Who Qualifies
The Earnings Test
Colorado looks at your “base period,” which is the first four of the last five completed calendar quarters before you file.3Justia. How You Left the Job
The program is built for workers who are out of a job through no fault of their own.6Justia. Colorado Code 8-73-108 – Benefit Awards – Definitions Layoffs, restructurings, and position eliminations typically qualify. Firings and voluntary quits get closer scrutiny.
If you were fired for gross misconduct — willful disregard of the employer’s interests, threats against coworkers, or repeated reckless behavior — you face a 26-week disqualification. Lesser cause, like insubordination, policy violations, excessive tardiness, or walking away because you disliked standard working conditions, defers your benefits by ten weeks rather than barring them outright.6Justia. A voluntary resignation can still produce a full award if you can show a compelling employer-tied reason, such as unsafe conditions, discrimination, or a significant change to your job duties. CDLE reviews documentation from you and your employer before deciding, so save emails, write-ups, and anything else that supports your version at the time you leave.
How Much You’ll Receive
Colorado runs two formulas and pays whichever gives you the higher weekly amount.
- Formula 1: Add your wages from the two highest consecutive quarters in the base period, divide by 26, then multiply by 0.60. This formula caps at $767 per week.
- Formula 2: Add all wages from the full 12-month base period, divide by 52, then divide by 2. This formula caps at $844 per week.

How to File
Claims go through the MyUI+ portal.10Colorado Department of Labor & Employment. MyUI+ Have these ready before you start, because the session will time out if you stall:
- A government-issued photo ID (driver’s license, state ID, or passport). Identity verification runs through ID.me and requires uploading your ID and taking a selfie.11Colorado Department of Labor & Employment. Applying for UI Benefits
- Work history for the past 18 months: legal name and address of each employer, dates worked, and rate of pay.12Colorado Department of Labor & Employment. File a Claim
- A clear reason for leaving each job in that window.
- Proof of work authorization if you are not a U.S. citizen. Anyone 18 or older must show lawful presence to receive benefits.
You’ll pick direct deposit or a state-issued prepaid debit card for payments, and you’ll get a confirmation number at the end that documents your filing date. Keep it. Colorado also imposes a one-week waiting period at the start of every claim. By law, no benefits are paid for that first eligible week, though you still file the weekly certification for it.13Colorado Department of Labor and Employment. What You Must Do Every Week
Each week you want to be paid, you have to certify through MyUI+ that you were able to work, available for work, and actively looking. Miss the deadline and that week is gone. There is no grace period.
CDLE recommends at least five work-search activities per week.14Colorado Department of Labor & Employment. Within one week of filing, register with Connecting Colorado (online or at a local workforce center). Registration is mandatory and skipping it can jeopardize your claim.15Colorado Department of Labor & Employment. Getting You Back to Work
You also have to accept suitable work when it’s offered. CDLE weighs the rate of pay, your experience, and how long you’ve been unemployed.4Colorado Department of Labor & Employment. Eligibility and Work Search Requirements Early in your claim you have more room to hold out for a job that matches your prior pay and skill level. As weeks pass, the definition of suitable broadens and turning down reasonable offers gets riskier.
Working Part-Time While Collecting
Part-time or gig income doesn’t automatically knock you off the program. You can earn up to 50% of your weekly benefit amount with no reduction. Every dollar above that reduces your benefit dollar for dollar.1Colorado Department of Labor & Employment. FAQs On a $500 weekly benefit, earning $250 has no impact; earning $300 drops the benefit by $50. Report all earnings on your weekly certification, however small.
If Your Claim Is Denied
A denial comes with a Notice of Determination explaining why. You have 20 calendar days from the mailing date of that notice to appeal. Filing through MyUI+ is fastest. Mail and fax appeals use the form on the back of the notice but take longer. Explain clearly what you disagree with and why.16Colorado Department of Labor & Employment. Appeals FAQs
Hearings happen by phone, usually four to six weeks after you file the appeal, and typically run about an hour. You must check in by phone no later than 2 p.m. Mountain Time the day before the hearing, including on weekends. If you requested the appeal and don’t check in or participate, the appeal is dismissed.16Colorado Department of Labor & Employment. Appeals FAQs Both sides present evidence and question witnesses under oath. An attorney is allowed but not required.
Overpayments and Fraud
If CDLE later determines you were paid benefits you weren’t entitled to, you’ll get an overpayment notice and have to repay. Innocent causes are common (an employer reports wages late, for instance), and you can request a waiver on non-fraud overpayments if repayment would be against equity and good conscience. A waiver request is separate from an appeal.
Fraud is another matter. If the overpayment resulted from intentional misrepresentation, you’ll owe the amount plus a 65% monetary penalty, and CDLE can withhold up to 25% of any future benefit payments to offset the debt.17Justia. Taxes on Your Benefits
Unemployment benefits are taxable at the federal level. CDLE issues a 1099-G through your MyUI+ account, typically available by late January, showing the total benefits paid the prior year.19Colorado Department of Labor & Employment. Colorado income tax may also apply because the state generally follows federal adjusted gross income. Setting withholding at the start of the claim avoids a surprise bill the following April.
