Dahvie Vanity, the Blood on the Dance Floor frontman whose legal name is Jesus David Torres, has been publicly accused of sexual misconduct by at least 21 women, 16 of whom say they were minors at the time. He has never been criminally charged. The allegations against Dahvie Vanity span more than a decade and at least 12 U.S. states and two Canadian provinces, yet two documented police encounters ended without prosecution, the statute of limitations has run on the oldest cases, and most accusers never filed reports at the time.1HuffPost. What Torres Is Accused Of
The earliest allegations date to 2006, when two 15-year-old girls reported being assaulted. Accusers range in age from 13 to 18 at the time of the alleged incidents, with two saying they were 13 when Torres, then in his late twenties, assaulted them. The accusations include rape, molestation, groping, and forced oral sex. Seven women reported being raped or molested, and most described being forced to perform oral sex.2Alt Press. Accusers described a recurring pattern: Torres used his celebrity to make contact with young fans online or by phone, then brought them to tour buses or apartments. Seventeen of the 21 accusers were quoted using their real names in HuffPost’s 2019 investigation, among them Dianna Farrell, Kristin Gonzalez, Kate Offutt, Tiffany Galvez, and Megan Hood.1HuffPost. The 2007 Florida Case That Ended in a Warning
The most-documented police encounter happened in June 2007. Dianna Farrell, then 14, reported to the Pinellas County Sheriff’s Office that Torres had come to her home on the pretext of styling her hair and then forced her to perform oral sex. Captain Kurt Romanosky of the Crimes Against Children squad reached Torres by phone. Torres admitted to the sexual contact but said he had not known the girl’s age.1HuffPost. Dahvie Vanity BOTDF Sexual Assault Under Florida law, not knowing the victim’s age is not a defense to such an offense.3Business Insider. Dahvie Vanity Let Off With Warning After Alleged Rape in 2007
Romanosky did not arrest him. Instead, he told Torres the victim’s mother would not pursue charges if he stopped contacting her daughter. Torres apologized and agreed. The case was closed with the notation “Victim Refuses Cooperation with Prosecution.”4Jezebel. Police Reportedly Let Dahvie Vanity Off With a Warning Former sex crimes prosecutor Boz Tchividjian later called the decision not to arrest Torres “incredibly lazy, sloppy, and irresponsible,” noting that police and prosecutors can proceed without victim cooperation, especially in cases involving minors, where consent is legally irrelevant.1HuffPost. The 2009 Denver Arrest That Produced No Charges
On September 12, 2009, Denver police arrested Torres at a performance venue after a teenage girl said he had forced her to perform oral sex. Former bandmate Garrett McLaughlin, who performed as “Garrett Ecstasy,” said he and a friend had found Torres alone on the tour bus with two teenage girls shortly before the band was due onstage. McLaughlin said that during the show police took Torres into custody, and that he saw one of the girls crying in the parking lot while telling an officer what had happened.1HuffPost. Torres was released after a few days without being charged. In a video statement, he said his accuser had “mental issues” and “failed a rape kit,” and hinted at a possible out-of-court settlement. Colorado authorities declined to comment, saying the records were sealed.1HuffPost. Dahvie Vanity BOTDF Sexual Assault
Why the Statute of Limitations Now Blocks the Oldest Cases
By the time the allegations drew wide public attention in 2019, the statute of limitations had already run on the 2007 case.4Jezebel. Police Reportedly Let Dahvie Vanity Off With a Warning Florida lawmakers introduced SB 130 in 2019 to let prosecutors file sexual battery charges at any time when the survivor was a minor at the time of the assault. For offenses committed on or after July 1, 2020, there is no time limit for sexual battery against a victim under 18.5RAINN. Policy Crime Definitions – Florida
For earlier offenses the picture is more complicated. There is no time limit for offenses against victims under 16, but limitations periods and reporting requirements apply for older teen victims. And Florida courts have held that extensions of the statute of limitations cannot be applied retroactively if the original period had already expired before the new law took effect.5RAINN. Policy Crime Definitions – Florida For an allegation like the 2007 case, where the clock had already run out, the reforms arrived too late.
Why Most Accusers Never Went to Police
Most of the alleged victims did not file reports at the time. Accusers cited a “word against his” dynamic, a lack of physical evidence, and the intimidation of speaking out against a public figure with a devoted fanbase.1HuffPost. Dahvie Vanity BOTDF Sexual Assault Ash Costello, vocalist for New Years Day, said she did eventually file a police report over an incident at a Milwaukee venue in which she alleged Torres choked her, but that it went nowhere because of jurisdictional issues. She has said she continues to receive legal threats from Torres whenever she speaks publicly.6Loudwire. New Years Day Ash Costello Dahvie Vanity Allegations
Current Status With Law Enforcement
Torres has no criminal record and does not appear on any sex offender registry. Authorities in central Florida, where he lives, have said there are no complaints against him in their jurisdiction, giving them “no basis for an investigation.” The FBI has said it “neither confirms nor denies the existence of an investigation.”1HuffPost. How the Allegations Became Public
Three investigations drove the story. MetalSucks published an exposé in August 2018 detailing allegations of sexual assault, forced oral sex, and emotional manipulation.7Vice. Several people who worked closely with Torres have publicly broken with him. Jayy Von Monroe, who was a core member of Blood on the Dance Floor, quit the band and called Torres a “sexual predator,” accusing him of “disturbing behavior toward teenage girls.”10Billboard. Torres’s Response
Torres has largely avoided directly addressing the allegations. He did not respond to repeated requests for comment from HuffPost during its 2018 investigation.8HuffPost.
