Curtis Reeves Case: Theater Shooting, Trial, and Acquittal

The Curtis Reeves movie theater shooting was a January 13, 2014 killing in Wesley Chapel, Florida, in which Reeves, a 71-year-old retired Tampa police captain, fatally shot 43-year-old Chad Oulson during an argument over cellphone use before a screening of “Lone Survivor.” Reeves was charged with second-degree murder and aggravated battery, claimed self-defense, and after more than eight years of pretrial litigation was acquitted by a Pasco County jury on February 25, 2022.¹

What Happened Inside the Theater

Reeves and his wife were seated at the Cobb Grove 16 Theater in Wesley Chapel, a Pasco County community north of Tampa. During the previews, Chad Oulson was using his cellphone to reach the babysitter watching his young daughter. Reeves told him to put the phone away, and the two men began arguing.¹

According to a criminal complaint and surveillance footage, Oulson grabbed a bag of popcorn and threw it at Reeves. Reeves then drew a .380-caliber handgun and fired a single shot. The bullet passed through the hand of Oulson’s wife, Nicole, who had raised her arm in front of her husband, and struck Oulson in the chest. He died at a hospital.²

Reeves later claimed Oulson had also thrown a cellphone that struck him and was lunging over the seat toward him. Prosecutors said witnesses did not corroborate the cellphone claim, and a judge who reviewed the surveillance video in 2017 concluded the supposed phone was “simply a reflection from the defendant’s shoes.”³

Who Curtis Reeves Is

Reeves joined the Tampa Police Department in 1966 and retired in 1993 as a captain after nearly three decades. He worked as a homicide detective and a property crimes detective, served as an instructor, and held a command role for roughly 16 to 17 years.⁴ He helped establish the department’s first tactical response team and worked in robbery/homicide, fugitive apprehension, and SWAT.⁵ He also worked security details for Presidents Ronald Reagan, George H.W. Bush, and Bill Clinton. That background would become central to the defense’s argument at trial.

Chad Oulson

Chad Wayne Oulson was a 43-year-old Navy veteran who served from 1990 to 1997, including during Operation Desert Storm, as an aviation maintenance administration petty officer second class.⁶ He left behind his wife, Nicole, and their 22-month-old daughter, Alexis. At a press conference shortly after the shooting, Nicole Oulson said, “In the blink of an eye, my whole world just got shattered into a million pieces and now I’m left trying to pick them up and put them all back together.”⁷

Charges and an Eight-Year Wait for Trial

Reeves was arrested the day of the shooting and charged with second-degree murder for killing Chad Oulson and aggravated battery for wounding Nicole Oulson. He pleaded not guilty on February 5, 2014, before Pasco County Circuit Judge Pat Siracusa and was initially held without bail.⁸ In July 2014 an appeals court granted him a $150,000 bond with house arrest, GPS monitoring, surrender of firearms, and a no-contact order regarding Nicole Oulson.⁹ He remained on pretrial release for roughly seven and a half years.¹⁰

Trial dates set for 2019, 2020, and 2021 were all postponed. The delay was attributed to numerous pretrial motions and hearings, Stand Your Ground litigation, and the COVID-19 pandemic.¹⁰ T.J. Grimaldi, an attorney for Nicole Oulson, called the timeline “embarrassing” and argued it benefited Reeves by letting him stay home rather than in custody.¹¹

The Stand Your Ground Ruling

Reeves’s defense team, led by attorney Richard Escobar, filed a motion in October 2015 seeking pretrial immunity under Florida’s Stand Your Ground law. Pinellas-Pasco Circuit Judge Susan Barthle held two weeks of testimony in February 2017 and denied the motion.¹⁰ Barthle ruled that deadly force “was not necessary” and found Reeves’s account “significantly at odds with the physical evidence and other witness testimony.” She said she had “considerable doubts” about his credibility and concluded the circumstances were not among those “envisioned by the Legislature when the ‘stand your ground’ law was enacted.”¹²

An appeal of that ruling was denied in May 2018. The denial did not bar Reeves from arguing traditional self-defense before a jury at trial.¹⁰

Inside the 2022 Trial

The trial proceeded before Judge Barthle in Pasco County and ran roughly three weeks, with nine days of testimony and nearly nine hours of closing arguments. Reeves was 79 by the time it began.¹⁰

