What the Lawsuit Alleges
An FDA inspection of the Sanford plant in May 2024 found that water used to rinse equipment and manufacture toothpaste had repeatedly tested positive for bacteria, including Pseudomonas aeruginosa and Ralstonia insidiosa. A third bacterium, Paracoccus yeei, was found in a batch of Wicked Cool! Anticavity Toothpaste. Inspectors also observed a black mold-like substance in multiple areas of the facility and powder residue on equipment used to make Silly Strawberry Anticavity toothpaste. The FDA cited the company for failing to maintain the plant and for not investigating roughly 400 consumer complaints about odor, color, and taste.
