Colorado DMV Reinstatement: Requirements, Fees, and Interlock Rules

To meet the Colorado DMV’s reinstatement requirements, you need to finish serving your suspension or revocation period, file an Application for Reinstatement (Form DR 2870), pay a $95 reinstatement fee, and submit whatever additional proof your specific offense demands — most commonly SR-22 insurance, an alcohol education certificate, or an ignition interlock lease.1Department of Revenue – Motor Vehicle. Process to Reinstate Driving Privilege The extras are what trip most people up, because they change based on why your license was taken in the first place.

The Core Requirements Every Driver Must Meet

Three things apply to every reinstatement, no matter the reason.

First, your waiting period has to be complete. The clock starts on the date the restraint took effect, not the date of your arrest or citation. If more than one restraint sits on your record, every single one has to be resolved before the DMV will restore your privilege.2Department of Revenue – Motor Vehicle. Reinstatements

Second, you file Form DR 2870. The application asks for your full legal name, date of birth, Colorado license or ID number, and current mailing address.3Colorado Department of Revenue. Application for Reinstatement DR 2870

Third, you pay the $95 reinstatement fee. If your suspension or revocation involved a DUI or DWAI, add a $25 DUI/DWAI restoration fee for a total of $120.4Department of Revenue – Motor Vehicle. State DMV Fees These fees are non-refundable, so line up every other requirement before you pay.

Everything else depends on why you lost your license.

What You Need Based on Why You Lost Your License

Point Suspensions

If you were suspended for accumulating too many points under the standard point system, reinstatement is fairly light. Serve the suspension period the DMV set for you, show evidence of current liability insurance in your name, and pay the $95 fee. You do not need an SR-22 for a point-only suspension.5FindLaw. Colorado Code 42-7-406 – Proof Required Under Certain Conditions

Colorado’s point thresholds vary by age and license type: 12 points in 12 months or 18 in 24 months for adult drivers, lower numbers for drivers under 21, and separate limits for professional chauffeurs.6Justia. DUI, DUI Per Se, and Refusal Revocations

Alcohol-related revocations run longest and carry the most reinstatement conditions. Revocation periods are 9 months for a first DUI or DUI per se, 12 months for a second, and 24 months for a third. Chemical test refusals draw 12, 24, and 36 months for first, second, and third refusals.7Colorado Department of Transportation. How to Get Your License Back After a DUI

To reinstate after any of these, you’ll need:

  • Proof of financial responsibility filed by your insurer, commonly called an SR-22. If you letting it lapse even for a day can restart your suspension. If you reinstate with an interlock-restricted license, the SR-22 must stay in place for three years or the full length of the interlock restriction, whichever is longer.5FindLaw. • Proof of enrollment in or completion of a court-ordered alcohol and drug program. The most common assignment is a Level II Alcohol and Drug Education and Therapy course, which can run up to 13 months. The provider must be state-licensed.7Colorado Department of Transportation. • An Ignition Interlock Agreement Affidavit if you fall into a category that requires one (see the interlock section below).
  • The $95 fee plus the $25 DUI/DWAI restoration fee.4Department of Revenue – Motor Vehicle. State DMV Fees

If your revocation runs longer than one year, you may qualify to reinstate early with an interlock-restricted license after serving one year of the revocation.8Colorado Secretary of State. Rule 11 Interlock-Restricted Licenses For a first-time DUI with a 9-month revocation, the rules are more forgiving: you can apply for an interlock-restricted license at any point during the revocation.9Justia. Driving Without Insurance

An insurance lapse triggers its own suspension separate from any traffic offense. A second insurance suspension lasts four months and a third or later lasts eight months. You cannot get a restricted driving privilege during an insurance-based suspension, and reinstatement requires SR-22 insurance.10Colorado Department of Revenue. Auto Insurance

Unpaid Tickets or Child Support Holds

These are the simplest to clear. Pay off the underlying obligation or get compliance documentation from the issuing court or child support agency, then pay the $95 reinstatement fee.11Department of Revenue – Motor Vehicle. Process to Reinstate Driving Privilege – Section: In Person (Limited)

