown’s deal of probation and community labor fell well below that ceiling.

The Sentence and Protective Order

Formal sentencing took place on August 25, 2009. Judge Schnegg imposed five years of formal probation and ordered Brown to complete six months of community labor, described as roughly 1,400 hours of physically demanding work such as roadside cleanup, supervised by the Richmond, Virginia, police chief.8Billboard. A protective order required Brown to stay 100 yards from Rihanna, reduced to 10 yards at music industry events. Judge Schnegg warned Brown directly: “I am not amused with the chatter that has been on the airwaves and any violation of your probation in this case comes with the potential for state prison.”8Billboard. Chris Brown Sentenced to Five Years Probation and Community Labor A prosecutor noted that if Brown completed his sentence successfully, the felony could later be reduced to a misdemeanor.

The protective order was modified in February 2011 at Rihanna’s request. Judge Schnegg permitted the two to speak and reduced the distance requirement at industry events, though Brown was still forbidden from harassing or stalking her.10ABC 7. How the Probation Actually Played Out

In February 2013, Los Angeles County District Attorney Jackie Lacey filed a motion alleging Brown had not legitimately completed his community labor. Deputy District Attorney Mary Murray said the investigation found “significant discrepancies indicating at best sloppy documentation and at worst fraudulent reporting.”12Los Angeles Times. Chris Brown Community Service Investigation On one date when records showed him picking up trash in Richmond, prosecutors said Brown was documented boarding a private plane to Cancún.13CBS News. Chris Brown May Have Faked Community Service On another, he was photographed 100 miles away in Washington, D.C., hosting a charity event. Investigators also found Brown had reportedly logged 701 hours in seven months, far faster than his earlier pace, and that his mother may have filled out timesheets instead of a designated supervisor.14BET. Chris Brown Denies Claim He Lied About Community Service Geragos called the motion “frivolous, scurrilous and frankly defamatory.”

In July 2013, Judge James R. Brandlin revoked Brown’s probation after prosecutors alleged he failed to provide license and insurance information following a minor traffic collision.15CNN. Chris Brown Probation Revoked That October, he was arrested in Washington, D.C., for punching a man named Parker Adams outside a hotel after Adams tried to join a photograph Brown was taking with two women. According to a police report, Brown said, “I’m not down with that gay s—. I feel like boxing,” before hitting Adams.16ABC News. Chris Brown Arraigned on Misdemeanor Assault The charge was reduced to misdemeanor assault; Brown pleaded guilty and was sentenced to time served after two days in a D.C. jail. After the D.C. arrest, Judge Brandlin ordered Brown into a residential rehabilitation program for anger management, substance abuse, and issues related to bipolar disorder. Brown was expelled in March 2014 for violating facility rules. On May 9, 2014, Judge Brandlin sentenced him to a year in county jail, credited him with about eight months of time already served in rehab, jail, and good-behavior credits, and left 131 additional days to serve. What Rihanna Said

Brown and Rihanna briefly reconciled in 2012 and 2013. In a 2012 interview with Oprah Winfrey, Rihanna described the aftermath of the assault as “embarrassing” and “humiliating” and said she had lost her “best friend.” She told Winfrey, “I think he was the love of my life, the first love,” and said she was able to forgive him only after repairing her relationship with her own father, who had been abusive during her childhood.21BBC. By 2015 the reconciliation was over. In a Vanity Fair cover story, Rihanna said she had believed “a hundred percent” she could change Brown and had felt like a “guardian angel” strong enough to weather the relationship. “I was very protective of him. I felt that people didn’t understand him,” she said. She came to see that in the dynamic she had become “the enemy,” and that tolerating mistreatment only made him think less of her. “I was stupid thinking I was built for this,” she told the magazine. “Sometimes you just have to walk away.”22Vanity Fair. She also expressed frustration at being labeled a “poster child for victims of domestic abuse,” saying the constant media attention forced her to relive the incident. “I just never understood that, like how the victim gets punished over and over,” she said, while adding that domestic violence is “not a subject to sweep under the rug.”23BBC. The Public Reaction and Victim-Blaming

The case drew heavy criticism of how the public and the press treated Rihanna. A survey of 200 Boston-area teenagers in the immediate aftermath found that 46% believed Rihanna was responsible for the violence, and media reports described high school students suggesting she “must have done something to provoke the assault.”24PMC (National Library of Medicine). A peer-reviewed study in the Journal of Health Communication analyzed 48 articles from seven leading U.S. tabloid magazines between February and April 2009. While 83% of articles made at least a passing reference that abuse is wrong, that was the dominant message in only 40% of them. Victim-blaming appeared in 81% of articles and was the primary frame in 36%. The researchers found that most of the coverage communicated “mixed messages” that minimized the seriousness of partner abuse.24PMC (National Library of Medicine). U.S. Tabloid Magazine Coverage of a Celebrity Dating Abuse Incident Advocacy groups such as the Family Violence Prevention Fund pushed back, emphasizing that “Nobody should blame Rihanna” and that leaving an abusive relationship is often a long process.

What Came After

The 2009 assault was not the end of Brown’s legal history. In the years since, he has been accused in a long series of incidents.

Brown’s most serious pending matter is a criminal case in the United Kingdom.
