What the Lawsuit Alleged

Named plaintiff Eric Geaslin, a resident of Plantersville, Texas, said he received at least 20 Spanish-language text messages advertising properties for sale, though he is not Hispanic, does not speak Spanish, and had no relationship with the company. He had registered his cellphone number on the National Do Not Call Registry in December 2019, more than 30 days before the texts began arriving in late 2022.5Communications Litigation Today. How the Fund Is Divided

Several deductions come off the top of the $1,994,123 fund before claimants are paid:

  • Attorneys’ fees for class counsel Pardell, Kruzyk & Giribaldo, PLLC of up to $664,707.66, roughly one-third of the settlement.
  • Litigation costs of up to $8,000.
  • A service award of up to $12,000 to Geaslin.
  • Administrative expenses of up to $48,925.

What remains is divided equally among eligible claimants on a pro rata basis.4ClassAction.org. Geaslin v. Why Payouts Ended Up Near $3,787

Original estimates put individual recoveries at $1,000 to $2,000. The actual figure came in far higher because only 333 people filed valid claims out of a potential class of tens of thousands. That participation rate, under 1%, concentrated the remaining fund among a small group of claimants.1TCPA World. Low claims rates are common in consumer class actions. One claims-tracking service estimates that 96% of settlement funds typically go unclaimed, though the gap in this case was particularly stark.2Claim Depot. Colony Ridge TCPA Settlement

A Separate Colony Ridge Settlement Is Not This One

Colony Ridge is also the subject of a $68 million federal and state settlement announced on February 10, 2026, resolving predatory lending claims brought by the U.S. Department of Justice, the Consumer Financial Protection Bureau, and the Texas Attorney General. That deal covers different conduct — allegations of deceptive advertising, misrepresented flood risks, and loans issued without assessing borrowers’ ability to repay — and requires infrastructure spending and a three-year freeze on new residential plats for direct-to-consumer sales, but no direct compensation to borrowers.7U.S. Department of Justice.