The Prosecution

Prosecutor Scott Rosenwasser argued Reeves shot Oulson out of anger and wounded pride, not fear. He described an “alpha male mindset” and framed the killing as an overreaction to popcorn in the face. “He didn’t fear anything,” Rosenwasser told jurors.¹³

Nicole Oulson testified her husband had already put his phone away and that she saw no aggression from him before the shot. Witness Charles Cummings described “popcorn in the air then a flash, bang,” followed by Oulson saying, “I can’t believe he shot me.”¹⁴ Rosenwasser also pointed to testimony that Reeves was heard muttering “throw popcorn at me” immediately after firing.¹³

Prosecutors used surveillance video to attack Reeves’s account, arguing it did not show a cellphone being thrown and that Reeves was not trapped in his seat. A paramedic testified he flushed Reeves’s eye with water after the shooting and observed no injury. Medical examiner Dr. Jon Thogmartin testified a cellphone impact would not have caused the injury Reeves described.¹⁴ Rosenwasser questioned how a veteran SWAT commander who had navigated high-stakes assignments without firing his weapon could call a moviegoer the “most out-of-control, scariest person he ever faced.”¹³

The Defense

Escobar cast Reeves as a frail, elderly man confronted by a younger and aggressive adversary. Reeves’s daughter, Jennifer Shaw, testified her father’s health had declined in his seventies and that he had “lost a step or two,” with arthritis affecting his hands.¹⁵

The defense leaned heavily on Reeves’s police background, arguing his decades of training in the justifiable use of deadly force made him uniquely qualified to assess a threat. Escobar told jurors Reeves “had more knowledge, more experience, more study in that area than anyone in this courtroom.”¹⁶ He also pointed to Florida law providing that attacking someone over 65 is a felony, reinforcing the argument that Reeves had reason to fear serious harm.¹⁷

The defense attacked the police investigation as well, accusing lead detective Aaron Smith of failing to secure Oulson’s phone for DNA testing and potentially allowing exculpatory evidence to be “contaminated or accidentally destroyed.”¹⁵ In closing, Escobar argued the interval between the popcorn being thrown and the gunshot was less than three-quarters of a second, making it “impossible” that Reeves fired simply because he was hit with popcorn. “It’s a dangerous world,” he told jurors.¹⁶

The Verdict and Reactions

On the evening of February 25, 2022, after roughly three and a half hours of deliberation, the jury found Reeves not guilty of both second-degree murder and aggravated battery.²

In a March 2022 interview with ABC News, Reeves maintained the shooting was self-defense, describing Oulson’s actions as a “vicious attack” and saying he was unaware popcorn had hit him until after he fired. “It was something that was, I had no control over. He’s the only one that could have kept it from happening.” He added, “I wish that none of this would have happened at all,” and said he had no contact with the Oulson family.¹⁸

Nicole Oulson said the jury “got it wrong” and that the trial had portrayed her husband, an “amazing man,” as a “monster and the aggressor.” She vowed to keep speaking out.¹⁸

Civil Settlements

The criminal acquittal was not the end of the case. Nicole Oulson filed a wrongful death lawsuit against Reeves and separate negligence suits against Cobb Theaters, a theater employee named Thomas Peck, and the shopping center’s developer, alleging the theater and its staff failed to enforce a prohibition on weapons.¹⁹ She received undisclosed settlements from the wrongful death action against Reeves and from the negligence suits.²⁰

Why the Case Still Matters

The Reeves case became one of the most prominent tests of Florida’s Stand Your Ground law since the 2012 shooting of Trayvon Martin and the trial of George Zimmerman, drawing outsized attention because the underlying dispute was so ordinary: an argument over a phone during previews that ended in a killing.³ Grimaldi called the defense’s use of the statute a “bastardization of the ‘stand your ground’ law,” saying, “You cannot convince me that the legislature’s intent was to pass a law that when someone throws popcorn on someone else, that person can shoot them.”²¹ Reeves lost his pretrial Stand Your Ground hearing, yet a jury still accepted a self-defense argument at trial, a split outcome that shaped commentary on how broadly the law’s principles reach once a case gets in front of jurors.
