Colorado Handicap Parking Laws: Permits, Fines, and Fraud

Colorado handicap parking laws are set by the state’s Department of Revenue and the Division of Motor Vehicles. To use an accessible space, you need a blue placard or disability license plate issued after a healthcare professional certifies a qualifying condition. Parking in a reserved accessible space without one is a Class A traffic infraction carrying a $350 to $1,000 fine on a first offense, and penalties climb from there. A third violation is a misdemeanor.

Who Qualifies for a Placard or Plate

Colorado recognizes six categories of qualifying disability. You need to fall into at least one:

  • You cannot walk 200 feet without stopping to rest.
  • You cannot walk without a brace, cane, crutch, prosthetic device, wheelchair, or help from another person.
  • Lung disease limits your forced expiratory volume to less than one liter per second, or your arterial oxygen tension is below 60 mm/hg on room air at rest.
  • You use portable oxygen.
  • You have a heart condition classified as Class III or IV severity under American Heart Association standards.
  • An arthritic, neurological, or orthopedic condition severely limits your ability to walk.

How to Apply and What It Costs

Applications go through the Colorado DMV. Download the DR 2219 form or pick one up at a local office, have a medical professional complete the certification section, and submit it at the time of registration.2Colorado Department of Revenue. DR 2219 Parking Privileges Application

Once approved, you pick from three options:

  • Two sets of disability license plates, with standard registration fees and ownership taxes.
  • One set of plates plus one permanent blue placard. You pay the plate fees; the placard is free.
  • Up to two permanent blue placards and no plates, at no charge.

Temporary Placards

If your disability is short-term, say recovery from surgery or a broken leg, you can get up to two 90-day placards at no cost. Your medical professional authorizes the duration, and you can renew if the condition persists.2Colorado Department of Revenue. Renewing a Permanent Placard

Permanent blue placards must be recertified every three years. A medical professional has to verify your condition at the initial application and again at the ninth year (your third renewal). At the three-year and six-year renewals, you can renew by mail with a signed DR 2219 or in person with valid identification, without a new medical evaluation.2Colorado Department of Revenue. Using the Placard Correctly

A disability placard or plate belongs to the person it was issued to, not to a vehicle. You may only use it when you are the driver, or when you are the passenger being dropped off or picked up at that location. Lending your placard to someone who does not qualify can lead to fines and revocation of the permit.

Displaying It

When you park in a reserved accessible space, the placard must be clearly visible: hanging from the rearview mirror, or placed on the dashboard so the identifying number can be read through the windshield. If Your Placard Is Lost or Stolen

Blue Placards Do Not Waive Meter Fees

A standard blue placard does not let you park free at meters. Colorado offers a separate purple placard, the Remuneration-Exempt Disability Parking Placard, that does. You qualify for the purple placard if your disability limits fine motor control in both hands, prevents you from reaching a height of 48 inches from the ground, or prevents you from physically accessing a parking meter due to wheelchair use.4Department of Revenue – Motor Vehicle. Fines for Parking Without a Permit

Colorado’s penalties escalate sharply with repeat offenses. Every violation also carries a $32 surcharge on top of the fine.

  • First offense: a Class A traffic infraction with a fine of $350 to $1,000.
  • Second offense: still a Class A traffic infraction, with the fine range narrowed to $600 to $1,000.
  • Third and subsequent offenses: a misdemeanor, with a fine of $1,000 to $5,000 and up to 10 hours of community service.

Fraud, Forgery, and Officer Authority

Forging, altering, or counterfeiting a disability placard or plate is a separate offense from parking without one. Colorado addresses fraud and trafficking of disability parking credentials under Sections 42-3-204 and 42-4-1208 of the Colorado Revised Statutes.1Colorado General Assembly. Officers can ask anyone using a disability placard or plate for proof of eligibility. If your identification does not match the placard registration, the officer can issue a citation or confiscate the placard. The DMV can also revoke a placard that was issued on false medical information or is being used fraudulently. Using Your Placard in Other States

Federal regulations require every state to honor disability placards and plates from other states and foreign countries.