Habitual Traffic Offender Revocation

Colorado designates you a habitual traffic offender for three or more serious moving violations within seven years, 10 or more four-point violations in five years, or 18 or more lesser violations in five years.12Justia. Colorado Code 42-2-202 – Habitual Offender This revocation stacks on top of any other restraints already on your record. If DUI convictions contributed to the habitual designation, you’ll also owe an interlock period after reinstatement.9Justia. Ignition Interlock Requirements

Colorado requires an interlock-restricted license for certain alcohol-related offenders, and the length of the restriction is set by statute:9Justia. Colorado Code 42-2-132.5 – Mandatory and Voluntary Restricted Licenses Following Alcohol Convictions

  • Drivers with a BAC of 0.15 or above or a persistent drunk driver designation: at least one year with the interlock after reinstatement. Persistent drunk drivers must hold the interlock-restricted license for at least two years.
  • Drivers with multiple DUI, DUI per se, or DWAI convictions: at least two years and up to five.
  • Habitual offenders whose designation involved DUI: at least one year.

Your Ignition Interlock Agreement Affidavit has to confirm you’ve signed a lease agreement, cover every vehicle registered in your name and any other vehicle you might drive, and include written consent from any co-owners.13Department of Revenue – Motor Vehicle. Rule 11 Interlock-Restricted Licenses Installation and calibration have to go through a state-approved vendor. Monthly lease and monitoring costs run around $100, though vendors set their own pricing.

Tampering with or circumventing the device carries its own revocation and resets the clock on your restriction period.9Justia. Colorado Code 42-2-132.5 – Mandatory and Voluntary Restricted Licenses Following Alcohol Convictions

How to File

Three channels are available, and the one you use depends on your offense type.

The myDMV online portal is the fastest for most people and the required channel for DUI-related reinstatements. You can check your eligibility date, view your specific requirements, upload documents, and pay electronically.1Department of Revenue – Motor Vehicle. Process to Reinstate Driving Privilege

By mail, you send Form DR 2870, all supporting documents, and a check or money order for $95 (plus $25 if DUI-related) to the address on the form. Allow up to 20 business days for processing.14Department of Revenue – Motor Vehicle. Process to Reinstate Driving Privilege – Section: By Mail

In-person reinstatement at a Full Service Driver License Office is limited to a narrow set of suspension types: unpaid tickets, child support holds, and point suspensions. Alcohol-related suspensions cannot be reinstated at the counter.11Department of Revenue – Motor Vehicle. Process to Reinstate Driving Privilege – Section: In Person (Limited)

Once the DMV verifies everything, it mails a letter of clearance to the address on your application confirming your driving privilege has been restored.1Department of Revenue – Motor Vehicle. Don’t Drive Before You’re Cleared

Driving under restraint carries penalties that scale with what got you suspended in the first place. If the underlying suspension was non-alcohol, driving under restraint is a class A traffic infraction, and a second offense within five years bars you from any license for three additional years. If the underlying revocation was alcohol-related, driving under restraint is a class 2 misdemeanor traffic offense with mandatory jail of 10 to 90 days and fines of $150 to $300, rising to $500 to $3,000 on a repeat within five years, plus up to four more years of ineligibility.15Justia. Two Situations Where Colorado Reinstatement Isn’t Enough

If you move to another state while your Colorado license is suspended, the new state will find the hold and route the inquiry back to Colorado. You have to clear the Colorado restraint before another state will issue you a license.16The Council of State Governments National Center for Interstate Compacts. Driver License Compact

Commercial driver’s license holders face federal disqualification periods that run independently of Colorado reinstatement. A first alcohol-related offense in a commercial vehicle brings a minimum one-year CDL disqualification; a second is a lifetime disqualification, reducible to no less than 10 years under federal regulation.17Office of the Law Revision Counsel. 49 USC 31310 – Disqualifications Clearing your Colorado requirements does not automatically restore CDL privileges.
