To collect C&R guns in California legally, you need two credentials working together: a federal Type 03 Collector of Curios and Relics license and a California Certificate of Eligibility. With both in hand, you can move certain curio and relic firearms outside the state’s usual dealer-transfer requirements, skip the 10-day waiting period on qualifying pieces, and sidestep the one-handgun-per-30-days rule. The catch is that California layers its own reporting deadlines and configuration bans on top of federal law, and none of the collector exemptions rescue a firearm that violates the state’s assault weapon or magazine rules.
What Counts as a Curio or Relic
California does not write its own definition. State law points to the federal regulation at 27 CFR § 478.11, which recognizes a firearm as a C&R if it meets any of three tests: it was manufactured at least 50 years before the current date, a museum curator certifies it as a curio or relic of museum interest, or it derives most of its value from rarity, novelty, or association with a historical figure or event.1eCFR. 27 CFR 478.11 – Curios or Relics Replicas of old firearms do not qualify.
The ATF publishes a list of specific models it has formally recognized as C&R items, but because any firearm over 50 years old qualifies automatically on age alone, the list mostly captures younger firearms admitted under the other two criteria.2Bureau of Alcohol, Tobacco, Firearms and Explosives. The Two Licenses You Need
Federal Type 03 Collector’s License
The federal side is a Type 03 Federal Firearms License, sometimes called an FFL03 or C&R license. The license lets you acquire C&R firearms across state lines for a personal collection. It does not authorize you to deal in firearms as a business.
California Certificate of Eligibility
The state-level credential is a Certificate of Eligibility (COE) from the California Department of Justice. You submit fingerprints at a Live Scan station and complete the electronic application through the California Firearms Application Reporting System (CFARS).6California Department of Justice. Live Scan carries a $54 DOJ fee and a $17 FBI fee, totaling $71 in government fees before the Live Scan operator’s own rolling fee, which typically runs around $25 to $40 depending on location.6California Department of Justice. Both credentials must be active at the same time. If either lapses, the collector exemptions go with it.
Bringing a C&R Firearm Into California From Out of State
California’s general rule under Penal Code 27585 is that any firearm a resident acquires outside the state has to be delivered to a licensed California dealer for a standard transfer.8California Legislative Information. Within five days of bringing the firearm into California, file Form BOF 4100A with the DOJ along with a $19 processing fee.10California Department of Justice. BOF 4100A – Curio or Relic Firearm Report The window is short. Do the paperwork before you unpack.
If an out-of-state seller ships the firearm to you instead of handing it to you in person, the exemption doesn’t apply and the shipment has to route through a licensed California dealer.9California Legislative Information. California Penal Code 27565 – Collector Acquisition of Curio or Relic
Buying C&R Long Guns From Other Californians
Licensed collectors with an active COE can acquire C&R long guns from non-licensed California residents without going through a dealer. That matters, because every other private-party firearm transfer in the state must run through a dealer’s Record of Sale.11California Department of Justice. Frequently Asked Questions
After taking possession, file Form BOF 961 with the DOJ within 30 days. The form asks for make, model, serial number, and caliber, and carries a $19 processing fee.12California Department of Justice. Watch the deadlines. Out-of-state acquisitions report within five days. In-state long gun acquisitions report within thirty. Confusing the two is an easy way to trip a misdemeanor.
Handguns Are Treated Differently
The in-state private-party exemption under Form BOF 961 covers long guns only. A C&R handgun bought from another Californian still has to move through a licensed dealer.14California Department of Justice. Collector In-State Acquisition of Curio or Relic Long Gun Report
Out-of-state C&R handgun acquisitions do fall under the Penal Code 27565 exemption, so you can take personal possession outside California, transport it back yourself, and file Form BOF 4100A within five days.9California Legislative Information. California Penal Code 27565 – Collector Acquisition of Curio or Relic C&R handguns are also generally exempt from California’s roster of approved handguns, which is a meaningful benefit because many collectible models never appeared on that list.
Collector Privileges Worth Knowing
Beyond the transfer routes, the FFL03-plus-COE combination unlocks two smaller but useful exemptions. Collectors are exempt from the 10-day waiting period on transactions involving C&R firearms, according to the DOJ.11California Department of Justice. California’s one-handgun-per-30-days limit also has a collector carve-out. The DOJ recognizes that FFL03 and COE holders may acquire C&R handguns without being capped at one per month.11California Department of Justice. Federal Recordkeeping: The Bound Book
Every Type 03 licensee has to maintain a physical bound book logging every C&R acquisition and disposition, and the ATF can inspect it during business hours. Under 27 CFR § 478.125(f), acquisition entries record the date received, the name and address (or license number) of the seller, the manufacturer, importer (if any), model, serial number, type, and caliber or gauge. Disposition entries record the date of sale or transfer, the name and address (or license number) of the recipient, and date of birth and identification method for non-licensed transferees.15eCFR. 27 CFR 478.125 – Record of Receipt and Disposition
Acquisitions must be logged by the close of the next business day. Dispositions must be recorded within seven days. Keep the book indefinitely, even after the license expires. Missing or sloppy records are the fastest way to lose an FFL at renewal.
Configuration Laws C&R Status Does Not Override
Collector status changes how a firearm gets transferred. It does not change what California considers a legal configuration.
Assault Weapon Features
California defines assault weapons both by name in Penal Code 30510 and by generic characteristics in Penal Code 30515. Under the features test, a semiautomatic centerfire rifle with a detachable magazine and any one of several features, such as a pistol grip, folding stock, or flash suppressor, qualifies as an assault weapon.16California Legislative Information. A Cold War-era rifle with a detachable magazine and a pistol grip falls under the ban unless the magazine is permanently fixed.
Large-Capacity Magazines
Penal Code 32310 prohibits importing, buying, or receiving any magazine that holds more than 10 rounds.17California Legislative Information. The rifle can. Before importing, source a compliant magazine or have the original permanently modified to accept no more than 10 rounds.
The .50 BMG Carve-Out
One place the law works in a collector’s favor: Penal Code 30530 explicitly excludes curios and relics from its definition of “.50 BMG rifle.”18California Legislative Information. Penalties for Getting It Wrong
Missing a report or blowing through the transfer rules is generally a misdemeanor under Penal Code 27590, punishable by up to one year in county jail. The charge escalates in the presence of aggravating factors. Prior firearms-transfer convictions, membership in a prohibited class such as a convicted felon, or gang involvement can push the offense into a two-, three-, or four-year state prison term.19California Legislative Information. Configuration violations carry their own penalties.
