There is no active class action or major public lawsuit against Cinch Home Services. Both the warranty and the website terms include a class action waiver. That means you cannot join with other Cinch customers in a class action lawsuit or a consolidated arbitration. Each dispute has to be filed and paid for on its own.
The practical consequences of the clause: no jury, generally no appeal, and each side pays its own attorney. It is also the point at which many disputes actually get resolved, because it forces the file in front of the legal team rather than a call center.
Can the Arbitration Clause Be Challenged?
Sometimes. The New Jersey Supreme Court’s 2019 ruling in Kernahan v. Home Warranty Administrator of Florida, Inc. struck down an arbitration clause in a home service agreement because it was misleadingly placed under a section titled “Mediation” and failed to clearly inform consumers they were waiving their right to sue in court.3Greenbaum Law. Kernahan involved a different company. Cinch’s own arbitration language is more explicit than the clause the New Jersey court invalidated, which makes a challenge on those grounds harder. Enforceability still depends on state law, how conspicuously the clause appears in the contract, and whether the consumer had meaningful notice of it. A lawyer looking at your specific contract version and state is the only way to know whether an argument exists.

Searches of public records turn up almost nothing directly involving Cinch on the consumer side. The one case on file is Cross County Home Services, Inc. v. The allegations against Choice — misrepresenting coverage, denying claims for wear-and-tear issues, and failing to disclose limitations — closely track the complaints consumers file against Cinch. If enough Cinch customers complain to their state attorney general, a similar enforcement action is possible. Nothing like that has been filed against Cinch to date.
What Consumers Are Actually Fighting About

Cinch reserves the right to offer cash instead of a repair or replacement, and buyout amounts are based on the company’s negotiated wholesale costs, which sit below retail. Given the arbitration clause, most consumers have four practical channels.

Based on publicly documented outcomes, the BBB channel has been the fastest way for individual consumers to get money or a claim reversal. Small claims is the strongest option when the number is too large for a goodwill refund but still within the court’s cap. Arbitration is the only mechanism the contract leaves for larger claims, and it is the one Cinch has designed the contract around.
One boundary worth knowing: Florida’s Department of Financial Services warns that if a home warranty company enters receivership, pending claims are not covered by any state guaranty association.10Florida Department of Financial Services.
