The statute of limitations has expired. Every state sets a deadline for filing a debt collection suit. Texas allows four years. The wrong creditor is named. In Bryan v. Credit Control, L.L.C., decided by the U.S. Court of Appeals for the Second Circuit in 2020, a collection letter listed Kohl’s Department Stores as the client and Chase Bank as the original credit grantor but never named Capital One, the actual creditor. The Second Circuit held that the consumer had plausibly pleaded a violation of the FDCPA’s validation-notice requirement, writing that Kohl’s participation in a credit card program did “not necessarily convert Kohl’s into a creditor, and certainly not into the creditor to whom the debt is owed.”8National Consumer Law Center. The collector lacks documentation. The plaintiff must prove the debt, its amount, and the chain of ownership. Collectors that purchased charged-off accounts sometimes cannot produce the original account records.

Your Debt Validation Rights
Before any lawsuit, federal law gives you the right to see proof of the debt. Under the FDCPA and the Consumer Financial Protection Bureau’s Regulation F, a debt collector must send you a written validation notice either during or within five days of its first communication.9Consumer Financial Protection Bureau. You then have 30 days from receiving the notice to dispute it in writing. Anything the collector does that “overshadows or is inconsistent with” your 30-day dispute window violates the statute.10Cornell Law Institute. 15 U.S. Code § 1692g – Validation of Debts That was the theory in Lopez v. Credit Control, LLC, a proposed class action filed in the U.S. District Court for the Middle District of Florida in May 2017 (case number 8:17-cv-01145). When You Can Sue Credit Control
The FDCPA gives consumers a private right of action. If a collector violates the statute, you can sue in state or federal court within one year of the violation. Filing a Complaint Without Going to Court
You can report suspected violations to the CFPB, the FTC, or your state attorney general. The Better Business Bureau also accepts complaints and forwards them for a response. As of mid-2026, the BBB lists 387 complaints against Credit Control LLC over the prior three years, with 104 closed in the most recent twelve months and 292 categorized as billing issues.
